The New Mexican of late has re
ceived inquiries as to the law en
acted by the 37th Legislative As
sembly providing that certain coun
ty official should have their offices
and headquarters at the county
seats of their respective counties
and maintain them there during
their terms of office. In several of
the counties it was thought that
all county officials are included in
the provisions of the new statue.
This is not the case and in order
that the correct understanding may
be obtained, the law in question is
herewith published in full. It reads:
An act to amend chapter 38 of
the acts of the 35th Legislative
Assembly of New Mexico, House
Substitute for House Bill No. 29,
Approved March 21, 1907.
Be it enacted by the Legislative
Assembly of New Mexico :
Section 1. That Chapter 38 of
the acts of the 35th Legislative As
sembly be, and the same is hereby
amended so as to read as follows :
"Section 1. That all sheriffs,
treasurers and probate clerks of the
various counties of New Mexico
shall establish and maintain their
offices and headquarters for the
transaction of the business of their
respective offices at the county seats
of their respective counties, and
shall their keep all the books, pa
pers and official records pertaining
to their respective offices; Provided,
That such offices shall be provided
for such officers at the expense of
the respective counties.
"Section 2. Any county officer
who shall fail to comply with the
provisions of this act, shall upon
verified complaint by any tax payer
r2sidingin the counU in which such
delinquent officer is serving, filed
in the district court having juris
diction over such county, setting
forth the facts as to such violation
of this act, and after hearing upon
such notice as the court shall pre
scribe, and proof of such facts to
the satisfaction of the presiding
jude of such court, be summarily
removed from his said office, and
such office declared vacant bv
judgment and decree of such court,
and thereupon any vacancy so ere
ated shall forthwith be filled in the
manner prescribed by law."
Section 2. All laws and parts
of law in conflict herewith are
hereby repealed, and this act shall
take effect and be in force from and
after the date of its passage.
