So severe was the cold that lubricating oil on some of the racing machines froze and forced the contest ants to quit the races. Aitken's sensational dash was in the 20-mile event to set records for dis tances of from one to 20 miles. Ait ken covered the distance in 16:18:41. Aitken's time for five miles was 4:00:56. He went ten miles in 8:12:10 and 15 mile3 in 12:17:01. Walter Christie with his "freak" rac er and Ijouis Strang with a 200 horse power Fiat were unable to fulfill their expectations of lowering the records because of the low temperature. After 10 rounds of furious fighting Cyclona Johnny Thompson of Sycamore, 111., was awarded the decision over Fight ing Dick Hyland of San FTancisco be fore the Empire Athletic club here last night. Thompson easily deserved the ver dict. He rushed the battle from the start and forced Hyland into clinches time after time in order to save him self. Using his vicious right to the jaw to good effect, the Sycamore far mer tottered the Pacific coast boy re peatedly. The battle was fast from start to fin ish, with a large amount of infighting. By previous agreement, the men were permitted to fight in the clinches as long as either could swing, and this kept them close to each other the great er part of the contest. Hyland landed many blows during the infighting, but they were not as powerful as those Thompson delivered in the break aways. Kid Brown of Chicago knocked out Roxie Kenall of Buffalo in the fifth round of a preliminary contest. Corbet t to Help Jeff. New York. Dec. 18. James J. St. Louis. Mo.. Dec. IS. The appeal of the Standard Oil company of New Jersey, its subsidiaries, and the seven individuals against whom the govern ment recently won its dissolution suit ited States circuit court was esterday afternoon. Sixty-five instances in which the cir cuit court is alleged to have erred are cited as reasons for taking the case to the supreme court, of the I'nited States. The appeal was accompanied by a bond of $50,000. Collectively the assignments of er ror are that the evidence did not show a violation of the Sherman-act, under which the suit was brought. t Subject to Order. The decree is attacked as against almost all the defendants, different reasons being assigned as to why they were not subject to the order of the j court. j Specific objection also is made as to the overruling of theVilea against the jurisdiction of the court. The findings in respect to coinpeti- ! tion as between corporations occupy i ing contiguous territory also are de j clared to have been in error as well as the court's conclusions regarding the part which John D. Rockefeller, Henry i II. Rogers, John D. Archbold, and the j other individual defendants took in the ! formation and conduct of the various companies. Enjoined From Operating;. The circuit court enjoined the New Jersey company from voting the stock of subsidiary concerns, the smaller companies from paying dividends to the larger, and the Individual defend ants from continuing the combination which it found to exist or the formation by them of any similar arrangement looking to the control of the price or transportation of petroleum. All these orders are declared to be in error. The findings regarding monopoly of a part of commerce are assailed, and it is contended that no decree should have been entered against certain of the defendants which operated in only one state, or the stock of which was purchased for cash by the Standard of New Jersey, or which were organized at the instance of the trustees of the trust of 1SS2 prior to 1890. The order granting the appeal was signed by Judges William C. Hook and Elmer B. Adams.
