A21. (Introduced by Commissioner Snyderl An Ordinance Regulating the Erec tion and Use of Smoke Stacks in the City of Watertown, South Dakota. Be it Ordained by the Board of Com missioners of the C-lty of Water town, South Dakota: Section 1. (How Constructed.) That no person or persons, firm or corporation, shall erect, construct or use any smoke stack or chimney of any stationary steam engine, or of any steam laundry or factory, or of any steam works of any kind, now or hereafter operated or used in the City of Watertown, unless the same shall be so constructed, arranged and used that the sparks, cinders, coal, ashes or smoke therefrom shall not become injurious, or dangerous to the health, comfort, or to the property of Individuals, or the public, nor mater ially impair the comfort of persons or property within the city. Section 2. (Same.) That all such smoke stacks now or hereafter used and operated, shall be constructed and arranged in such manner and of such material as to be safe from causing a flre and shall be of such height from the ground as not, in any manner, to cause a violation of this ordinance. Section 3. (Powers of Mayor and Board.) That whenever in the opin ion of the Mayor of the City, any such smoke stack or chimney is causing or Is in any danger of causing a vio lation of this ordinance, he shall at once order or direct such smoke stack or chimney to be reconstructed or repaired of proper and safe material, or raised to such height or so ar ranged, within such reasonable time as he ^tiay fix, so that the same win be in compliance with the provisions of this ordinance, or the Board of Commissioners, may, when it deems any smoke stack or chimney danger ons to the health of the inhabitants or injurious to such a. degree as to be a nuisance, order the same torn down or extended up or otherwise remedied so that the same shall com ply with this ordinance. Section 4. (Penalty Any per son or persons, firm or corporation, violating or causing to be violated any of the provisions of this ordin ance, shall upon conviction be fined in a sum not exceeding one hundred dollars, and each day such violation is allowed to exist shall constitute a separate offense. (Introduced by Commissioner Bush An Ordinance Regulating Sidewalks and Providing for the Cleanlag There of. Be it Ordained by the Board Of Com missioners of the City of Water town, South Dakota: In the City of Watertown to allow any mud, rubbish, debris, or obstruction to be or remain on such sidewalk along such abutting property^ for more than twelve hours. Section 2. (Penalty.) Any' per son or persons, firm or corporation, violating the provisions of Section 1 of this Ordinance shall upon convic tion thereof, be fined in a sum not exceeding Twenty Dollars. (Introduced by Commissioner Bush) An Ordinance to Prohibit the Plac ing of Rubbish in Streets, Regulating the Placing of Material in Streets, Excavating Under Sidewalks or near Streets, Placing Buildings In Streets and Prohibiting the Obstruction of Sidewalks and Regulating Stair Rail ings, Eave Pipes over Sidewalks and Prohibiting Animals from Sidewalk or Being Picketed Across Roadways and Providing and Protecting Trees and Grass Plats and Providing Penalty for Violation. Be it Ordained by the Board of Com missioners of the City of Water town, South Dakota: Section 1. (Materials In Streets Permits.) The City Eingineer is au thorized to grant permission in writ ing to any person to deposit and keep lumber, stone, brick, or other mater ials for building, in any pub^c street, road, or alley, adjacent to a building •to be erected or repaired, for a space of time not eafceedlng six consecutive months but such permission shall hot excuse the obstruction or occu pancy with such material of more than: one-third in width of any, sidewalk, or more than one-third in width of the carriage way of any., street or road, or the placing of such material in such a way as to Impede the free flow) of water In the side gutter. Section 2. (Cleaning Streets 'fit. Rubbish.) Section 5. (Obstructing Sidewalk, Xo person shall place any goods or merchandise for sale or exhibition up on any sidewalk, or suspend any goods over the same for show or deposit !hereon, or cause or suffer to be de posited thereon, any cask, barrel, case, box or any other package ex cept as provided in the next section, nor shall any person, place, hang or maintain on or over any sidewalk, any sign, which Bhall extend more that three feet from the building to which it is attached or belongs, ex cept electrical or gas display signs, which may extend over the sidewalk, us far as the curb line, provided such sign shall not be less than twelve feet above the sidewalk. Section 6. (Goods on Sidewalk.) It shall be lawful. for any person to place on three feet In width of the outer edge: of the sidewalk in front of his premises, for a period not ex ceeding ten hours, any goods or mer chandise which he may be in the act of receiving or delivering. It shall also be lawful for any person to dis play on or over sidewalk in front of and within two feet of the building by him used as his place of business, any goods, wares or merchandise. Provided, that, no goods or merchan dise thus displayed shall be left on or over such sidewalk during the night. Section 7. (Buildings and Streets.) No person shall erect or maintain any building in such a position that the same shall stajid in whole or in part upon any public street, road, alley or sidewalk in said City. or so construct ed that any part ot the building prop er shall project into or over such street, road, alley or sidewalk Provided, that jut windows, bulks, cornices and other projections from a building from the first story, may ex tend over the adjoining street, road, alley or Bldewalk, not exceeding eight een inches arid no person shall con-, struct any cellar or basement stair way extending into any public street, alley or sidewalk, more than three and oas-half feet or any step,^ area or other appurtenances to any building so extending more than thirty Inches nor shall any person erect in any public street or road, any flight of stairs leading to the second or auy higher story of any building. Section 8. (Stair Railings and Grates.) The owner of any building in said City, having a stairway lead ing from-an adjoining sidewalk to the: basement or cellar ot such building, shall guard such stairway with a sub stantial railing not less than three ifeet high, and the entrance to such stairway: shall be at right angles to the street from which entry is made. Sec-tion 9. (Eave Pipes.) No per Bon,shall on any .street place or main tain-any pipe leading from the eaves of any building in such a position that water discharged thereby may flow upon or over any public sidewalk. Section 10. (Animals and Vehicles on Sidewalks.) Griswold of Arlington, visited friends in the city last week. Mr. Griswold had an op eration performed for the relief of eye trouble! The Aberdeen News of Friday last, refers to Dr. R. Rifenbark locating at that city and says he Is a son of Rev. Duane Rifenbark, for many years pre siding elder of the Watertown dis trict of the Methodist church. The young M. D. will practice osteopathy. Ralph Pruyn of Clark was in the city Tuesday putting on the finishing touches of advertising for the Clark county fair, which will be held at Clark October !, 2 aud 3.
