Sec. 1. (Milk and food division established.)
There ia hereby established a division of the
department of health of the city of Hock
Island to be known and designated as the
milk and food division, which shall em
embrace the commissioner of health, ai:d
such other inspectors and employes as the
council may, by ordinance, prescribe and es
Sec. 2. (Officer' defaults). Any officer or em
ploye of the Health Department, who will
fully connives at or assists In the violation
of any of the provisions of this article shall
on conviction thereof, be fined not less than
one hundred dollars nor more than two hun
dred dollars and at oiico forfeit his office.
fcectlon 3 (Insignia of office-powers.) The
Health Commissioner and the luspectors
shall each, when on duty, wear a metallic
star, inscribed with suitable words, which
shall be supplied by and be the property of
the city. They shall each have the power,
on demand made therefor, to require ths
aid. assistance or presence of any police of
ficer. In the performance of any duty en
joined by the provisions of this article, to
arrest all persons found violating any of the
terms or provisions of this article, and shall
have full powers, as are now provided by the
laws and ordinances of the city.
Section- 4. (Milk Vendor's License License
Fees.) No person or per80ns firm or corpor
ation, or driver of any milk wagon thereof,
shall srll or offer for sale, expose for sale.

intent so to do as aforesaid, have in his or
their possession, care, custody or control
milk or cream for human food, without hav
ing been first licensed so to do. Every per
son or persons. Arm or corporation selling
or disposing of milk or cream at retail shall

vendor selling, offering for sale, exposing for
lc, exchange or delivery, or disposing of
the same in or from any store, stand, booth
market place, milk depot, warehouse, dairy.

Section 8. (Inspection Resisting.) It shall
be the duty of the said Health Commissioner
(either In person or by one or more of the
said inspectors) to visit, view and inspect

cream may be sold, offered for sale, exposed
for sale, stored, kept, exchanged, delivered
or disposed of. as wen as 10 inspect, view
and examine all vessels, cans, receptacle?.

purpose ot inspecting, testing or analyzing
the same. Any person, firm or corporation
falling, neglecting, delaying or refusing to
cbey or conform to any reasonable order or
direction under this section, made by the
nroner officer, shall be deemed guilty of a
misdemeanor, and lined not less than ten
nor more than one hundred dollars, and
whenever a sample or samples so found and
taken as aforesaid shall not correspond with
or shall be In violation of, the requirements of
thU ordinance, the person or persons, firm
or corporation In whose possession, care,
custody or control such milk or cream may
be found, shall be deemed guilty of a mlsd

nor more than one hundred dollars for each
and every offense.
Section 10. (Simples Test.) All samples
of milk and cream taken or brought to the
effieo of the department of health by the
officers thereof, or by any other person
shall be analyzed or otherwise satisfactorily
tested, and wherever or whenever said milk
or cream or other foods, so tested or analyz
ed shall be found violative of the provisions

taken for a prosecution for a violation there
of. The analysis or test herein required may
be made with such Instruments, apparatus.
chemicals or other articles, and to such ex
tent as may. by the commissioner of health

Section 11. (Milk Test.) No milk shall be

Section 13. (Skimmed Milk Penalty.) Any
vendor of milk or cream, or any driver, ser
vant or agent of such vendor, who shall, tn

any milk from which the cream or any part
thereof shall have been taken, nhall ofte
for sale and sell the same as skimmed mi
and not otherwise, and no vendor of nil lk

dor shall offer for sale, or sell, or have I

Any person, firm or eorporation, who si
sell, offer for sale, expose for sale exchang
deliver, dispose of cr transport, convey or

dy or control, any milk or cream having
therein or containing any foreign or other
substance of any kind whatever, or coloring
matter, or any adulteration or preservative,
whether for the purpose of artificially in
creasing the quantity of milk or cream or
for preserving the condition of sweetness
thereof, or for any purpose whatever, shall
be deemed guilty of a misdemeanor and. or.
conviction thereof, shall be fined not less
than ten dollars nor more than one hundrcl
dollars for each and every offense.
Section 17. Condensed or Evaporated Milkt
No person shall manufacture, sell or offer
for sale, any condensed or evaporated milk
for domestic use. unless the same shall he
put up In packages or cans upon which shall
be distinctly labeled or stamped the name
or brand by whom, or under woicn, tne same
U made. No condensed or evaporated milk
shall be mncie. sold, or offered for sale, ex
changed or delivered for domestic use, unless
the same is manufactured from pure, clean,
lipulthi. fresh. unadulterated wholesom
milk, from which the cream has not bee rc
moed. or unless the proportion of milk so!,
ids and butler fat contained in the coudensed
or vaporatcd milk shall In amount oe tne
equivalent of milk -solids k& butter fat as
proxided by this article. For any violation
of this section the offender shall be deemed
guilty of a misdemeanor and fined not les

dred dollars for each and every offense.

the addition of cane sugar In the manufact
ure of condensed or evaporated milk.

or keep a dairy In the city of Rock Island
shall maintain the premises thereof free
from any accumulation of refuse matter or
offal, which 'shall be removed frequently, so
as not to endanger the nubile health.
