The New Leeal Kate.
The law passed by the late legislature
to regulate the rate of interest in this
state ie now in effect and now the highest
legal rate is seven per cent, while the rale
when no agreement is made is but five
per cent. The sections of the law that
define the rate are given below in full:
Section 1- The rate of interest uprn
the loan or forbearance of any money,
goods or things in action, shall be five
dollars (85) upon one hundred dollars
(100) for one year, ard after that rate
for a greater or less sum, or for a longer
or shorter time, except as herein pro
vided. Sec. 8. Judgments recovered before
any court or magistrate shall draw inter
est at the rate of five (5) per centum per
annum from the date of the same until
satisfied. When iudgment is entered
upon any award, report or verdict, inter
est shall be computed at the rate afore
said, from the time when made or ren
dered to the time of rendering judgment
upon the same, and made a part of the

shall be lawful for the parlies to stipu
late or agree that seven (7) per cent per
annum, or any less sum of interest, shall
be taken and paid upon every one hun
dred dollars ($100) of money loaned or
in any manner due and owing from any
person or corporation to any other per
son or corporation in this'state, and after
that rate for a greater or less sum. or for
a longer or shorter time, except as here
Sec. 6. If any person or corporation
in this state shall contract to receive a
greater rate of interest or discount than
seven (T) percent, upon any contract,
verbal or written, such person or corpor
ation shall forfeit the whole of said in
erest so contracted to be received, and
shull be entitled only to recover the prin
cipal sura due to such person ornjorpora
ti"n. And all contracts executed after
bis act shull take effect, which shall pro
vide for interest or compensation at
greater rate than herein specified, on ac
count ot non-payment at maturity, shall
be deemed usurious, and only the princi
pal sum due thereon shall be recoverable.
