The Federal Jury Convicts
Three; Other Smuggling
Cases in Federal
Court.
Mar Been Kee, manager of the Wing
Hong Yuen Co., on South Oregon
street and one of the most prominent
Chinese in the El Paso colony of ori
entals, and Tee Kim Yok and Charlie
Soo were adjudged guilts' of the
charge of conspiring to smuggle Chi
nese persons into the United States
who were not entitled to enter or re
main in this country.
The verdict was agreed upon Wed
nesday afternoon after a session "of
10 minutes and sealed and placed in
the hands of the district clerk. It was
read in open court Thursday, morning,
all three of the defendants being ad
iudeed guilty. Sentence, which was
temporarily deferred by judge Maxey,
will probably be announced Saturday.
The government's charge constitutes
a penal offense, and the punishment is
imprisonment in the federal peniten
tiary. Mar Been Kee is one of the largest
Chinese property owners in El Paso.
Besides being interested in the Wing
Hong Yuen company, on South Ore
gon street, he owns a string of res
taurants located at San Francisco,

Tee Kim Yok, an old man, owns a drug
store on South Oregon street, and
Charlie Soo, an alien Chinaman who
lived in Juarez, has a restaurant in
Juarez.
The case of the government against
Victor H. Tobin, Chas. E. Crawford,
Isaac Blum, jr., Tee Mun Li and Tee
Gin, charged with conspiracy to
smuggle Chinese laborers Into the
United States, did not go to trial, as
Tobin, Crawford and Blum entered a
plea of guilty. Their sentence has
been temporarily deferred. Yee Mun
Li and Yee Gin have not been ar
rested. Wiliiam Sullivan, charged with
smuggling and receiving smuggled
property, was fined $40 and discharged
upon the payment of the fine.

William J. Hew'itt, charged with un
lawfully secreting and destroying a
letter and embezzling the contents, was
continued until the next term on mo

Chin Kee, charged with uttering and
publishing a false writing for the pur
pose of defrauding the United States,
was continued upon the application of
the defendant
Fred Collins, charged with smug
gling, pleaded not guilty, and a jury
was empaneled to try the case. The
case is on trial.
TROPICAL STORM "WARNING
IS SENT TO GULF TOWNS
Mobile. Ala., Oct. 13. The local
weather bureau received warning from
Washington today that a tropical storm
of considerable intensity is raging In
Yucatan channel and heading toward
the Gulf of Mexico. Vessels in these
waters are cautioned.

The government's final crop report
for the - season on the condition of
cotton is as follows:
North Carolina, 72, showing a decline

The average condition as given was
65.9 percent of normal as compared
with 72.1 on Aug. 25; 58.5 on Sept 25,
1909; 69.7 on Sept 25, 190S, and 66.6 the
average for the past te nyears.
Preceding this publication the census
bureau issued a report placing the
amount of cdtton ginned up to Sept 25
from the growth of 1910 at 2,302,211
bales, as compared with 2,568,150 bales
ginned to the same date last year. This
report in some quarters was pointed to
as indicating a smaller crop than last
year. It is hardly fair, however, sim
ply because less cotton has been ginned
to make such a deduction; rather does
it add testimony to the correctness of
our reports from different sections
of the belt as to the lateness of the
crop, and this is practically its only
bearing on present market movements.
The government report was in line
with previous trade estimates, the con
sensus of opinion from these sources
having figuied the condition at 66.7.
In this connection it is gratifying to
note the increasing reliability of the
government estimates and that the de
plorable conditions of a few years ago
no longer exist; hence, making due al
lowances for an inclination to underes
timate conditions and overestimate
acreage, the reports are now to be de
pended upon.
The report issued Monday points to
a crop of about 11,700,000 bales if it
be accepted that 33,196,000 acres were
planted to the staple, as reported ear
lier in the year. Some critics, "however,
are inclined to question the acreage;
assuming, nevertheless, that the gov
ernment figures are correct, the total
yield .as indicated must be looked upon
as" the maximum.
From now on the all important fac
tor is weather and a close watch is be
ing kept on every climatic change
throughout the cotton xbelt for it must
be admitted that killing frost prior to
Nov. 1 would result In further mate
rially reducing the ultimate yield. This
would be most serious, for nearly all
of the manufacturing centers, both at
home and abroad, are bare of the sta
ple, and it is believed that close to
13,000,000 bales of American cotton,
will be required to supply the normal
demand from the world's spindles.
It must be borne in mind, however,
that, as in previous years where short
crops existed, the demand has been
made to fit the supply,, and it is rea
sonable to assume, judging from the
past, that from now on as the price ad
vances the demand of necessity will be
lessened.
Last year's cotton crop amounted to
10,350,078 bales apparently an inade
quate supply and yet on August 31,
when new cotton commenced coming
to market there still remained on hand
a stock of 939,803 bales only 543,782
bales less than the previous year,
which followed a crop of 13,029,902
bales, and this compares with a stock
on hand at the same date in 190S of
1,236,058 bales and 1,044,329 bales in
1907.
It should not be lost sight of that the
price of cotton for, say, May delivery',
now approximates the extraordinarily
high figure of 15 cents per pound
which, it must be admitted, has already
largely discounted a second small crop.
It is feared that a good many of the
recent purchases of cotton for future
delivery have been on behalf of people
who may not be in a position to stand
a serious setback should one take
place, and for this reason it would
seem rather risky for one to purchase
freely at this high level without at
leas't the protection of a stop loss or
der. Receipts show a slight falling of f ram
last week, but the movement to market
is in fair volume and prospects for
the coming week point to very liberal
arrivals, both at Interior points and
the ports.

