Wilson and Anderson the Commis sioners to Take the Evidence. --Attorneys for Contestee Contend That Notice of Contest Was Not Filed Within the Legal Time. j The taking of evidence in the contested election cases in this coun. ty began Monday morning. Theevi dence is being taken in the contest of W. S. Clanton vs J.Sol Reid, and M. B. Williamson vs. E. M. Eanson, Messrs. Eanson and Reid being the sitting members of the General Assembly from Mecklenburg county. Messrs. John A. Anderson and J. II. "Wilson have been appointed com missioners to take the evidence. The attorneys for the contestee contended that notice of contest had not been given within the time re quired by law. The attorneys for the contestants filed their notice of contest, and the attorneys for the contestee tiled their objection. The grounds of objection were that the commissioners had no power or authority to take depositions in this contest to be heard before the general assembly, inasmuch a3 their appointment is irregular and that they have no power to take evi dence to be read before a court, and that notice was served on the wrong party. Messrs. W. R. Henry, George F. Bason and J. M. Moody are the at torneys for the contestants, and Messrs. C. H. Dula, J. D. McCall and J. W. Keeraus are attorneys for the conteatees. Clerk of the Court J. M. Morrow was the first witness introduced by the contestees; he was sworn in, but before the examination began an ad journment of an hour was taken. . . TREE FELL ON HIM. Young Son of Mr. A. E. flcLelland Badly Hurt. VV hile cutting down a large tree Tuesday Earl McLelland, son of Mr. A E. McLelland, of Crab Or chard township, was caught beneath the falling tree and badly crushed, Ihe negro who was with him man aged to raise the log, but the boy was unable to crawl out. He lay under the log until the negro went to a saw mill some distance away and secured help. Passed Away at 9:30 O'clock This florning. Mr Edward Cobb died at 9:30 o'clock Wednesday at his residence on Poplar street lie had been suf fering with consumption quite a long while, and returned only a few weeks ago from Baltimore, where he had been under treatment. Mr. Cobb has been a resident of Charlotte a number of years and a large circle of warm friends mourn his death. He was thirtv-five years old and leaves a wife and one child. He married Miss Haley. He was a hrother of Mr. Walter Cobb, Register of Deeds of Mecklenburg county. - - aj BANK STOCKHOLDERS MEET. The Old Officers Re-elected at the Meetings This florning. The stockholders of the various banks of Charlotte held their annu al meetings Tuesday morniDg. At the Commercial National the old officers were re-elected, and no change is made in the staff of the clerks except that Mr. Arch. Graham succeeds Mr. L. 1J. Jackson, who will remove to Richmond to live. The meeting of the stockholders of the First National Bank was held that morning and all the old officers of the bank re-elected. "Moody of Haywood" Here. Mr. J. M. Moody,of Waynesville,the well-known Republican politician, is here to act as counsel for Messrs. Clanton and Williamson in their contest. He has just returned from Raleigh, and says everything is going Pritchard'8 way. Mr. Moody has been prominent in the Republican circles for years and was one of the leaders of that party in the last Legislature. It is re ported that lie is slated for a good position under the incoming admin istration. A Letter from Bryan. Mr. R. D. Whitley, of Bristow, has received a letter from Mr. Wil liam J. Bryan, in which the noted Nebraskan says: "I beg to thank you for the kind expressions of good will and for the interest which prompted your com munication. The consciousness of duty done must sustain us until we see the triumph of our cause. I have no doubt of ultimate victory." Death of Mr. Edgar Sharrar. Mr. Edgar Sharrar, son of Mr. and Mrs. D. E. Sharrar, died Friday night at his home in Seversville, of pneumonia, aged about twenty years. At the time of his death he was employed by the Southern Newspa per Union. Previous to that he was printer at the Racket Store. Court Meets Next Monday. Mecklenburg superior coart meets next Monday, Judge Norwood pre siding. Cierk Osborne is busy making up the calendar. The order of cases will probably be ar ranged by a meeting of the bar to morrow. Dr. J. P. Strong is confined to hia