tate condemned for a levee in the Sixth waid
of the city of St. Paul, under proceedings
had for the condemnation and taking of land
for a street or levee in the Sixth ward, from

Works July 18, 1899, and also under proceed
ings had for the condemnation and taking

This resolution is passed pursuant to
authority conferred by an act of the Legis
lating of the ttute of Minnesota entitled

Whereas. The Common Council of the
City of St. Paul, at a meeting held on the 7th
day of April, A. D. 1891, did adopt a resolu
tion appropriating and setting apart in the
City Treasury, out of the General Fund, the
Bum of 57,400 in said treasury, not otherwise
appropriated, and authorizing and empower
ing the City Treasurer to pay over the said
turn of 57,4U0 to the St. Paul Title Insurance
and Trust Company ; and
Whereas. The purpose for which said
mouev was so attempted to be appropriated
■was to reimburse the St. Paul Title Insurauce
and Trust Company for money paid into the
City Treasury on behalf of Rev. John Ireland
ana Thomas Cochran, for the purpose of and
in order that the piat of Elmer & Morrison. s
rearrangement of part of Macalester Park
might be recorded, in which said rearrange
ment certuin streets and alleys had been
vacated, and other streets and alleys dedi
cated to public use in lieu thereof, more than
equivalent iv value and area; and
Whereas. Said rcsolutton of April 7th,
1891, was defective in that it specified the
General Fund as the fund out of which the
Mime was to be paid, instead of the Local
Improvement Fund, out of which the same
Ehould be paid, said sum so paid into the
treasury having been originally placed to the
credit of the said Local Improvement Fund
Now, therefore, be it
Resolved. That an order be drawn upon
the City Treasury, after the claim has been
audited by the City Comptroller, in favor of
the St. Paul Title Insurance and Trust Com
pany, for the sum of seven thousand four
hundred (7,400) dollars, to be paid out of the
Local Improvement Fnnd lor the purpose of
reimbursing said company, according to the
provisions of the said resolution of April
vth, 1891, referred to above. Said resolution
of April 7th. 1891, is hereby repealed.
