SURVEYORS LAYING OUT ROUTE A street railway system is the next metropolitan feature to be giv en towns of the Meaaba range. Surveyors are already out and work will be commenced as soon as a right-of-way is secured. The first step will be the building of an elec tric railway between Virginia and Kveleth. A company composed of well known capitalists has just been or ganized and articles of corporation were filed in the register of deeds office this morning. Those forming the corporation are: G. G. Hartley, O. D. Kinney, Geo. W. Buck, H. B. Fryberger and H. C. Fulton. There are some Buffalo capitalists inter ested in the enterprise, although their names are not given. The birth of the corporation be gins tomorrow morning, and its life is to continue for fifty years. 'The capital stock consists of 500 shares of $100 each, making $50,000. The limit of indebtedness is $5,000,000. How extensive the new concern, which is known as the Missaba Electric Railway company, will en ter the transportation business at this time is not known,but it is said that before many years have passed an electric railway system will con nect all of the small towns, cities and villages on the Mesaba range. The articles of incorporation also call for supplying commercial lighting and public lights in the towns that will be touched. O. D. Kinney, one of the prime movers of the new enterprise, said today that there was little to be given out at this time concerning the new company. Surveyors are now laying out a line between Ev eleth and Virginia," .-said he, '"and the intention is to have a system in operation next spring. The work will begin as soon as we secure a right-of-way." It has long been thought that it was a matter of but a few years be fore an electric system would be found on the ranges, and it has re mained for Duiuth capitalists to see the importance of it. The rapid growth of the mining towns and the excellent outlook for the future ap pealed to the men interested in the Missabe company. The distance between Virginia and Eveleth is but four and a half miles, and the elec tric line connecting those two points will be a great convenience to the people living there, the traffic be ing very heavy. The system will be equipped with the most modern machinery and up-to-date cars, and everything will be brand new. The announcement will be welcomed by the people of the range and the many others who have extensive business there.—Du iuth Evening Herald. An ordinance prohibiting: the keeping of unlicensed dogs within the limits of the Village of Buhl prescribing the sums to be paid for the license of dogs kept, and prescribing further the penalty for the violation of this said ordinance. The Village Council of the Village of Buhl do ordain: Sec. 1. It shall be unlawful for any person to keep or own any dog within the limits of the Village of Buhl, St. Louis County, (Minnesota, without first havihg said dog licensed, listed and registered as hereinafter provided. Sec. 2. Every person owning a dog within the limits of said Village shall, on or before the first day of May each year,, and every year thereafter, pay or cause to be paid to the treasurer of saidi Village for each male dog so kept, the sum of $1.00 and for each female dog so kept the sum of $3.00, for which payment the said treas urer shall issue a receipt for the amount received to the person paying the same or to the person on whose behalf the same is paid, and which receipt shall set forth for what purpose said money is paid. There upon the said receipt shall be delivered to the recorder of said Village, who shall, upon the payment of twenty-five (25) cents therefor, properly list said dog by entry in a book kept by him for such purpose, the name of the owner and keeper of such dog. with a descrip tion and its registered number of said dog. And said recorder shall also at the same time issue and deliver to the owner or keeper of said dog a written license, which license shall expire on the first day of May of the year fol lowing the issuing thereof, and shall contain the name of the owner or keeper of said dog. a description of the dog and its registered number and shall be signed by said Village Re corder. Sec. 3. The owner or keeper of any dog licensed as hereinabove set forth shall cause said dog to wear a collar distinctly marked with the registered number of such dog. Sec. 4. No femals dog shall be per mitted to run at large within the limits of the Village, during the time they are in heat It is hereby made the duty of the Village Marshal of said Village to see that the provisions of this ordinance are in every respect en forced. And it shall be the further duty of said Village Marshal to kill all dogs which may be running at large within the limits of said Village con trary to the provisions of this ordi nance. Sec. 0. Any person shall be deemed to be the owner or keeper of a dog, within the perview of this ordinance who harbors said dog or permits the same to be about his premises. Sec. 6. Any person who shall violate any of the provisions of this ordinance shall, upon conviction thereof, be pun ished by a fine of not less than $5.00, nor more than $25.00, and the costs of the prosecution and in default of the payment thereof shall be committed to the County Jail of St. Louis County. Minnesota, until payment be made, not to exceed thirty days. Sec. 7. This ordinance shall take ef fect and be in force from and after its passage and publication. Trustees voting Aye—Everson. VILLAGE ORDINANCE NUMBER 14. An Ordinance to prevent the running at large of any horse, mule, cattle, swine, sheep, goat, or other beast, or any chicken, turkey goose or other poultry within the Pound limits of the Village of