room by an attack of the grip. Goodman who keeps a gun and locksmith shop at 25 North College street, ia in serious trouble. He was tried before Mayor Wedding ton Saturday morning for keeping a tence, receiving and concealing stolen goods. lor sometime the Southern rail way people have been missing what they know as "brasses." These were stolen from the railroad yards. The pclice havi been working on the case, and last night Cbief Orr traced two sacks full of the plunder to Goodman's store. Before the brasses were delivered to Goodman. Chief Oir took them out and took note of the numbers on them. When Chief Orr went to the shop and began to search the building Goodman said if the Chief stated he had any brasses about the building he "told a dog gone mistake." A section was found sawed out of the floor, and under this the brasses were discovered. He told the mayor this morning he had the brasses "honestly hid" under his floor. Ihe mayor fined him $50 for keeping a junk shop without license, and bound him over to court in bond of $250, on the charge of con cealing stolen goods. Goodman said he bought the brasses from a negro whose name he did not know. Later the police found he had snipped two boxes of brasses to Richmond via the Seaboard Air Line. The boxes were stopped at the depot and are in the posses sion of the police. Six hundred pounds of brass were lounu in the shop, which amount will "bring in the market $G6. DEATH OF MRS.W.R. JONES. She Passed Away at 9:45 Last Night. O'clock Mrs. Maggie B. Jones, wife of Mr. W. R. JoneF, died Tuesday at her residence on College street. She had been sick with pneumonia ten days, but not until Tuesdav morn ing did a dangerous condition &e- velop. She passed away at 9:45 o'clock. She was the daughter of the late Mr. and Mrs. McGilvary, of this city and was highly esteemed for her traits of christian character. She was an active and useful member of Tryon Street Methodist chureh,.and will be greatly missed by her large circle of friends. She leaves a hus band, two sons, Messrs. Frank and Will Jones, and two sisters, Mrs. Frank Houston and Mrs. William Collier. The funeral was held from the Tryon Street Methodist church at four o'clock Wednesday afternoon. The Contact Casei. The commissioners are making slow progress in the examination of witnesses in the contest cases. Only two have been examined up to the time of going to press. Maggie Alexander, the wife of John H. Alexander, the colored reg istrar of Pineville township, precinct 2, was the first witness called Wed nesday, and at this hour Arthur Alexander, their son, is on the stand. They both testify that a masked crowd of men broke into the house looking for John Alexander, and they recognized the following: Boyce Bell, Dr. Moore, Sam Cunningham and Jim Barnett. Death of Mrs. Nancy Watts. For the Times. Mrs. Nancy A. Watts, wife of J. D. Watts, depaited this life Decem ber 30th, aged 61 years. She leaves three sons, a husband and two daughters to mourn her loss. She had been a member of the M. E. church about twenty-five years. The funeral was conducted by Rev. W. D. Foyleman at the family residence, after which her re mains were laid to rest in the ceme tery at Prosperity. TheTedder-Harill Wedding. Wednesday at 7:30 o'clock in the Tryon Street Baptist church, Miss Marion Tedder and Mr. J oseph II. Harrill were united in marriage, in the presence of a large company of relatives and friends. The bride preceeded by the ushers, entered the church with her maid of honor, Miss Annie Misenheimer, and was met at the altar by the groom and his best man, Mr. I. W. Jamison. Dr. Barron, the pastor, the officiat ing minister, in a simple but beauti ful ceremony pronounced them man and wife. Witness-) WautThalr Monay. The negro witnesses in the con tested cases have bten bothering Lawyer Henry today for their pay, and threatening to go home if thy are not paid for their time. They say they have been here day after day and are getting tired of it. John Withers, Milton Grier, and Walter Cherry were the only witnese es examined this morning, but no especially testimony was brought out. Mr. S. H. Youngblood of Hun tersville, has moved to the city, and ia living at 400 North Pine street. He is the senior member of the firm S. H. After a full and free dlh nation cf the affairs of the bank, and-its fu ture,, owing to