WARD HKKCIIKR.—Mr.Lane, President of the Literary Association, in forms us that there is a prospect that the renowned lieecher can be induced to lecture in this city some evening this week. Mr. l^ine went to Chicago yesterday evening, and will endeavor to arrange matters so that this noted speaker can do himself the distinguished honor to visit the Metropoli tan City of Iowa. tw The weather is undoubtedly improving. We hope it is so. The late cold snap we have been shivering over for the past week is but the tip end of the great snow storm whielt we have read of out in Nebraska and on the plains, and which camc very near reaching this point. Sleighing has, of late, been very fine at Nebraska City. The weather wise predict that we have just had the clearing up" *torm, and may soon ex poet more genial and aunim»r»like weather. We hope thny know all about it. MINNESOTA BANKS.—The time has como when we are compelled to renew our currency articles. The scandalous thrash, yclept Minnesota currency, is being scat tered here as thoroughly as it ean be—given every body who can be induced to take it We have heard of several persona leav ing here far Missouri, who had motuy paid them by Cook A Sargeant which they found it as impossible to use in that State as they would counterfeit money. This was "State bank of Minnesota" and "Farmer's Bank." Nothing ever happened to this city which came so near ruining it as did the circula tion of tbe Florence wildcat Let us add to it the circulation of the Minnesota cats, and we shall have a most beautiful reputa tion abroad. If our merchants have any regard for the future welfare of this eity they will discountenance the circulation by utterly refusing to receive it The traeh is not suflieieutly secure—it is not redeema ble at any aecessable point it is not spe cie paying, it is a rank wildcat, besides be ing an outrageous imposition upon the bu siness community. We warn all persons that there is danger there will be one grand smash-up among theee Banks, and no man is safe in keeping their issue over night We beseech our business nan to aip Uua praeioua seheme in the bad. Send along your advertisements and let the people know what is going on. But, you say, "nobo«ly reads the advertisements.' Hear what the best commercial puper iu the West, tiie St. Law is Republican, Bays this point: It is A mwt:il en idea that people do not read the advertisements iu a newspaper.— KVerv man of business does It, because it is only by this means that, be can keep up with his neighbors, or know what lie is doing or what is going on around hiin. A man who does not examine thisib pai'tmentof a news paper, will soou fall behind in the 'J: 10 race for busiuess ami iuformulioti.lor at bis speed everything is done now n days' Tlie cities of New Orleans and St. Louis are examples of tbe universal tendency to advertising— every man makes his calling or bis wants, known through this medium, and every ouu has to take a newspaper, in order to save a world of trouble iu hunting for any particu lar thing which he may desire to purchase. In truth, nothing can be done in the cities without the aid of a newspaper, aud so everybody retorts to it." ^-^•Considerable activity prevailed in town yesterday, the streets being crowded with teams and people from the country. We couversed with several of our farmers and tind that notwithstanding the outrage ous weather we have had this spring, they are by no means discouraged. They say that a large proportion of the grain is in the ground and their only fear is that the late frosts may have injured it. If this should be the case, they will have to re-sow the ground, but as many of them are without seed, it will be rather hard on them. We sincerely trust that no such ill luck may befall them, as it is to this portion of our community thst we must look for a retnrn of good times. THE WEATHEK.—Messrs. During the whole of the year 1857, the writer of this (residing on the side of the bluff, between Ath and (ith streets,) kept a regular diary of the weather, in which the height of the mercury at a. m., at neon, and at 0 p. m., together with noticcs of storms, Ac., are fully recorded. On recur ing to this it is found that from the 1st to the 20th day af April, inclusive, there were only four days an which the mercury was not below the freezing point at a. m. On two of the days (the 6th snd 15th,) the mercury stood at 13 deg. above sero, at six a. m. and on tbe 16th at 15 deg. aliove aero. During this period there were seven clear days, but one of them recorded as Spring-like every day but one of the twen ty were cold with high winds. On the morning of the 18th, snow fell to the depth of 5 to inches. The average temperature of