Now tho largo amount of liquor consumed
in Honolulu nt that timo was proof enough
thnt tho five dollar per gallon duty opera
ted by no means ns a "prohibition " of its
importation; but it did howovcr opornto ns
n strong inducement to mnny to srnugglo
nnd thus cvndo tho paymont of nny duty
whatover on spirits. Many nnd various,
implo as well ns ingonious, ware tho plans
nntTdevicci adopted by those who embarked
in tho biihitiCRs. Sometimes tho smugglers
brought their packages by boat nt tho dond
of night into the Nuimuu stream nud sank
thorn thoro to bo 1 amoved nt convenience
This wns bnndy for tho two liquor shops
that flourished in tho immedi.ito neighbor
hood. At Ewn, whero Victor Chnucercl,
licctiFCo of the French Hotel, Fort street,
bad n cottngo nnd n garden, ho used to en
tertain tho Captains of whalers. Thero
wero Fronch whalers in thoso days, and re
port mid tho masters found it profttablo in
moro ways than ono to rnako trip3 in their
"boatrto Pftarl Kivor, near ono of tho estu
aries' of which was situated "Victor's gar
dc"n. Then again, tho boat-landing nt AVai
kiki, now included in Knpiolnni Park, could,
if VOCka hiid tho power of speech, tell mnny
tales of miduight expeditions nnd tho laud
ing there iOf mysterious casks nnd boxes.
In fact, "thoro wns in thoso dnys n vast
amount "of liquor smuggling carried on,
nnd tho'instancos of detection wero vory
raro. Indeed, ns I subsequently learned,
cortnin government officials (all since de
coahed) wero ntnong tho most nctivo agents
in tho business, nnd mndo lots of inonoy by
it. I remember an instnnco rotated to mo
somo yonrs nftor its occurrcnco by ono of
thoBO who took part in it, which, while it
illustrates tho boldness of tbo smugglers, is
not a little amusing.
One day about noon, Dr. Judd, tho Min
ister of" Finance (and general factotum of
tlio Government) strolling nbout "tho
boacb." ns was often his wont, observed nt
tho coral ombnnkment (which nftorwnrds
grow into Drewer's wharf) tho " tido
wnitor," or Customs. Guard, ono Rogers,
growling nnd swearing ntn native in n boat
nlongsido tho wharf. Tho Doctor inquired
ns to what was the trouble " Why," snid
Kogote, "I can't ninko this stupid kanaka
understand how to got that barrel of bcof
on to tho whnrf." "Poha!" said tho Doc
tor; "givo mo n ropo nnd I will show you."
And so tlio ropo bciug proourod, tho Doctor
proceeded to rcovo it through n ring nml
nuulc, iu nautical parlance, a "pnrbucklo,"
whereby, the Doctor pulling on ono sido and
llogors on tho othor, tho bnrrol of hoof (?)
was soon safely landed. "Thoro," snid the
Doctor, genially, ns ho walked, away,
"whon you get in a pilikia again of this
sort, just let mo know." Ono may imngino
that Hogers felt vory much rolioved when
tho Doctor wns gono nnd tho barrel of
brandy safely oouveyed to its destination ;
nnd so doubtless was his confederate, tho
Prefect of Police, who saw tho "parbuck
ling" operation from a neighboring window.
About tho middlo of November, 1840, I
saw n most extraotdinnry ipectnelo on Kn
nhuumnu street. The otltco of tho Collector
of Customs wns, ns ban boforo boon stated,
in tho building at tho head of that stroet,
now occupied by Whitney nnd Hobcrthon,
nud tho cellar boneath wns tho warehouse
of tho Collector. From this cellar, ouo day
nbout noon, I saw live casks of brcttdy
brought forth, and iu tho street iu front of
tho building, whilo Government officials
stood by iu grim bilenco, "Marshall tho
Cooper," by order of Dr, Judd, proceeded
to knock iu tho heads of tho caiks nnd tbo
liquor rati in a stream dowu tho street.
Tho lookers on, who soou gathered iu
crowds to witness tho straugo sight, in
quired, "Why this waste of over thousand
dollars worth of good liquor i" As it ran
down tho street iu a me.iudoriog stream,
occasionally.lt gathered iu little pools, nnd
tho nntivts wero to bo soeu ou nil-fours,
getting freo drinks, whilo some managed to
b til' up a bottle or two for futum us. This
brnndy had beeu found ou tbo deck of a
whaleship in the harbor ouo tuoruiog, mid
the ownership traced to n German brig.
Tho brandy was seizod and coutitewted, aud
the Captain of tbo brig find $2,600, which
bo pa$d. Soros one suggested to Dr. Judd
that-the liquor ought to be sold at auctiou
for tho beneSt of the Government, but he
testiUed hit stern teiupemuce principle
(not b few used ouother term) by destroy
iug it ou the spot, as ho would a wild beast.
About tbi time there was an article, of

