One day after the demit of her Infant
daughter, Mrs. August IIoos died yes
terday morning at her home. Thirtieth
and S streets. She was 88 years of ago.
She Is survived by her husband, August
Hoos.
The funeral will take place Tuesday
morning from the late residence of tha
deceased to Bailey's cemetery In Omaha,
Refuses to Conform to Law.
If ths people elect Jim Callaoan to tha
police Judgeship tomorrow they will elect
a man who absolutely refuses to conform
to the laws that require him to make aa
itemized accounting for all moneys cola
lected and uncollected In the administra
tion of Justice in the police court-
Said the Judge In discussing- the msttea
a day or two back:
"I will not give them or anyone an
itemized account of the cases tried before
me. Mo other Judge hag done It and I
win not. I have not done so before this
and I will not now."
The law as laid down In the statutes of
the state specifies that the police Judge
shall make a monthly accounting; with
the city treasurer of all fines collected
and uncollected. The law reads, "a full
and accurate account," which by law
yers Is taken to mean an itemised account
or each case.
When the Judge claimed that his prede
cessors did not keep such an account he
erred, as the city clerk's office will show.
The purpose of tha law as laid down
in the statutes of Nebraska Is to make
sure that the city rets every cent
money that is paid Into the hands of the
police judge. In Omaha the police Judge
has a clerk, who receives and handlea
the money and gives a receipt to every
man who pays a fine. The receipt shows
what the prisoner has paid to the city.
in the police court as now conducted in
South Omaha there is no such safeguard.
A police blotter is all that is maintained.
The prisoner pays his money and receives
no other acknowledgment of the same
than hlg freedom. . 1
