Jefferson county today Judge Meyer
refused the petition to the stale of
Kn ageintt in A. T. k. 8. T. Rail
road company to forfeit end tell the
property of the railroad. The prev-
oat orders appointing a. receiver and
granting injunctions in mid thereof the
judge announced would be let aside.
The opinione hold that the law under
which the action waa brought it not
applicable to railroads. It declare!
that the land law nnder which he ap
pointed a receiver for the property
doei not apply to the reilroadt. The
detition ii a complete victory for the
Santa Fe company. Attorneys for the
plaintiff will take etepe at once to
carry the case to the supreme court of
Kansas oa appeal.
