That we, whose names are hereunto subscribed have this day united our selves together to form an associa tion for carrying on th* business of under the laws of the state •f North Dakota, and have adopted and executed Articles of Association, In duplicate, for that purpose, and have duly forwarded a copy of such articles to the secretary of atate of North Dakota that we do hereby under our hands make and file the following as our certificate of or ganization: First.—The name of said corpora tion is German American Bank (of Burlington, N. D.) Second—The place where the busi ness of discount and deposit are to he carried on is Burlington, Ward County, N. D. Third—The amount of the capital stock and the amount into which its shares are to be divided is fifteen thousand dollars divided into one hundred fifty shares. Fourth—The names and places of residence of the shareholders and the number of shares held by each of them as follows: Jourgen Olson, Minot, N. D., 110. Fred Spath, Minot, N. D., 30. John H. Werner, Burlington, N. D., 10. Fifth—The period at which this corporation shall commence business shall be April 15th, 1909, and it shall terminate April 15th, 1934. In Witness Whereof. A sufficient contest affidavit having been filed in this office by Peter P. Underdahl, contestant, against home stead Entry No. 44441, made Feb. 26, 1907, for NE 1-4 NW 1-4, sec. 18 and NW 1-4 SE 1-4, 1-2 SW 1-4 Sec. 7, township 153, range 85 W 5th P. Meridian, by Walter F. Nichols con testee, in which it is alleged that said entryman has not sincc the date of his filing thereon established or had his residence thereon that since that time he has and now does reside else where than thereon that he has not made any improvements thereon of any kind that the said land remains in its natural state, wild, unbroken and unimproved prairie land that said said entryman has wholly aban doned the same for more than six months last past, said parties ar* hereby notified to appear, respond, and offer evidence touching said alle gation at 10 o'clock a. m. on May 25, 1909, before the Register and Re ceiver at the United States Land office in Minot, N. D. The said contestant having, in a proper affidavit, filed April 6, 1909, set forth facts which show that after due diligence personal service of this notice can not be made, It Is hereby ordered and directed that such notice be given by due and proper publication.
