a sharp appetite by digging and washing
in the ict-cold water ol the river, went up
to his camp, to find that his mate had tfY
camped, carrying olTa hor.o and the joint
stock of gold dual, amounting, it was said,
to some fifty ounce. There wat great in
dignation among the minirs at this out
rage, which tier considered n particular
ly mean the stealing from " n pard " of
o pitiful a sum, right on the spot where
it could bo so easily dug. The one or two
horj-ea in camp wrro speedily saddled And
men with shoUguns went in pursuit of tho
thief, bat 1 never heard of his having beca
caught. I doubt if he would havo been
lynched to death, for oar people had not
yet been goaded by outrage nnd crime, as
was ubpqucntlj the case, to take tho law
into their own bands.
Threo ox wagona, belonging to a family
from Santa Cruz, formed our train from
Mormon Island to Weber's Creek. Wo
were three days oa tho road, and tho
nagon containing tho joint, stock of myjelf
nd Beardsley got upset on a side hill late
in the afternoon of tho second day, so wo
camped down thero for tho night. Jlyself
and tho driTcr, a California half-white,
went on to a spring two or threo miles fur
ther where the other wagons were campsd,
he to get assistance to come in tho morn
ing to right our vehicle, and I to get a jug
of water to carry bick to our camp on the
hillside. It was already dark when I set
out on my return, carrying tho jug of
water in one hand and a chunk of fiesh
beef in the other. The night was very
dark, and the road led all tho way through
a forest of trees, tho dense growth of
which rendered the darkness almost palpa
ble, I knew when I was on the road by
feeling with toy feet for the ruts made in
the soil by the carts. It was n very long
three miles, and when by the rising ground
I knew I was pretty near camp, 1 shouted ',
to Beard&Iey and was gratified by hearing
him respond near at hand. He had
heaped up a monud of dry leaves and twigs
to which, as I joined him, he applied a'
match, and the big flame that leaped op
illuminated the hillside and the plain over
which I had come, for a wide spare. We
were surrounded by hundreds of coyotes
a creature between a fox and a wolf that
had evidently been jogging along with me,
attracted by the beef I carried, all the way
fro the othr camp. , They are mischiev.

That same night we had another visitor,
a big grirxly bear. Wo did not seo, al
though we beard him, overhauling a bag
of dried meat with which" he made quite
free, but hts tracks were plain enough all
bout us in the morning, and from the sixe
9 inches across indicating that he
must hare been as largo as an ox. Our
friends at the other camp were similarly
visited by perhaps the same hear that
night, acid lost a quarter of beef that was
hung up at the tail of a wagon.
Weber's Crt-ek, where we located our
filiniog camp and pitched our tent, we
found to be quite dry, except where hero
and there was a pool of standing water.
Prom the appearance of its bed,.tb?s must
have been quite a stream in the season of
winter rains, lbe settlement wtnen even
tually grew up here was fim named Hang
town, in honor of a lynching affair which
took plfco there in early days, aud was
afterwards and is now known br the more
civilixed name of I'lacerville. Tbo gold
which was found almost anywhere in the '
bed and banks of the creeK and in the
ravines leading" to it, wai not " dust "like
Uut fesnd on the fork of the American
and Feather rivers, bat coarse and lumpy,
the pieces varying in size from small bird
shot, op to lumps weighing several ounces
rare instances were knuwn of a pound
or more found in oue piece. I bad better
luck at the dry diggings than at Mormon
Island. 1 struck, mio a rariuo that came
'down ft moderately sttep hilUde, and in
aainiog parlance, "struck it rich." My
first Dan full of earth from the crevice of
tkia ratio, whea washed out iu a pool in
the creek, left about eighty dollars worth
of coarse gold, by weight. The work was
a good deal slower than washing by a
trail f m the river bars, but It paid
very much better. I got out about twetve
ounces the first day. Deardsley, my prU
car, was of a cocumercul turn of uiud,
aud it was agreed between us that he
shoald remain at the tent and attend to

left Honolulu in thn summer of 1817 for

tho miner xns a man named Colson, who
had nlo resided on thesn hi a nil , nnd who
in 13-lfi, logrlhpr with tho late Ij. i. Tor

