Order of Sale Under School Fond
Mortgage.
To the Sheriff of Cape Girardeau
County. Missouri (Jreetinjf:
Whereas, On the eighth day of
August lsss. Augustus V. Thompson
and Cynthia Thompson borrowed of
the County of Cajw Girardeau in the
State of Missouri, the sum of one
thousand dollars, belonging to the
Capital School Funds of said county,
for which said sum of borrowed
money, the said Augustus V. Thomp
son and Cynthia Thompson as princi
pals, v.ith Jasper X. lirooks. Alfred
Minton and ltobert L. Taylor as
securities, executed a bond to the
said county, bearing date the eighth
day of August 1 !. in which said bond
the said principals and securities agiv-e
and bind themselves to pay to the said
county, for the use and b-ne'it of the
county School Fund hes-ein before men
tioned, on or lefore the eighth day of
August l'. the said sum of borrowed
money, with interest thereon from the
date of said bond, until paid
at the
rate of eight er cent, jx-r annum:
said interest to be paid annually on
the eighth 'ay of August, in each and
every year, until the whole debt should
be paid off and discharged. And.
Whereas. In consideration of the
premises, and to secure the paymct of
said sum f borrowed money, when
the sain.? should b-eoine due. on the
eighth day of August Iss'.t, the said
Augustus VY . Ihompsoti and Cyntuia
Thompson executed and delivered to
the said county, for tin; use and liene

certain mortgage deed, whereby they
conveyed to the said comity the fol

of land, lying, being and situate in

aforesaid, viz:

L'pon this express condition, how
over: That if the said principals and
securities should well and truly pay.
or cause to Ik; paid, the said sum of
borrowed money, and all the inteivst
thereon, according to the tenor and
eject of said bond, that then, in that
case, said Mortgage I iced should lie
come void: ami that if default should
lie made in the payment of the said
sum of borrowed money, or the inter
est thereon, or any part thereof, at
tiie time when they should severally
become due and payable, according to
the tenor and effect of said bond, that
then the then acting Sheriff of Cape
Girardeau county aforesaid should,
(without any suit on said mortgage
deed.) proc-ed to sell at piibiicauction.
to the highest bidder, for cash in
hand, the proicrty therein conveyed
and mortgaged, lirst giving twenty
days public notice of the time, terms
and place of sale, by publication in
some newspaper published in said
county: and out of the proceeds of
said sale to pay the costs attending
such sail, and then the debt and in
terest due. the county oi Cape Girar
deau as aforesaid: which said mort
gage d I'd was recorded in the ollice
of the Recorder of said county of
'ajie Girardeau, in Book M. at page
three hundred and fourteen.
And. whereas, the County Court of
CaK" Girardeau County aforesaid, by
an order made and entered of record
on the lifth day of February. lx'X, doth
find that default has lieen made in the
payment of the said sum of money, ac
cording to the tenor and effect of said
bond, and that the said Augustus W.
Thompson and Cynthia Thompson are
now indebted to the sale county for the
use of said School Fund in the sum of
one thousand and thirty-four dollars
and fifty cents, principal and inteivst.
computed to this date, due and unpaid
upon said bond, and then and there
dins-ted that judgment therefor should
lie entered against said principals and
their securities in said bond, and that
an order of sale of the property d
scrilied in said Mortgage Deed should
issue to satisfy the same.
Now. Therefore. You. the Sheriff of

mentioned sum of money upon the real

sell the said real estate according to
law to satisfy said debt, inte.-est and