Buhl to provide a public Pound for the Village of Buhl, and prescribing the penalty for the violation of the terms of this said Ordinance. The Village Council of the Village of Buhli do ordain Sec. 1. No person shall suffer or per mit any horse, mule, cattle, swine, sheep, goat or other beast, or any chicken, turkey, goose or other poultry owned or controlled by him to be or run at large within the pound limits of the Village of Buhl. Sec. 2. The pound limits of the Vil lage of Buhl shall be the Platted Por tion of the Village of Buhl. Sec. 3. The public pound of the Vil lage of Buhl shall be located on Sharon Ore Co.'s land, west of Block 2. Sec. 4. The police officers of the Vil lage are hereby appointed pound- Sec. 5. It shall be the duty of the poundmasters to impound any animav found running at large, contrary to the provisions of this ordinance, in the. public pound. Sec. 6. The poundmasters shall pro vide subsistence for all animals im pounded. and the expense thereof shall be paid by the owner or person claim ing the same. Within twenty-four (24) hours after the animal is impounded, the poundmaster shall cause three notices containing a description of the impounded animal to be posted, as follows: One at the Village Post Of fice, one at the Village Recorder's Of fice. and one at the public pound in which the animal is impounded. Said notices shall further state a time not less than ten (10) days from the time of the posting of said notice, and a place when and where said animal, if not redeemed, as hereinafter provided, shall be sold at public auction to the highest bidder. Any animal impounded under the provisions of this ordinance may be redeemed at any time before sale, by paying to the poundmaster all ex penses of taking and keeping the same, and in the case of any horse, mule, cattle, swine, sheep, goat or other beast, a penalty of two (2) dollars for each animal, and in the case of any chicken, turkey, goose or other poultry, a penalty of twenty-five (25) cents for each fowl. Sec. 7. At the close of such sale the poundmaster shall give to such pur chaser a certificate containing a de scription of the animal, the amount of poundage for which said animal was sold, and the name of the person to whom sold. Sec. 8. The poundmaster shall render a monthly statement to the Village Council, under oath, of all fees charged and moneys from sales and penalties received by him. and after deducting his fees from expenses paid or incurred by him. shall Day the balance over to the Village Treasurer, and file said Treasurer's receipt with said statement. Sec. 9. It shall be unlawful within the limits of Buhl for any owner or per son having charge of any of the ani mals specified in Sec. 1 of this ordi nance, to allow the same to trespass upon or run over any lawn, garden, im proved lot or fenced private grounds. Sec. 10. It shall be unlawful for any person to break open or in any manner directly or indirectly assist in break ing open the public pound or to rescue therefrom any animal impounded therein or to hinder, delay or obstruct the poundmaster in securing in a public pound any animal liable to be im pounded therein. Sec. 11. Any- person violating any of the provisions of this ordinance shall be punished by a fine of not exceeding twenty (20) dollars or by imprisonment in the county jail of St. Louis County not exceeding twenty (20) days. To amend the ordinance entitled "An Ordinance fixing the rates to be paid for takipg water from the public hydrants, and prescribing: the penalty for taking water without first having paid therefor," passed Aug. 26th, 1902, and published Sept. 5th, 1902. The Village Council of the Village of Buhl to hereby ordain: Sec. 1. Before any person or persons shall in any manner, or for any pur pose other than for the extinguishment of a menacing fire or conflagration, take any water from any opening in the mains, or any supply or service pipe of the Village water "system, such person or persons shall first pay to the Department of Water and Light the amount or amounts hereinafter provided for rent for the use of said water, and at the times and in the manners hereinafter laid down and ex pressly described. Sec. 2. Water rates shall and are hereby declared to become due and payable in quarterly installments, in advance, on the first days of January April. July and October of each year, and must be paid- to the Department of Water and Light and said Depart ment shall, for such payments, give to the person or persons making the same a receipt, which shall recite the fol lowing statements, viz: The name of person or persons to whom such receipt is issued the period for which payment has been made, the same giving inclusive dates: the amount paid, and a complete and sufficient description of the building, part of building, place or prem ises wherein or whereon such water is to be used, together with a statement of the uses and purposes to which said building, part of build ing. place or premises is devoted. And in case water is to be used in watering stock (horses or cattle), or on the out side. or on premises not enclosed then receipt shall clearly state such facts. Sec. 3. The rates to be paid to said Department of Water and Light hv the users of water supplied by the Vi' lage. whether the same be taken from either public or private openings in the said water system of the Village, shall be as follows: For use in a private family". .$9.00 per yr For use in family where a stationary bath tub is in stalled 12.00 per vr For use in boarding house.. 18.00 per yr For use in hotels 24.00 per yr For use in saloons 18.00 per yr For use in public bath, for each tub.... .. 