3. That the said defendant and
all persons claiming under him, sub
sequent to the mortgage described in
the complaint herein, either as pus
chasers, incumbrancers. Judgment
creditors or otherwUe.m ay be bar
red and forever foreclosed of all
right, claim or equity of redemption
in said premises and every part
thereof, and that said defendant
may be adjudged to pay any defi
ciency which may remain after ap
plying all the proceeds ot the sale ot
said premises properly applicable to
the satisfaction of said judgment.

ORDINANCE NO. I HO.
An ordinance providing for the
licensing the - sale ot Intoxicating
liquors in quanltles of not loss than
one gallon, within the City of St.
Helens. Oregon, and providing a
penalty for any Infraction thereof.
The City ot St. Helens does ordain
as follows:
Section 1. (1.) The words "In
toxicating liquors" whenever and i
whereover used In this ordinance
shall be taken to mean and Include
spirituous, vinous, fermented, malt
or mixed liquors, or fermented
cider.
(2.) The word "person" when
ever used In this ordinance shall bo
taken to mean and include a nat
ural person of either sex, persons,
copartnership, corporations and ns
caclations of persons, and tho sin
gular number shall include tho
plural, and the masculine pronoun
shall Include the feminine and neu
ter. (3.) A wholesale liquor dealer
shall be taken to mean any person
who sells or In any manner disposes
Of Intoxicating liquors In quantities
of not less than one gallon, whether
In unbroken packages or otherwise,
and not to be drunk on the premises
where sold.
Section 2. No person shall cell or
barter or permit to be sold or bar
tered, within the City of St. Helens,
Oregon, any intoxicating liquors In
quantities ot lex than one gallon,
whether in unbroken packages or
otherwise, without first obtaining a
retail liquor license, as now provid
ed by ordinance 160 of this City.
Section 3. No person shall sell or
barter, or permit to be sold or bar
tered, within the City of St. Helens,
Oregon, any Intoxicating liquors In
quantities of not less than one gal
lon and not to be drunk on the
premises, and herein understood to
mean by the wholesale, without
first obtaining a license therefor,
from the Common Council ot said
City.

Section 4. Every person to whom
a license shall be granted undor the
provisions of this ordinance, shall
pay Into the treasury of said City,
the sum of Two hundred and fifty
dollars per annum, or a proportion
ate amount for any less period; pro
vided that no license shall be Issued,
hereunder, for a less period than
three months.
Section 5. Any person -wishing to
apply for such a license shall make
a written application to the Common
Council of said City of St. Holens, to
sell Intoxicating l'quors in quanti
ties of not less than one gallon and
not to be drunk on the premises,
which application shall be dated and
signed by the applicant and there
upon the Common Council of said
City may, In its discretion, grant
said application and order such li
cense to issue for not less than three
months, as hereinbefore provided.
Section 6. Any person who shall
barter, sell or dispose of, in any
manner, any Intoxicating liquor in
quantities of not less than one gal
lon, within said City of St. Holons,
without first having obtained a li
cense iheiefor, as herein provided,
shall be deemed guilty of a mlsde
moanor, and upon conviction tliere
of.shall be fined In a sum of not less
than Ono hundred ' Dollars, nor
more than Two hundred and Fifty
dolluis, and the City Reoordor shall
have Jurisdiction and la heruhy giv
