Em erson was tried. Lord & Horton, the contractors built the building in which the Arcade is located brot suit against the owner, Mr. Eme» son for something over $3000, which they claim is due them om the building. Mr. Emerson claims that the building was not erected accord ing to plana and specifications, and in his defense, makes numerous claims, to show the faulty construc tion of the same. Mr.. Emerson is represented by Le Sueur, Bradford & Hurley. The case hag been tak en under advisement. CONTEST NOTICE. Department of the Interior, United States Land Office, Minot, N. D. Aug. 31, 1908. A sufficient contest affidavit hav ing been filed in this office 'by Val entine Jeczmionka, contestant, against homestead entry No. 45081, made June 18, 1907, for SE 1-4 of NW 1-4 and lots 3 and 4, section 1, township 152, range 92, by Herman Schultz conte&tee ,in which it is al leged that said entryman has not since the date of his filing thereon, established or had his residence thereou that since that time he has been absent therefrom that the same has not ibeen in any manner cultivated nor improved that said al leged albsence from the said land was not due to his employment in the army, navy or marine corps of the United States as a private sol dier, officer, seaman or marine dur ing the war with Spain or during any other war in which the Un!ted States may be engaged said parties are hereby notified to appear, re spond and offer evidence touching said allegation at 10 o'clock a. m. on November 20, 1908, before the Reg ister and Receiver at the United States Land Office in MinOt, N. D. The said contestant having, in a proper affidavit, filed Sept.. 15, 1908, set forth facts which show that after due diligence personal service of this notice ran not foe made, it is hereby ordered and directed that such notice he given (by due and proper publication.
