REPLIES TO A QUESTION Never Promoted His Coach man and Never Had One. Topeka, Kan., Aug. 6. United States j Pension Commissioner Eugene F. Ware j reached Topeka at noon today for a ; twenty-four hour stop enroute to the G. A. R. reunion at San Francisco. In reply to a question as to the charges of Albert Martin being dismissed from I the Topeka pension office as being a vio lation of the civil service rules, Mr. Ware said: "I have not seen the newspaper ac counts of the charges, but understood j that I am charged with promoting my i coachman in the bureau. As I never I had a coachman or a coach, I think this must be a mistake. "We have done more business in the pension office this past year than in. any similar time for ten years. "As you will see, I am not charged with misconduct of office in any manner save a violation of the civil service rules. No shortage of funds is alleged. "In reality it seems to me an attack upon the administration through this bureau by enemies of President Roose velt. "I court the most rigid investigation by the civil service commission." KAW RIVER IS RISING. Additional Rains Addi Force to the Raging Waters. Lawrence, Kan., Aug. 6. As a result of the heavy fall of rain here and west last night the Kansas river here has risen about three feet in the past twelve hours. The current is swift and has undermined the north end of the new approach to the wagon bridge and continues to eat away the north bank. Junction City, Kan., Aug. 6. An Inch and a half of rain here last night caused the Smoky Hill river to rise rapidly and it Is now up over ten feet. A hundred and eighty foot temporary bridge here that took the place of the steel bridge that was washed away by the flood In May, was swept away last night and the only remaining bridge across the river in this county Is in great danger. Kansas City, Aug. 6. The Kansas river here has risen but slightly since yester day, and it is believed the water com ing this way from the west will spread out before reaching Kansas City and j that no damage will result at this point. Topeka, Kan., Aug. 6. A rainfall of three and one-half inches over this ter ritory after midnight has started the Kaw river upward rapidly. Many North Topeka citizens are alarmed by the heavy rainfalls of the past few days and the reports of rising tributaries of the river to the west and are packing up their valuables and preparing to flee to higher ground. Topeka, Kan., Aug. 6. The Kansas river at this place is slowly rising. Last night's rain amounted to over three inches. On account of high water up stream the river will be higher tomor row. ANNUAL REUNION. ' Famous Twentieth Kansas Will Meet at ola. Topeka, Kan.. Aug. 6. The boys of the "Famous Twentieth Kansas" will hold their fourth annual reunion at Iola from August 25 to 2S. The local committee at Iola Is making arrangements to help the visitors have a good time. Harry W. Brent, who is adjutant of the Twentieth Kansas organization. Is notifying the members. Harbison, building. $20,000; Masonic , lodge, $7,000. Losses well covered by Insurance. SHOT HER HUSBAND. Drunken Man Attacks His Wife With a Chair. Arkansas City, Kan., Aug. 6. Newt Far rie. while drunk today, attacked his wife with a chair, when she shot him through the heart. Farris was 50 years old. Mrs. Furris, who Is 45 years old has not been arrested. On Seven Counts. Wlnfield, Kan., Aug. 6. Fred Ammon was tried in Justice Eachart's court for violating the prohibitory liquor law and a jury found him guilty on seven counts. The court imposed a fine of $750 and CS0 days In jail. Ammon is a jolntist at Dexter, twenty miles southeast of this city. Given Six Months. Marion, Kan.. Aug. 6. John Mason, who tried to assault Mrs. Parliman near Creswell. has been given a six months' sentence and fined $250. Its Opponents Have Discovered An other Serious Obstacle. Colon. Columbia, Aug. 6. The latest advices from Bogota state that the ad versaries of the Panama canal treaty have assumed a new attitude which Is based o nthe recently published opinion of an eminent lawyer at Bogota who claims that acceptance by the Columbian congress of the Hay-Herran treaty would be unconstitutional, because congress did not sanction the .last canal project and for other technical reasons. The ladies of the Derby Baptist church are preparing for a large attendance at the Harvest Home Festival which is to take place on the Baptist church grounds Saturday evening. August Sth. There is a largo acreage of corn gath ering in the vicinity of Derby and the recent rains having assured good crops the farmers are in a much happier frame of mind than they were a few weeks ago. Therefore they will feel more like giving thanks and eating Ice cream with' their best girls. A number of visitors from Wichita are expected to attend the festi val. ALL IN JAIL. People Who Escaped From City Jail Boarding With Sheriff Schad. Warrants were issued yesterday for Sadie Dornbush, Mrs. Schumacher and Charles Evans, and they were removed from the city jail to . the county Jail, where they will remain until the time of their preliminary hearings. The charge against Sadie Dornbush was Incorrigibil ity; Mrs. Schumacher was charged with obtaining goods under false pretenses, and Evans is charged with aiding the two women in escaping from the city jail Tuesday morning. The hearing of Sadie Dornbush was continued until Au gust 13th, and the preliminary hearings oi Evans and Mrs. Schamucher was set for the 14th. Evans was placed under a bond of $600, and Mrs. Schumacher under a bond of $5W. Neither were able to furnish bond. TO BEGIN MONDAY.V Big Asphalt Mixer Ready for Opera tion Then. West Douglas avenue people are still kicking on account of the torn up condi tion of the street, and Tuesday evening a load of hay stuck in the mud hole at the corner of Douglas and Seneca. The concrete layers began work on the east side of Seneca street, leaving a big space without concrete. This has been excavat ed and for the past week or ten days