defendant and several witnesses were
introduced testifying to having hoard a
pistol shot. The defense sought to offset
this witn proof that tho naturo of tbe
wound was auch that it could not have
been dono by a pistol. Tbe instructions
were presented to the judge in the even?
ing, after which court adjourned till 10
o'clock this morning, when tho argument
