The case of the S ate of Iowa va Joseph
F. Atwill, on the charge of embezzle"
ment, brought by Charles Ilanaon, of
Rock Island, was called for trial at Jus
tice Eagal's court at 9 o'clock yesterday,
but, aa before. II a ison, the prosecuting
witness, waa not on band, and an officer
who waa sent over to k quest him to ap
pear, returned to report that the man re
fused to come. A change of renue was
taken to the court of Justice Kaufraann
by the defense, anr, upon receipt ot the
intelligence that Hanson would not at
tend, the justice diimisaed the case upon
instruction of Jurif e Stewart
The other case. n a similar charge
brought upon information of Maggie P.
Glass, will be settled. The watch en
trusted to Atwell ptated out of his pos
session, it is said by being pawned, and
Anally, after a circuitous journey and a
variety of possession, it landed in the safe
of County Attorney Stewart. Judge
Stewart baa it now in bis poataasion. and
will retain it until tlie woman to whom it
belongs baa earned 1U, with which to
redeem it from the claim of the man
who held it last and who advanced that
amount of money i pou it. Davenport
Kock Island, A ug. 16. There has
been ao much aaid about the litigation in
which I am involved that I would like to
say a word. Ia It -SI Appelquist and I
let our plow out to .be Globe Plow com
pany of Davenport. In the fall of that
year when the shop broke up, Appelquist
collected for 350 plows at fifty cents
apiece, amounting t $150.50. When I
found this out I ei gaged Atwill to sue
the company. I lost that -case, and then
sued the assignee of the concern, Christ
Lamp, for $55 and won it in the Febru
ary term of court. On March 6th the as
signee paid the arrount and costs into
court. In June I learned Atwill had
drawn the money $57.25 and I sued
him for it before Justice Kauffman and
cot a judgment for f46. This money he
turned over to Appelquist and be did not
give ine my halt. I waa sick yesterday
and rould not go over to attend the
suit. Oliver Olson and Appelquist aaved
Atwill from going tc jnil .