the fact that the Cra ig family, who owned a controlling interest in the bank, desired their money to invest in other business, the following resolution was unani mously adopted: "Resolved, that it is expedient to cease operations 01 the .Loan and Savings Bank and to settle up the affairs of the institution as speedily as may be consistent with prudence and the best interests of the stock holders, "Resolved, 2, that the board of directors be and are hereby instruct ed to adopt suitable means to wind up the affairs 01 the bank by ap pointing the necessary agents or of Mcers to accomplish such purpose. and to take such bonds or security from such agents as shall protect the interests of both the depositors and stockholders." The board of directors elected for this purpose are J. H. Craig, P. Schiff, D. O'Donoghue.J. J. Sims, L L. Jenkins, E. M. Mellon and J. R Craig. The directors, after the meeting of stockholders, held a meeting at which they elected Mr. J. A. Craig president, Mr. John E. Oates de clinirig re election on account 0 other business engagoments. Mr Lee H. Battle was re-elected cashier, From interviews with stockhold era of the bank, it is learned that the bank has ample funds at its comanand to pay all depositors in full, and that the stockholders wil realize more than par for their stock. The votes on all matters pertain ing to the bank were unanimous in both meetings, and the utmost har mony prevails. MAY TAKE SIX MONTHS. To Wind Up the Affairs of the Savings Bank Business to be Transacted as Usual for the Present. Cashier Lee H. Battle, of the Loan and Savings Bank, said this morn- ine: "It mav take as long aa eix months to wind up the affairs of the bank. For the present the bank will be open as usual, deposits will be received and checks paid, and the business will be transacted just as it has been heretofore, "When we intend to close the doors of the bank notice will be given in the newspapers, and all de positors will be requested to call and withdraw I heir deposits. Until that time the business of the bank will be transacted as usual." Marriage of Mr. Beard and Miss Hood. For the Times. Htjntersville, N. C, Jan. 13. Mr. Joe Beard of Huntersville and Miss Ella Hood, daughter of Mr. J. Watt Hood, were married at the home of the bride Jan. 6th, 1897 at half past six o'clock p. m. The ceremony being performed by Rev. R. G. Miller of Sardis. The attendants were: -Misses Mary Beard, Carrie hood and Delia Irwin and Messrs. Baxter Hood, Hunter McCall and George Steel. After the congratulations were re ceived they were called to supper where the table was spread with an abundance of good things. Music was furnished by the Thyatira string band. A. the board of directors met Monday even ingin the parlors of the Association building to discuss the plans the ladies have under advise ment relative to the inauguration of the Exposition which they have ful ly decided to open at some time not vet designated, but in :fthe early months of the coming spring. Mr. J. A. Durham wad called to the chair, explaining fully his con ception of the office pf the board of directors as designated .by the La dies' Auxiliary as co-operated with them in the capacity of an advisory body to the Exposition;enterprige. It being the general, wish of all present to learn further particulars, Mrs Minnie Hebb Kellogg, of Bat tle Creek, Mich., whose .services as business manager hve been engaged by the ladies, proceeded to carefully outline details and plans of Exposi tion work, as conducted by her heretofore in various parts of the country, subject of course to changes that may seem advisable, with de sirable additional features, suggest d by local color or existing circum stances. Interest in the nffuir was manifested by the entire board, and when the possibility of the enter prise became apparent they were unanimous in their decision that the Ladies Auxiliary had adopted a unique and novel foim of entertain menr, from which the entire com munity and. surrounding country will derive great advantage by means of the various educational and scien tific features connected with the work, while it is hoped that no less advantageous and remunerative will be the final outcome to the Y. M. C. A. of not only Charlotte alone but that it will serve to awaken new thought and interest in Association work in neighboring cities.
