A Franchise for a Railway In the City of Yale, County of St. Clair and State of Michigan. A Public Utility Franchise granting the Meade Construction Company, a conoration, existing under the laws of the State of Michigan, its successors and assigns, hereinafter called the grantee, the right to con struct, maintain, use and operate a railway in and across the road 3 and highways in the City of Yale. The City of Yale Ordains: Section 1. The consent, permission and authority is hereby given, grant ed and duly vested in said grantee, to construct, maintain, use and op erate a single cr double track railway with the necessary and convenient tracks and turnouts, side tracks, switches and connections in and on all the course of streets, ways and bridges of and in the City of Yale, hereinafter mentioned, and the same to keep, maintain use and to operate thereon, railway cars and carriages by electricity or by any other mod ern rapid motive power, or any com bination thereof, except steam nnd horse-power, during all the term r.nd upon the conditions hereinafter sei forth. The tracks of said railway shall be four feet, eight and one-halt nches (4' 8 " gauge. Section 2. The said grantee is by this ordinance, authorized to con truct. own and operate a street rail way as herein provided, upon the fol lowing route or such part or parts thereof, as it may elect, to-wit: com mencing at the intersection of the south boundary line of the corporate limits of the City of Yale and the Urockway road; thence northwester ly on said Ilroaflway road to Main street; thence north on Main street to the intersection of Main street and the north boundary lino of the cor porate limits of the City of Yale. Section 3. Proper and suitable crossings shall bo constructed and maintained at all of the roads. Section 4. Power and authority are hereby given, granted and vested n said grantee, to erect poles, string wires along the line of said railway, and do all necessary acts for the purpose of operating said railway, but said poles and wires shall be so erected and strung as not to materi ally interfere with the ordinary and proper use of said streets, ways and bridges by teams, vehicles and pedestrians. Section .1. The cars which shall be used on such railway Rhall be propell ed at a rate of speed not exceeding eight miles per hour on said .route, except as otherwise permitted by the Common Council of the City of Yale, hereafter. Section 0. In constructing said railway, the grades established by the Common Council of the City of Yale, for the streets traversed by said railwaj', shall be conformed to; the consent of said Common Council shall be obtained before any change shall be made In said grades on ac count of said railway. Section 7. The upper surface ot the rails forming the track of (lie said railway shall be laid Hush with the surface of the street and shall be so laid as to leot obstruct the free passage of vehicles or carriages over the same. Section 8. That portion of the street between the rails of the track of said railway and for one foot ort side thereof, shall be graded and paved on streets hereafter paved, and graded on all other streets, at the ox pense and cost of said grantee, upon such grade as the Common Council shall fix, nnd all satisfactory to the Common Council of paid city, Vt said grade shall not, after being once fixed as aforesaid, be changed In any way at the cost of or to the damage of said grantee, but it shall be the duty of said grantee to keep the space between the rails of track nnd one foot immediately outside of each rail of said track in good repair, ex crpt that In the case the city paves Main street, the said grantee shall pavo the space between their rails and tracks and for one foot outside thereof, on said street, with the same material, at Its own expense. Section 9. Whenever In the con structlng or repairing of said rail railway, said grantee shall disturb the surface of the street beyond the space between said tracks and one foot on each side thereof as afore said, said granteo shall put said street surface in good condition with out needless or unreasonable delay, and shall put said street surface in as good condition as before the same was disturbed. The said railway tracks shall be located in the center of said several streets, except where otherwise" permitted hereafter by the Common Council of the Citv of Yale. Section Id. Said grantee shall at all times, lay Its rails nnd tracks and maintain the same, subject to the rights of the city or any gas. water, electric light or power, or telephone company or conduit companies which are now granted, or which may be granted hereafter, by the city to such company, to lay down, take up. change or remove any works of any kind on or beneath the surface of the streets, but in such a manner ns not unnecessarily to damage or injure said tracks or their use, without any claim for damages on the part of saiu grantee, but all such companies or private individuals shall iirst obtain a permit of the city's proper author ities, before they shall dig or take up the pavement or the street, for the purposes aforesaid, and the city ex pre.-sly reserves the right to issue said permits for itself and to com panics and individuals, an aforesaid. nnd for purposes named there'n, whenever in their Judgment, the pub lie and private convenience and wel fare shall require if; but all com panics or private individuals who shall dig up the street or take up rre pavements under such permits afore said, being always required as by the city ordinance to restore the surface and pavement of the street to its for mer conditions. Section 11. Cars for the transpor tation of passengers shall be operated at least one car each way every ;our hours, through the City of Yale, be ginning not later than six o'clock a. m. and operated continously until six o'clock p. m.. but said grantee shall have the privilege of running cars more frequently and during a greater number of hours. The cars shall be modern and made comfort able for the accommodation of nas- sengers and said cars shall be at all times entitled to the track. The stopping place for local passenger cars shall be each road crossing or such other places as may be desig nated by said grantee. Freight trams are to be operated in such manner and at such times as will not inter fere with passenger tratlic, Section 12. The said grantee shall regulate the time and manner in which passengers are to be trans ported and the compensation to be paid therefore, which shall not ex ceed live cents (5c) through the city. Children under twelve (12) years cf ago to be carried for one-half fare Said grantee shall have sufheient ears and motive power to meet all re quirements which may reasonably be anticipated and shall furnish suitable cars to any and all persons who may apply therefore, for the transportn tion of any and all kinds of freight in carload lots. Provided, Preference may be given to shipments of live stock and per ishable property. Section 13. This franchise shall be accepted in writing by the duly au thorized otlicers of the grantee with in ten (10 doys from its date aud shall be filed with the City Clerk of said City of Yale, and shall take ef fect from the date of receiving the affirmative vote ot three-fifths major ity of the electors of said city voting thereon. Section 14. Said grantee shall in- lemnify and save harmless said City of Yale against any and all damages which may be suffered by third per sons arising out of the construction or operation of said railway by gran tee under this franchise. Section 15. It Is hereby expressly reserved to the Common Council of the City of Yale to make amendments to this grant and ordinance making such other and further rules, orders and regulations as may from time to time be deemed by the Common Coun cil, necessary to protect the interests, safety, welfare, or accommodation of the City nnd public in relation to said railway. Section 16. Said railway shall be completed and In operation 6n or be fore the 1st day of October, A. D. 1918, or in default thereof all the grants and rights herein conferred upon said gran tee shall be then forfeited and imme diately cease and terminate and shall revert to the said City of Yale. Provided, however, that this fran chise may be extended by the Com mon Council of the City of Yale be yond the period above limited. In casa they deem such extension equitable and expedient under the' existing circumstances. Section 17. In case the Common Council of the City of Yale should deem it expedient to alter or extend the franchise as regards streets in said City to be traversed by the rail way of grantee, such alteration or ex tension may be permitted by said Com mon Council, without resubmission of the same to the electorate oT said city. Section IS. The powers nnd privi leges conferred by the provisions of this ordinance shall be limited to thirty (20) years from nnd after the date of its adoption. Section 19. All ordinances or part3 of ordinances heretofore made, or dained nnd passed, inconsistent with th provisions of this ordinance, arc hereby repealed.
