Ta Whom It May Concrrh:
I am informed that certain persons in Beaver Couaty are etelmlng that Oliver F. PraeH, the present
Clark ef the District Court, should not be re-elected t that oik becaaaa be haa net paid to the County
the feea received by him fer aervlcea rendered with reference to Filing and Final Preets by homeMtad
I wiah to say that this question waa called to my attention f rat when Mr. W. T. Qalnn's term of of.
gee aspired, and I then held that since he waa not compelled to take FUlaga or hear Final Proofs and that
tka laws o the State did set require him te perform that daty, that he waa not required to pay the fees
received fer Filings and Final Proofs to the County. No appeal was tokfn from that decision. X agwin
bad the question before me In Texas County and Cimarron County and in each of the oases aa appeal was '
BaftlnaBMBB frifllH anaUt alAataalaal
fHaee that time the 8apreme Court of the State of Oklahoma, at lta July 1010 term, la the case of
State vs. Gardner, 370kla., page 1, etates the law to be the same aa 1 had held in these cases.
The County Fee aad Salary law, passed by the Legislature la 1910, Chapter 69, has been in force
aver since Mr. Praett became the Clerk and that law does not require the Clerk to take aUlngs on gerem
meat lead, nor to hear Final Proofs thereon, and where a Clerk deea aa, ia accordance with the decll.m
above cited, ha la not required to pay the fees therefor to the County. In ether wards, tlie Ckrk, it tie
desires, could refuse to take a FUina: or a Final Proof, and ia that event people would have to go to some
ether ettcer fer that aervlce, and in no eveat would the feea for auch servtoo ga to the County.
It is therefore unfair aad unjust to Mr. Praett for persons to circulate auch reports and for the in
fermatlea of the voter and in the latereat of Justice and right I feel it my duty to make the above state.
meat. Very respectfully,
R. H. Loofboukrow, District Judge.