the twenty days as deduced from the observations Uken at a. m., noon, and 9 p. m. was 32 1-2 degs. only and for the whole mouth of April o7 deg. On the 21st the change commenced, and winter rapidly merged into balmy spring But during the first twenty days of the month, the ground was frosen hard all the time aad little, if any, wheat was sown till May yet the yield was a good one, both in quality and quaatity, aa regards wheat, oats and bar ley—the destruction of this crop being ctused bj neessive rains which fall after the harvesting. RBAL EOTATB iBVBSTMRafBb— At this time Davenport and Seott County offers the most flattering inducements to those seeking investments for their money, to be fouod in tbe country. Real K-tate baa touched Itotlom, snd now is the time to buy. From this out the rise will be grsdusl bat sure, and with a fair crop this fall, lend aad lots will he selling in 1M0 for three tiaies what is now asked for them. The land in Scott county is just as fertile as ever it was, and just a large cro|« will be raised from it sgain. Orsin and produce will brine as high prices here as it will at any poiut oa the river, and the facilities for getting it to market, are certainly as good. In the eity the rise of real estate will be still more rapid. With an excellent country back to support a large trada, we think that prices of loteand rente, in 1860, will exceed any thing heretofore known. There is no pos sible reason why It should not ba so. By that time, the tremendous humbug, Pike'e Peak, will have exploded, and immigration from that point will be as great as is now the emmigration to it The majority of our merchants and business men are in a sound condition, and it only requires a good harvest to put the balance in the same po sition. A few shaky onee—those who never advertise, or endeavor to make their busi ness known—will "go up," bat the number of this clais in Itavenport, are few. Again, Davenport presents unsurpassed facilities for manufacturing. Cheap fuel, railroads, river, and the best qualities of building material no other city on the river can show as many and as good advantages for this branch of business, as Davenport. I^et us not then be discouraged with the present hard times, but put our shoulders to the wheel, and in another year Daven port will have forgotten that such a thing ss hard times ever visited us. O N E I If STORE FOR EVERY WORKINO MAN. NEBRASKA CITY, April No one who knows Mr. Brookfield, can for a moment doubt the truth of every word he utters. He is a personal frieod of mine, aud I do not hesitate to vouch far the relisbility of all his statements. In addition to this we have further and reliable information confirming everything he says. The Nebraska and Kansas Gold Minee are no myth, but a fact which will saon work wonders upon our western border, and build up a mighty State, which will form a connecting link between the Atlantic States and California. It will add to the resour ces of the coantry, a vsst snd uuexhausta ble mineral region, and it will build the Pacific Railroal. This last consideration is so great and of such immense importance to the country, thst its accomplishment will be glory enough for those who go to open up the buried riches gleaming in the dis tance. In haste, yours, D. C. CORBIN. Prom the Nebraska CHy Mews, Bitrs.1 It is with unfeigned pleasure we lay the following letters before our readers. To say we are pleased, delighted, expresses not one half the pleasure we feel. The source is unquestionable tho fact- irresistable. The question is fully settled that there are rich placers along the Platte and its tributaries. All doubts are removed. No one dare ques tion the statements of Mayor lirookliebl. They are a triumphant vindication of all we have said arid written about the great inte rior yeld fields of the continent. We com mitted ourself unequivocally, unmistakably in favor of the new Kl Dorado, its extent and richness. Facts sustain us—sustain western editors—remove the malicious stigma that it is all a trick of western editors to get peo ple out here. Sleepy togies and dreaming fools can rest quietly iu their oyster shells, and console themselves with the reflection that while they ure playing Rip Van Win kle, Anglo Saxon energy is carving out from the continent a great commonwealth prepar ing the way and hastening the time, when the iron horse is to carry the wealth of the country across the great plains, the moun tains, to the ocean, to meet the commerce of the Indies and of eastern Asia The car of progress—the speedy settlement of the interior, is not to be impeded by fools and maniacs. The laboring poor are not to be debarred the privilege of diggiug from the ground an independence