9.00 per yi For use in livery barn«r other than for watering stock 1S.00 per vr For use in watering horses or cattle, whether the same be in private or pub lic barns, per head 3.00 per yr For use in stores, shops or other places not herein lic barns, per head 9.00 per vi lli addition to the above rates for water, there shall be a fixed rate to users of water, where openings a--f specially or privately had 011 private premises, or in any building, part of building, or place, be the same of whatsoever name, nature or use. of $6.00 per year. And should any person or persons make application for. or be granted the privilege of using water from the Village supply, at any time other than at the beginning of the regular quarterly periods hereinabove noted, then such person or persons shall pay for the use of such water a pro rata proportion of the rates fixed hereinabove, and for said payment shall be granted a receipt in regular form for the portion of the quarterly period to expire on the first days of January, April, July and October, as hereinabove noted. And when a ser vice pipe shall be carried from any water main located on any street in the Village, it shall be done by and under the direction of the Water and Light Department, and the charge to any person requesting the said Depart ment of Water and Light to carry a service pipe, as noted, from the main in the street to the curb of the same, shall be $20.00. and shall be payable in advance, at the time the request for such connection is made. And if. at any time, any person or persons shall desire to take water supply from any main, a part of the system, and to carry it over to a street or alley where the water mains are not at the present time situated, and for the purpose of supplying their premises, the Depart ment of Water and Light shall grant such person permission so to do. and said permit shall contain a specific pro vision that the laying of said service pipe and the excavation of the trench therefor shall be done under the super vision and direction of the Department of Water and Light, and at the sole ex pense of the party making the re quest for such connection. Sec. 4. All payments for the use of water shall be made to the Department of Water and light, or to its authorized agent, and all quarterly rents for water are hereby declared due and payable in advance to the said Department, on the first day of said quarterly periods, as hereinabove described, and when any water rents thus due and payable shall remain due and unpaid on the 20th day of the first month of any quarterly periods as hereinbefore des cribed. the said Department of Water and Light shall proceed forthwith, and are hereby authorized and instructed to proceed forthwith to enforce the penalty for such non-payment of water rents as shall be hereinafter provided. Sec. 5. Possession of a proper re ceipt for water rents paid in the form as hereinabove described shall con stitute a license for the proper use of water, under the terms of said receipt, by the person or persons in whose name the same shall be issued an3 for the period therein named, as provided only. And it is hereby expressly pro vided that said receipt shall be ex hibited by the person or persons hold ing the same as often as request for its exhibition shall be made by any member of the Department of Water and Light, the Village Marshal, the Chief of Police, the Constable, or any other properly qualified official, and such exhibition of receipt only shall be held to constitute such license as shall entitle any person or persons to the right to use water from the Village supply. Sec. 6 Any person violating any of the provisions of this ordinance shall, upon conviction thereof, be punished by a fine of not less than Two ($2.00) Dollars or more than Ten ($10.00) Dol lars in addition to the costs of prosecu tion, and in default of the payment of such fine and costs, shall be committed to the Village Watch-house, or to the County Jail of St. Louis County, in the State of Minnesota, until such pay ment shall be made, not to exceed twenty (20) days. Sec. 7. Any ordinance or part of or dinance inconsistent with the provi sions of the foregoing Sections num bers 1 to 6 inclusive, are hereby re pealed. and are declared to be null and of no effect. Sec. 8. This ordinance shall take ef fect and be in force from and after its passage and publication. Trustees voting Aye—Everson. Erick son. Kasun, Carlson. Nichols. An ordinance for the conduct, man agement andi control of all the water and light plants of the village of Buhl, whether owned or to be ac quired for establishing a department of water and light, consisting of a board of water and light commis sioners. to have charge thereof. The Village Council of the Village of Buhl do ordain: Sec. 1. That there be established a Department of Water and Light, con sisting of a Board of Water and Light Commissioners of five members, the same to be comprised of members of the Village Council, and their term of office to be one year, except as herein otherwise provided. The President of the Village shall be President of thfc Board of Commissioners, and the Recorder of the Village shall be the Vice-President of said Board. Said Board shall elect annually some suit able person, not a member of the Board, as manager, who shall act as Secretary. A majority of the Board shall constitute a quorum for the pur pose of transacting business. The term of office of said Board shall be coincident with the term of office of the members of the Village Council, and shall expire on the second Tuesday in March, coincident with the expira tion of the term of office of the said Village Council: provided that the .first Board of Water and Light Commis sioners shall consist of the