from tlio firm who wcro tho importers. It
wns said to havo been the practico of thn
"fid shop" keepers, nftcr their customers
had becomo well seasoned with other liquor
so ns to loso tho Fcneo of tnsto, tobringoat
tho"Starkoylfc.Tanion."
Jnt thoro were two notnblo instnnccs of
smuggling liquor after tho tnodo nbovo in
dicated, nnd sovcrnl yenrs later, both of
which wcro nccidontnlly discovered. Ono
of thoso was nn invoico of two hnndrcd
barrels of beef from JJoslon, by tho ship
Chnrle. Ono hundred nnd nincty-nino
barrels had boon safely landed, tho two
hundredth nnd last wna in tlio slings,
swnyed up with tho mainynrd tacklo, whon
tho slings broke, nnd tho barrel -fell on lo
tho wharf nnd burst open, displaying nn
iron-bound ton-gallon keg. This wns fuuiui
to contain brandy, and nn cxnminntion of
tho ono hundred and nincty-nino previously
lauded revealed in tho ccntroof each n sim
ilar keg of brandy, nicely packed nround
with beef. As in tho former case, tho
brnndy was injured by tho brine.
Tho other instnnco was nn invoico of
nbout 100 barrola of flour from California
(about tho year 1852.) Tho flour Was
stored in n building that stood on tho lot
now occupied by Ilhodcs' brick block. Ono

clinnical operation going on nt such nn nn
usunl hour ns ton o'clock nt night, nnd his
interest wns enhanced when tho coopor,
nftcr scooping out n bng full of flour, pro
ceeded to lift out from tho barrel n neat
iron. bound keg. It was brandy again, bnt
thn flour, unliko tho brino in tho former in
btnucos, had not spoiled tho flnvor of the
nrticlo. I note, nlso, that although tho
liquor in both ensos wns seized nnd confis
cated by tho Government, it was not spilled
on lo tho street, ns in 18-40, but was sold
for tbo bonofit of tho Treasury. Tho mer
cantile firms of Honolulu that wcro directly
or indirectly implicated in tho two last
cited cases wero not fined.
Smuggling, a statutable ofi'onso, is cheat
ing Government out of its lawfnl dues.
What is tho real difl'erenro botwooii defraud
ing Government out of duties, or tnxes for
instnnco, nml defrauding one's neighbor ?
JTet public opinion seems to havo mndo n
distinction iu thoso matters without thoro
being any actual difi'oroncc. No conscien
tiously moral man would bo guilty of tho
former any moro thna tho latter.

John Quincy Adams and Josinh Quincy
Adams, Sr., wero enthusiastic advocates of
early rising. Thoy practiced it in boy
hood, nnd attributed to it their physical
vigor in old ngo. Jndgo Story, who wns
nn inlimnto friend, loved dearly n good
morning nap, nnd their opposito opinions
often gavo riso to sharp nud witty discus
sions. Ou ono occasion, when tho two
eminent men hnd dined with tho Judgo, ho
invited them lo nccompany him to tho law
school in Cambiidgo, whero ho wns to
dolivor a lectnro. Ho iuvitcd tho ox-Prosi-dent
to tnlk to the students, nnd Mr.
Adams made interesting practical remnrks,
touching, among othor things, ou his fnv
orito topio of early rising. Tho Judgo
went on with his lecture Tho nftornoon
wns hot nnd tho lecturo room closo, nnd
toward tho closo of tbo lecturo ho noticed
thnt tho class woro nodding to each other
nnd smiling. Looking first on his right
hand thou on his loft ho discovered tho
secrot of their merriment, for both of tho
distinguished visitors wcro asleep nnd nod
ding. Ho could not resist tho temptation
to add n postscript to his lecturo. " Toiuig
genttemon, I call your nttontiou to thix
visiblo proof of tho evils of early rising."
Tho loud Inugh that followod nwoko tho
goutlomen, but thoy did not understand
the joko thnt caused it.
