MeTyclre of tbe Metfao diat Kpiscopal Cburcb teatifled that bis wile and the Commodore'a wile were daughters of half sis'ers, and that he was ill in the Commodore's bouse about three weeks in February and March, 1873, most of the time confined to his bed ; that the Commodore frequently vulted him in his room, and had venations principally, at first, on the subject of the disease with which both aa a con were afflicted. "We talked," tbe-Bishop about horses, preachers, continued," railtoads, the Church of tbe Strangers, and other things." Then the Bishop told the story of his talks with the Com modore about tbe establishment of tbe University of Nashville, and gave tbe details suggested as to the formation of tbe college, the purchase ol grounds, and the establishment of the Board of Trus tees, with himself at tbe head. Tbe Commodore had no faith In boards, and wanted the Bishop to take charge of the university. The Commodore was very particular to place all the power in the Bishop's hands. There wss a flutter among the pro ponent's counsel when Mr. Lord ap proached the question of the Bisliop's knowledge of the Commodore's second wife. Mr. Lord asked . What was her name when the Commo dore married her ?" " Frank Armstrong Crawford." " Was Iter name ever Elliott ?" " 1 object," said Mr. Clinton. " I am advised that the witness knows not only that her name was Elliott, but that Elliott, was living at the time she married the Commodore," said Mr. Lord. Here ex-Judge Black followed it up with the Citation of a case in wliiclt a will was set aside on account of the relation of the principal legatee, a woman, to the testation, with whom she was living as his wile, although not married. Judge Black urged earnestly that the testimony was admissible to show the exact relation ot Miss Crawford to the family of Commodore Vanderbilt. He said "there was enmity against her on the part of the Commodore's daughters which pioduced a «■ irre- ponding bitter ness of feeling on her part. All that is so perfectly natural that it seems but to be stated for tbe Court to uudersuiiid it, and it is certainly true. There waa however, one exception in tbe family. William H. Vanderbilt approved the marriage.encouiaged improbably brought it about,and coulinucd alter tbe marriage to be on terms the most friendly with her—as friendly as if she had not done to the family that most horrible injury ol marrying an old man in his dotage lor his money, making him ridiculous in the eyes of the whole world. Now that is what we want should be shown—the relations between these daughters on one side, and Vanderbilt toward the second wife of the Commodore. But the aggravation is immense if it appears that tills mar riage was uot only a most imprudent one, calculated to offend to the last de tbat the daughters I in addition to that it was unlawful. If we show that we make out a case. Surely that shows that she was not a person tube put there, and that any influence which she exerted was altogether wrong aud undue. We want to show tbe circumstances of tbe marriage all through, and tins agg lion that her former husband was 1 at ibe time tbe marriage took place. That would be a juslifica ion—a frill and sufheient reason why the daughters with held from her the respect that such a relation as that, if it had been lawful and pioper aud reasonable, would have entitled her to. A^Suit Involtiny hi« Action (in Military Commander in New Orleans. A case in which General Phil Sheridan is defendant, and in which $400,000 is at issue, is to be heard in the Circuit Court, in New York, next week, by Judge Wal lace. In 1809 General Sheridan was mili tary commander in New Orleans, under there-construciion acts of Congrees, and in that capacity was appealed to by Mark Hoyt, now of New York, in a regular petition, imported by aftidavils, to dis IKissess James A. Whalen, who was then in the possession of the Kiloona planta tion, in the parish of St. Charles, about thirty miles from New Orleans, on the Mississippi. After a consultation with the judge Advocate-General, General Sheridan issued an order by which Wha len now claims lie was dispossessed and Hoyt put in possession of the plantation. Tbe suit is brought by Whalen against the General for the recovery of the value of the personal property which was then on the farm, and also for the valme of the standing crops. Hoyt claims that he bought the farm, and paid Whalen for ii, and that the latter, after receiving the money, declined to give up the occupan cy, in the hope that the delay which woul ! follow legal proceedings would enable him to gather the stauding crop.