of manslaughter. It snems that tho two
accused wrro interested in catlln raising nt
Uliipalaknn, and that in protecting their
slock from thieves, they, br ono of thorn,
had shot a native, who eventually died

said that legal proceedings wera carried on
in n somewhat jiecnliar mnnner in theso
Islands thirty or forty yeara ngo. How
ever, Torbcrt wna acquitted nnd Colson
pnniahed by a pecuniary fine, Mr. Ilicord
being the Crown pruiccutor. Now, nway
off in thpvo California wilds, they met for
tho first time since the trial, nccuser nnd
neenscd. The lnttcr, who was excited by
drink, brcamo much enraged, accusing
Ilicord of having worked d d hart! to get
him hnng, nnfnirly, hut lhat now they
were at lnt-t on equnl torms. Ilicord, who
behaved very coolly throughout, said ho
had only dono his sworn duty as a public
officer, without personal malice, and ad
vised the man to let it drop. But with
increased potations ho becamo still moro
excited, and ran off to get his rifle, swear
ing that he would have llicord's life. In
the crowd which gathered to listen, was a
number of Western men, from Kentucky
and Missouri, who looked on with stolid
faces. Bnt when Colson camo back with
his rifle, ready for murder on the instant,
several of these big, qniet, matter-of-fact
fellows promptly stepped forward nnd dis
armed him. And as they did so, one of
them remarked, in a slow, unexcited, but
emphatic manner, " Seo hyar, stranger,
that man aint armed, and ye can't shoot n
unarmed man." And so tho affair ended,
for that time at least, nnd I heard no moro
of either party, Ilicord having left tho
creek on the following day for new dig
ging reported a discovered on the Stanis
laus Ilivcr.
Another incident which I will relate, still
fnrther illustrates tho spirit of law and
order which prevailed among tho miners
during tho liret six months of tho gold
diggiugs. A milo np tho creek from our
camp, was established a family from Santa
Crux. The father was an Irishman who
had lived in the country many years, was
married to a native California woman and
had raised a large family, mostly grown
np daughters nt that time. On the bank
of tbo creek he had erected n largo
thatched booth as a residence, iu thi front
part of which he sold groceries, including,
of course, liquurs. His pretty daughters
sang and played the guitar very well, and
naturally the place became a favorite resort
for the miners after tho day's work was
over and on Sundays. Ono morning early
a messenger from tho Irishman wont
through the camps with the information
that he had a "nigger" n prisoner, who
had been guilty of some grave offense, nnd
that he wanted tho " boys " to come up
and drcido what should be done with him.
On our arrival nt Mac's, we found nearly
tho entire population within a radius of fivo
miles assembled in grave deliberation. Tho
prisoner who, was as black as night, sat on
a log with his hands tied. Tho olfbnco with
which he btood or rather feat, charged,
was tho having attempted, on the preceding
evening, to take some liberties of a pecu
liarly insulting nature, with one of the
landlord's daughters. Tho matter was
fully discussed among tho ""boys, " aud
whilu all agreed that the ofTenso was a
ery outrageous one, seeing that it was
committed by a " nigger " against n white
woman, tho opiuiuns were very divcrgcut
as to tne proper punuutuent to bo admin
istered. Some a small minority, however
wero for shooting or hanging; others,
too lenicut perhaps, wero in favor of simply
banishing him from tho diggings with a
warning not to be seen there again. It
ended in thb appointment of threo judges,
who were emjxjwercd to fix tho penalty.
These, ( of rbom Iicardslcy and I were
two, and a Kentuckian mado tho third) re
tired up the bill-sidtt among the pines to
consult together, while tho crowd below
proceeded lo " liquor. " The sentence was,
that the prisoner should receive thirty-nine
strip well laid uu the bare back with the
risu, (a rope of plaited leather thongs) be
furnished with two days grab, and ordered
to leave the diggiugs iusUnter, on pain, of
being shut on sight. This decision was
received with applause by nil, ( except the
dsrkey) aud was at once and vigorously
carried out. This was, I think, the first
instance of lyunh.law that occurred in tho
