We pronounce the above from the Ua Z'ttr, a compound pure falsehood and meaness. It ia untrue frotn the beirinning to the md. Il has not even the hliadow of truth to support it. It is true Sanders is only the tool in publishing it, for we have it from good authority that the stateim nts came from the office of lohn F. Dillon. The fact are as follows: .fudge Mitchell was occupying the Bench as Judge of tlie District. He signified to the members of the Scott county Bar his in. tention of resinning. A meeting of the law yers* of all patties convened anil sent for Judge Bennett, leijiiesting liitn to permit them to ask the Governor for his appoint ment. Judge Bennett s.iid it was a sudden thing, he would think of it, and if the Bar was unanimous, he would not decline the appointment. A petition was gotten up ami signet! gen erally by the lawyers, and shown to.lud^e Bennett, and on looking it over and not seeing the name of Dillon on the pel it ion, he had an interview with Dillon, saying to him, that il he (Dillon) wanted the i-flice, he (Bennett) would not apply for it. Dil lon said he did not not want it, and then put hts name to the petition, asking for Judge Bennett's appointment. '1 he petition went?forward to the Gover nor. lie was absent, and the Secretary of State, Mr. Sell*, filled up the enrntuHsion and forwarded it to Jud-e Bennett. After wards, Judge Bcunett not wishing to act under a couimis-ion not approved by the Governor, wrote to Mr. Sells, returning the commission, anil requesting the approval of Gov. rimes. Mr. Sells returned the com mission, stating that he had written to the Go\ ernor, and he had fully approved of it. This came too late for Judge Bennett to go Jackson county to hold a court, and no term of the court was holder in that county at that time, showing that Judge Bennett did not start without delay on the circuit." Judge Bennett never had his commission revoked, and never did i ny act. as Judge except acknowledge one deed, until possess ed of the full appoinment of Governor Grimes, and never showed any "urgent and prolonged solicitations" for the appoint menk But alas for journalism, when such pa pers as the Gazette is supported by a clique, who demand of it the suppjession of truth and the manufacture o^ falsehood, as a con dition of its existence. No man livea who sustains a purer reputation than Hon. A. H. Bennett In private lite he is a model of virtue. As a judge of law, we have only to say, that it is the unanimous voice of the Bars of all the counties in this District, that no man has ever filled the office of Dis trict Judge so ably, so impartially, so hon estly, and so acceptably as has Judge Ben nett Not long ago the Gazette was puffing Judge Bennett to the skies. He was ac cording to the Gazette, a model Judge. But alas! how changed is that ignoble journal! Its owners at the Marble Bank have com manded it to vilify one of our best citizens, and it pours out co'umn after column of falsehood, disgusting to the sensible men of the party for whom it acts. At Iowa City this trial excites muoh less sensation thAn we expected to see, owing probably to the faet that the cit izens have already become tired of hearing about it. I immediately went to my farm and found E. Pierson, as renter, occupying my home, and his lease was not out nntil March, 1858. On or about the 20th day of August, 1867, I erected a small dwelling on my farm, and staid there in possession of the premises un til Pierson moved out, and then I moved into the old homestead house, and have been there ever since. The last of February or first of March, while living on said lands, and after I had filed a bill to set aside the fraudulent con veyance, Wm. P. Clarke, acting or assum ing to act for said Gideon, leased or preten ded to lease my farm to Boyd Wilkinson. Why was this done wheu the matter was pending in law, and myself in possession then for more than six months? On the 22d of Match, 1858, after said lease was given, Wilkinson came to where I lived, and in presence of myself and Jaa. Studer, and within hearing of Marcus Mc Dermot, threatened to take my life, if i did not leave my premises—calling them his— and that night several balls were shot into my shanty, which I was living in, and had put up to live in until Pierson moved out of my old home. My friends advised no violence cxcept in sell-defence, and to resort for protection to the law. Accordingly, the next day I had Wilkinson brought before Horace Tuttle, a kh. d.r.»d..U, .nd mddilioo.1 i„d,b«d. t? peace. This he refused to do, and a mitti mus was handed to A. T. McKlwaine, con stable, who took Wilkinson, at his request, into Wm. Penn Clark's—his attorney—of fice, and delivered him to Johnston Orr, deputy sheriff and jailor of Johnson eounty. Clarke told Orr that he would be responsi ble for Wilkinson, «nd not to put him in jail, aa he (Wm. P. Clarke) wished to en« out a habt*M emrjm, or words to that effiset.