and a fortune. One hundred thousand people ere twelve moons roll round will vindicate the trut hfuluess of these statements, also. Mayor Brookfield has, heretofore written the moit discouraging of all our correspon dents from the mines, lie has been extreme ly cautious—more so, perhaps, than any oth er roan in the mines. His statements have been implicitly relied upon. It was known that Brookfield wrote exactly as he saw matters at the mines, indulging in no exsg eration, no speculation. No man has giveu the mines a fairer trial. No man is better qualified to speak of them. Ilis statements can be fully relied upoo, and we venture the assertion that not one man among the nu merous acquaintances aud friends of Mayor Brookfield can be found, hereafter, to ques tion or doubt (he richness of the mines. Mr. Brookfield was formerly a highly resected and respectable merchant in this city, and when he left, last September, held the office of Mayor. With these statements we give Eis ARR MOW RBOBIV(M0 AT THl OLD Stand, HO. 18 LB OLAIRB HOW, a splendid assortment of Wall Papers ami Borders, e tlrtlr new style*, which we are determined to sell CHEAP AS THE CHEtPKT! laee to letters from Mr. Brookfield, first to wife, second to his brother-in-law. I am quite of the opinion that we have just commenced finding what we came here for, and our Nebrsska City Co.,) discoveries are creating much ex citement at the settlements, and people are coming in every day. There are now here on the creek, over one hundred men and we bear from numbers more that will noon be here. The gold which we find is of quite a ditferent quality from any that has been found at other places, and what Is called "shot gold"—all that has been found in oth er placeos is "scsle or (lost gold." Before I elose this I will enclose a few specimens, (if I do not forget to do so.) I seut you some,, sometime since, I do not at present remember where I washed it. Should any of my friends come out in the spring, give them my compliments, and tell them, for me, to come to Boulder creek, though as I have always written, I will advise no one to como—as for me, I am almost certain that we are now where we ean at leaat make pood wagea and I feel almoM certain will make large ones. I had intended writ ing positively for you to come on, but ou re consideration I think it will be much pleasanter thst yon, if you come, start lat er in tlie eeason, as then the roads will be much batter, and also the weather. Mr. Phillips resumed his argu ment he had discussed yesterday, the fol lowing propositions: 1st, that if the evi dence offered ia admiaaable for auy purpose it inuat be recived 2d, that the issue pre sented by the iudictmeut is not whether there has been a murder id, that to con stitute murder there must be a killing with deliberate or malice pretense 4th, that the malice of tbe law implies a wicked, and de praved, and malignant spirit, a heart re gardless of social duties, let*lly bent on mis chief 5th, that even iu cases of express malice arising out of a past grudge, if these had intervened new provocations, it was not to be presumed the killing waa an old gru.lge ot.li, that iu cases where the law presumed malice from the act of killing, this presumption may be rebutted by expressions of good will and facts of kindness on the part of the prisoner towards the deceased always considering important evidences as allowing what was his general dispoattion towards the deceased from which the jnry may be lead to conclude that his intention conld not liave |l.. en what the charge ini putes, quoting 'id Kusseli that this pre sumption may also be rebutted by showing thai tbe killing was iu psi-sion urising from sullii'ieiil provocation is evidence of absence of mnli.'», quoting from the Commonwealth against It.-ll, page 1 f.ii 7tl. That the law declares adultery to be the worst of provocations there could be no such legal absurdity as permitting evidence of lesser provocation aud exclud ing evidence of the greater. Hth. This brought me to the considers-* lion of the admis-ion of the provocation, that If the accused bad seen with Ins own eyes lie very act of the adultry, then the pro vocation could be giveu in evidence and not otherwise. This I demonstrated to be. wholly unreaeouiilde and fallacious, by ro ving that the eye. the ear and tbe touch, were but media through which facts wero transmitted to the brain, and that this formed the will and decided tbe action.— 1 was illustrating the penitiou thai tho knowledge ot the adultery ut the time ol its commission could be as definitely con veyed to the mind by the ear and tlie touch as by the eye, and cited examples to this end, when the adjournment of the v!«urt took place.
