His pretty daughters sang and played the guitar very well, and naturally the place became a favorite resort for the miners after tho day's work was over and on Sundays. Ono morning early a messenger from tho Irishman wont through the camps with the information that he had a "nigger" n prisoner, who had been guilty of some grave offense, nnd that he wanted tho " boys " to come up and drcido what should be done with him. On our arrival nt Mac's, we found nearly tho entire population within a radius of fivo miles assembled in grave deliberation. Tho prisoner who, was as black as night, sat on a log with his hands tied. Tho olfbnco with which he btood or rather feat, charged, was tho having attempted, on the preceding evening, to take some liberties of a pecu liarly insulting nature, with one of the landlord's daughters. Tho matter was fully discussed among tho ""boys, " aud whilu all agreed that the ofTenso was a ery outrageous one, seeing that it was committed by a " nigger " against n white woman, tho opiuiuns were very divcrgcut as to tne proper punuutuent to bo admin istered. Some a small minority, however wero for shooting or hanging; others, too lenicut perhaps, wero in favor of simply banishing him from tho diggings with a warning not to be seen there again. It ended in thb appointment of threo judges, who were emjxjwercd to fix tho penalty. These, ( of rbom Iicardslcy and I were two, and a Kentuckian mado tho third) re tired up the bill-sidtt among the pines to consult together, while tho crowd below proceeded lo " liquor. " The sentence was, that the prisoner should receive thirty-nine strip well laid uu the bare back with the risu, (a rope of plaited leather thongs) be furnished with two days grab, and ordered to leave the diggiugs iusUnter, on pain, of being shut on sight. This decision was received with applause by nil, ( except the dsrkey) aud was at once and vigorously carried out.