following named persons: E. N. Everson. J. Carlson, Joseph Kasun. Lewis Erick son. M. A. Nichols, and that said Board shall serve until the second Tuesday in March, and until their successors are elected and qualified. Sec. 2. The duty of said Board of •Water and Light Commissioners shall be to have general charge, conduct, management and control of all water and light plants owned or to be ac quired by the Village of Buhl. Sec. 3. Said Board of Water and Light Commissioners shall prosecute any and all actions in the name of the Village of Buhl, against any person or persons, for the use of water or elec tricity. or for any breach of any con tract, or for any injury or trespass or annoyance done, or caused or procured to be done to the sources of water sup ply. pipes, masonry, or any other aparatus belonging to or connected with any part of the said water or electric Tight plant, or for any improper use or waste of water or electricity. Sec. 4. The Treasurer of the Village is hereby declared to be ex-officio Treasurer of the Board, and the Recorder of the Village is hereby de clared' to be ex-officio comptroller of the Board. It is made the duty of the secretary, under the direction of the Board, to collect and receive and pay. upon the following day. into the Vil lage" Treasury. all moneys due and col lected. on account of the operation of the water and light plant, and to keep a set of Books, which shall contain a full and complete statement of the con dition and operation of the water and electric light plants: of air moneys re ceived and paid out by order of the Board, and of all debts due and owins the Board, for any cause whatever, together with an accurate account of all expenses of the Board, which Books shall always be open for in spection to any member of the Board. Sec. 5. The Board shall regulate the distribution and use of the water and electricity, and fix the price and rates therefor. Sec. 6. The Village shall pav. out of the water and light fund to the ac count of the Board, at the price and rates so fixed by the Board, for all water furnished and supplied the Vil lage for public fire hydrants, for the extinguishment of fires, for water used at public fountains or watering places, and all other water and light supplied to or used by the Village and the Board is hereby authorized and re quired to restrain and prevent any and all wastage of water or electricity, and to that end. may, when in its judg ment. necessary, turn off the water, or disconnect the electric wires, or take such actibn as, in its judgment, miy appear proper. Sec. 7. The Board shall have ful1 power and authority to require pay ment in advance for the use of water or electricity furnished by them, in or upon any building, place or premises, and in case prompt payment for the use shall not be made, they may shut off the water or electricity from such building, place or premises, and shall not be compelled to again supply such building, place or premises with water or electricity, until all arrears, with interest thereon, together with the costs and expenses of turning said water or electricity off and on shall be fully paid: provided that the owner of the building, place or premises shall not be held for bills contracted By ten ants covering a period of time longer than thirty days: and it is further pro vided that the supply of water or elec tricity may be withheld by- the said Board from any person or persons who are owiner the Village or the De partment of Water and Light for elec tricity furnished them, in their build ings, places or premises, or for the purchase of lamps, or for other elec trical supplies. Sec. 8. The Board shall have full power and authority to employ a man ager for both the electric light and water plants, and shall hereby be en abled to combine in the appointment of one man the office of Secretary of the Board and manager of both the Water and the Electric light plants, and to fix the salary of the said Secre tary and Manager, as well as the sal aries of any other employees which they may deem it necessary to employ, in connection with the management of the various plants of the Village, as in their judgment, they may deem it wise. Sec. 9. Any person who shall, with out authority from the Board, la-y any main or service pipe, or take any water therefrom, or open or use any service cock or fire hydrant, or enter or form any connection with, or turn water in to any tunnel excavated or used by the Board for the purpose of laying its pipe, or who, being authorized by said Board to take water from any main or service pipe into any specified build tag or upon any specified premises, or to be used for any specified pur pose, shall, without authority from said Board, use said water for any other than a specified purpose, or to take the same out of said building or prem ises. they will be deemed guilty of a misdemeanor, and shall be fined, upon conviction, not more than Ten ($10.00) Dollars, nor less than Two ($2.00) Dol lars. pr by imprisonment In the County Jail of St. Louis County. Minnesota, not to exceed twenty (20) days. Sec. 10. It is hereby declared an of fense punishable by a fine of not to exceed Fifty ($50.00) Dollars, or by im prisonment in the County Jail, or both, at the discretion of the Court, if the Board, or any member of the Board •knowingly omits the property of any person from change, at the regular rates therefor, for water or electric light, or to neglect or to refuse to col lect the same, or to discriminate in favor of or against any person in re gard thereto. Water rates shalll be collected at least quarterly, or four times each year, and rates for electric light shall be collected at least once each month. Sec. 11.
