THE JURY FAILS TO AGREE AND
THE PRISONER IS GIVEN
WHAT WAS DONE IN THE JURY
ROOM, AND THE PRESS ON

sel looked rather cheerful. When tho
jury ontcrcd, tho foreman announced that
they could come to no ugrcemcnt what
ever. Tho Judge thereupon discharged
them. Stokes was taken back to tho
Tho following particulars of tho pro
ceedings of thojury tire given :
On Saturday evening, when they lint
rotlrcd to deliberate, a ballot was taken,
which resulted in saven for murder in the
first degree, threo for acquittal, and two
for man slaughter in tho third degree.
The names of tho seven for murder are
-Meyer Hamburger, liennett Williams, N.
M. Cornish, Jtyron Stone, John E. F.
Bond, Pelor E. Hawkins, and M. A. Sef
fvrts. Iho Jurors for Hciuiltal were Rod
erick Hogun, M. II. Thompson, and John
Tucker, and two for manslaughter in tho
third degree, were Theodore Klummu and
Henry U. Whittle. This state of affairs
remained until the jury came into court
and got Col. Fislc's clothes. The clothes
were nil tried on one of tho jurors, and
they arrived at tho conclusion that

consequently that the tlnory of Fisk draw
ing it pistol was humbug. This influenced
tho threo for ucquittul to veer around for
manslaughter in tho third degree
The medical testimony was thrown out
altogether, all believing tho wound mortal
from tho first, and tho question of Insanity
w s barely referred to. There was a lonj;
ulhcuislori as to the premeditation. All
tho jurors were of tho opinion that .Stokes
never went to tho Grand Central Hotel
with tho premeditated design of meeting
and killing Fisk. The seven jurors who
wuro for murder believe thnt when Stokes
met Fisk on the stairs, in a moment ho
formed in his mind tho design of killing
Fisk, and that this second was sufficient
time for premeditation. Tho flvo jurors
stoutly maintained that Stokes pulled tho
pistol in tho heat of passion, being stirred
by frenzy by tho sicbt of Fisk, and that
his crime was only manslaughter in the
third degree. The debate on this sido be
came quite exciting, and some harsh words
were used on both sides.
Timo and again a poll was taken, but
all no purpose. Firm to their opinion
they all remained, and at last fell asleep,
but woke up in precisely the samo stato of
mind. Finally they gave up the dispute,
seeing that there was no hope of altering
their opinions. It is the opinion of several
jurors that if they were allowed to bring
in u veruici ol inuruer in the second
degree, or manslaughter in ono of its higher
degrees, iney would navo airived at a
verdict; but "this was not allowed them,
as the judge charged them they should
either find it verdict of murder in the first
degree, manslaughter in the third degree,
in application for ball will be made in
u few days.
COMMENTS or THE FKEbS.
The preti comment on the result in the
Stokes case. The Express calls it a farce
a contempt of common sense. Here
after, it says, murder is no crime, but a
little trial, a disagreement at first and
finally an acquittal. The Commercial
blames tho law, which allows no in
termediate verdict between inurder in the
first degree and manslaughter in the third