has been a mud hole almost impassable with even a small load, and the man with a load of hay who went west on the concrete found his horses floundering in the mud. and the animals could not budge the load. It was stated autnorltatively that the laying of asphalt would begin Monday. The .mechanics can get the mixer ready for operation by Saturday, but it has been decided to begin the paving the firpt of the week, and one side of the street will be paved and opened within a week. BOYS IN MISCHIEF. Place GunCartridges on Street' Car Tracks. The street car people have been ex periencing considerable trouble within the past few weeks by boys placing load ed revolver or rifle cartridges on the car tracks. The cartridges explcio when struck by the car wheels. The street car men do not mind the explosion but there is. danger that the bullet in one of the cartridges may fly away andstrike some one. The police are also watching for the boys who do this and have promised the lads a very interesting time if they should And any one of them putting cart ridges on the street car tracks. He will be in the market about three months, purchasing the new fall lines. His intention is to r on the mar ket every day during that time, which will enable him to procure the Ut.st novelties and all the bargains oft rod in dry goods centers. Mrs. Morsman accompanied him. An Ordinance to Curb and Pave Seneca Street' in the City of Wichita, Sedgwick County, Kansas, From the South Side of Douglas Avenue to the South Side of University Avenue, and to Provide for Payment Therefor, and Authoriz ing the City Through its Proper offi cers to Do All That May be Necessary in the Making of Said Improvement. Be it Ordained by the Mayor and Council men of the City of Wichita: Section 1. That it Is hereby declared necessary and is ordered that Seneca street in the City of Wichita, Sedgwick county, Kansas, from the south side of Douglas avenue to the south s!deof Uni versity avenue, be paved with asphalt, the roadway of said street to-be so paved as to be fifty-six (56) feet wide from the south side of Douglas avenue to the south side of Texas avenue, and forty (40) feet wide from the south side of Texas avenue to the south side of Maple street less the width of street car track and one (1) foot on the outside from said Douglas avenue to the south side of Maple street, and thirty-five (35) feet from the south side pf Maple street to the south side of University avenue. Sec. 2. Said pavement shall be of as phalt laid as follows: the base shall con sist of a layer of hydraulic cement con crete four inches In thickness and said pavement shall be either of natural as phalt rock wearing surface or of sheet asphalt surface. If of rock asphalt, the natural asphalt rock shall bo laid direct ly on the concrete prepared and laid in accordance with specifications for a rock asphalt wearing surface now on file in the office of the city clerk; If of sheet asphalt, there shall be spread upon said base a binder course of bituminous con crete one and one-half (1&) inches in thickness and upon this shall be laid an asphalt wearing surface one and one-half inches thick, the matrix of which shall be composed of refined Trinidad aspha.lt obtained from the Island of Trinidad, or asphalt of equal quality for paving purposes, all to be done In conformity with the plans and specifications for sheet asphalt pavement now on file in the office of the city clerk of this city. Sec. 3. That all said work of paving to be constructed of such material and in such manner that the same shall endure without the need of repairs for a period of ten (10) years after the completion thereof, according to said specifications therefor. Sec. 4. That it Is hereby declared neces sary and Is ordered that said "Seneca street from the south side of Douglas avenue to the south side of University avenue be curbed, said curbing to consist from the south side of Douglas avenuo to the north side of Texas avenue of ce ment business curb, to conform in all re spects with the plans and specifications for business curbs on file In the office of the city clerk; that said curb from the south side of Texas avenue to the north side of University avenue on South Seneca street to consist of cement -residence curb, to conform in all respects to the plans and specifications for said residence curbs in the office of the city clerk of Wichita, Sec. 5. That the city clerk advertise for bids for said work and that the city of Wichita, acting through its proper offi cers, be and Is hereby authorized to enter into contract for the aforesaid improve ment as provided by law and do what ever may be necessary towards the mak ing and acceptance or rejection of said improvement and payment therefor; that to pay therefor. Internal improvement bonds may be issued in such denomina tions and on such terms as provided by law. Sec, 6. That a petition signed by the required number of qualified property owners has been presented and a proper resolution passed and published, time for protest has elapsed, and all proceedings prior hereto are found to be regular. That it is hereby declared necessary and is ordered that Univer sity avenue in the city of Wichita, Pf Ig wick county. Kansas, from the west s!d of Seneca street to the east side of Hiram avenue be paved with asphalt so as to make the roadway of said street forty (40) feet wide. Sec. 2. Be it Ordained by the Mayor and Coun cilmen of the City of Wichita: Section 1. That it is hereby declared necessary and Is ordered tnat First street In the City of Wichita, Sedgwick county, Kansas, from the west side of Main street to the west side of Water street be paved with asphalt; the roadway of said street to be so paved that it shall be forty-one feet wide. Sec 2. Said pavement shall be of as phalt laid as follows: the base shall con sist of a layer of hydraulic cement con crete six Inches in thickenss and said pavement shall be of either natural as phalt rock wearing surface or of sheet asphalt surface.
