The decision reads aa tollowa: "This is an Indictment of a deputy clerk of the d 'strict cocrt or Hawaii for converting to his own use moneys cf persons other than the United States, deposited with the clerk to te cure the payment of costs, by parties to proceedings other than proceedings in bankruptcy (Counts 1. 1, 4, 7, t) or by parties to proceedings in bank ruptcy (Counts 2, 5, 9). The sixth count charges the defendant, as cler. with a like conversion. A demurrer to the indictment was sustained sod the United States brings the case here. The judge assumed that the costs referred to in the sev eral counts vere fees of the clerk and. we presume. In cass of proceedings in bankruptcy, fees collected for the re feree and trustee, and also that the funds were funds to be accounted for by. the clerk as debtor, not as trustee, under the decision in United States v.
