A copy of this was presented to Judge Lee by the committee, consisting of C. S. Uattow, I", Cummings, John Richard son, S. P. Kalama and S. M, KamaLau. All the persons here named are now dead. lodge Lee, in expressing his thanks to the commit tee, stated that the President of the United States had told him that, undoubtedly, the Senate would appro e the Reciprocity Treaty with thes Islands. The celebrated committee of thirteen, of Honolulu, which had been so prominent in the move ment against Dr. Judd, was still in existence, and a petition from them was laid before the House of Representatives asking that the Hon. Ci. M. Robertson, one of the judges of the supreme court, be not allowed to hold a scat in that House, inasmuch as his so doing was opposed to the 23d article of the constitution, nut article read as follows: ' rtic supreme power of the Kingdom, in its exercise, is di vided into the cxeculixc, Icgislatise and judi cial; these are to be prcsened distinct; the two last powers cannot be united in any one individual or body." The question was re ferred by the House to Chief Justice Lee, who gate a lengthy reply. The gist is contained in the following words: "I do not understand thb article as excluding an) executive, legisla tive or judicial officer from a voice in either of the other departments, besides his own; but its meaning is that the whole owcr of one of these departments shall not le exercised by the tame lands which possess the whole owcr of either of the other departments." This dictum of Judge Lee was, however, re ceived with a good deal of dissatisfaction, for it was generally considered anpirulous that a judge should help make the laws which he was himself to execute. The present constitution, granted in 1864, provides (Art. so) that "no judge of a court of record shall ever be a mem ber of the Legislative Assembly." May 17, iSjS, diet the Hon. He was, or professed to be, a chemist, and claimed to have made the indigo exhibited by him from the weed which abounds here, by a peculiar process which he kept a profound secret. But after some time it leaked out that the Doctor's laboratory on the Valley road, which he kept so jealously guarded, was an illicit distillery' of spirits, in which he hail car ried on a flourishing business. A sample of his indigo, forwarded to I Iamburg for exam! nation, was pronounced to lie an article some what resembling indigo, but far from lieing indigo itself, and having no value in the market of Hamburg, where large quantities of the real article -are liought and sold. Frick was never proceeded against here, but drifted back to California, w here he died. August Sth, at Makawao, list Maui, died Mr. Z. Kaauwai, a native of mark. He was a circuit judge at the time of his death, and a man of considerable importance. While Ho apili was governor of Maui, Kaauwai wis an active and able assistant in government busi ness. He had been sev era! times returned to represent cither Makawao or Wailuku in the Legislature, and look a high place among the members of that body. He was also a mem ler of the land commission, lly industry and thrift he had liccome wealthy, and was noted for liberality.
