R. & N. system, tho railroad company to day filed its formal protest against such action on the part of the com mission and sets forth tho conten tlon, in defense of the rates in forco at the presont time, that such rates to and from Baker City on the main lino of the O. R. & N. are prescribed and published under' the westoru classification of rates and are legal, fair and not excessive or discrim inatory in comparison with tho rates In effect to and from other points along Its lino of railroad. The Baker City Commercial club recites, as a cause of action against the rates in quostlon, that Baker City is tho distributing point for a large territory of Eastern Oregon for the commodities enumerated in tho long list embodied in its com plaint and that, while there is a special commodity rato published in ther O. R. & N. tariff upon other commodities to nnd from that point, . tho commodities enumerated should be taken out of tho western classifi cation of rates and placed in the special commodity list as published.