MISS MAUD ATKINS.
Miss Maud Atkins, 24 years old,
daughter of .J. YV. Atkins, of Shreve
port, La., died at a local sanatorium
Thursday morning at 11:30 oclock after
a short illness, she having been In El
Paso only a few days. At the deathbed
were her mother and her uncle, ir.
Hugh Atkins, who will accompany the
body to Shreveport on the T. P. Thurs
day evening.

IN JAIL AND OUT AGAIN
Tee Ten Get got, Wednesday night.
He got in trouble, got in jail and got
In police court Thursday afternoon.
Tee Ten, alias Charley, was arrested
with a charge of selling liquor unlaw
fully, registered against him, and his
arrest was dignified with a warrant
with the official seal attached. Mr.
Get got his friends to goo n his bond
for $50 and he immediately got back
to Chinatown.
ARMY OFFICER TRANSFERRED.
Major Jiminez Castro, second in com
mand of the Mexican troops stationed
at Ciudad Juarez, has received orders
transferring him to Vera Cruz. He
will leave this month. Major Castro
has been stationed many 5-ears at the
border garrison, and is known by marny
Americans of EI" Paso. His successor
has not been named.

rested on Charge of Murr
der; Eeleased on Bond.
Private Joseph T. Desmond, of com
pany E, 23rd infantry, stationed at
Fort Hliss, died Wednesday evening
from the effects of injuries which he
is said to have received in the Coney
Island saloon late Tuesday afternoon.
Edward Warren, a bartender at the
Coney Island, was placed under arrest
at the time of the trouble, charged
with assault to murder, and placed on
bond. Later he was rearrested on the
charge of murder in the second degree,
and the amount of his bond, originally
fixed at $1000, increased to $3000. This
was signed by Tom Powers, proprietor
of the Coney Island and J. T. Cannon
and Warren was given his liberty.
A post mortem exaination was
made of the body of private Desmond
at Fort Bliss Wednesday evening, in
the presence of justice of the peace
E. H. Watson. It was found that death
had occurred from concussion of the
brain, thought to have been, brought
about by a blow on the head with a
hottle. Desmond was struck twice, once
on the forehead and once over the left
ear. according to justice Watsdn. The
skull was not fractured but the con
cussion resulting from the blow caused
death. "Warren, who is said to be un
married and who lived at 712 St Vrain
street was placed under arrest bv
deputy constable Brown upon com
plaint of the police department He was
liberated late Wednesday night and
will be given a preliminary hearing
before justice Watson Thursday even
ing at 7:30 p. m.
Private Desmond was serving his
first enlistment and had been in the
service two and one-half years. He was
about 34 years of age and has a moth
er. Mrs. J. K. Harcourt living on Madi
son avenue. Chicago. The body of Des
mond is in charge of his comrades at
the army post and will be prepared for
burial. It has not yet been decided
whether the body will be returned to
Chicago or interred at the post ceme
