RKPRINTKP FROM YMTIRPAY LYNCH ▼». MARTIN. A' I Cause Why He Holds tha Oflos of J Sheriff. [Yesterday 's Gazette. ] This morning Charles B. Lore and George H. Bates, Esq»., counsel for Purnal J. Lynch, presented the petition of the latter to the court, setting forth frauds at the late election whereby he was deprived of the office of 8heriflT, which he was legally elected. The peti tion, to which is attached the affidavit of Lynch declaring that the facta set forth In the former are true to the best of hi» knowl edge and belief. The petition first »Ute» the fact of the election, the count as returned by the elec tion officers, the action of the Board of Can vassers, and then goe» on to narrate where the fraud* were pre pet rated. It declare» that tn North Chrlitlana hun dred there were 37 vo|*s cast by non-resi dents who had paid no county tax within two years preceding the election. in South Christiana three vote» were cast by non residents and two by criminals dis franchised by Imprisonment and the lash. Seventh election district, Fifth ward, Wil mington, 18 votes by non-residents, and in Eleventh district, Seventh ward, 30 votes by non-residents. The total number of fraudulent votes cast being 85, besides 200 other illegal ballots mentioned In a general way. The petitioner declares that all the fraudu lent votes thus cast were deposited for .James Martin, and by them he, Purnal J. Lynch, was defrauded of hie just rights. The petition concludes as follows : Wherefore, your petitioner prays that a it issue out of said court, directed to d .James Martin, directing him to Hie rule the «ai appear upon a day therein named, and show cause, if any he have, why an information in the nature of a quo i rarranto, shall not be filed to Inquire by what warrant he, the said James Martin, doth exercise the »aid office of sheriff of said county. Accompanying the petitiou was an affi davit of Thomas Toy, setting forth the fact cast in Jhrlstiauahuu that illegal votes dred for James Martin. The court made the rule to show cause why a writ of quo warranto should be issued returnable on Monday, when the matter will come up for argument. Martin's counsel, Anthony Iliggius aud E. U. Bradford, Esq»., accepted service of the rule, Martin being present iu court. If the writ asked for is granted a time set for taking testimony iu the matter will be net and the contest formally begun. Hearing ltefore Enquire Yamlegrlft. A hearing in a ease of disorderly conduct, in which au elderly lady was the defendant and a young married lady the prosecutrix, took place lefore Esquire Yaudegrift this morn ing. The parties are tenant» in the same hou»? and from the evidence given, the trouble arose lrom the payment of the rent. A B. railroad, was seized with cramps this morning while at work. Pennington, who wui an em ploye of the Northern Central Railroad Company, had bought a round trip ticket from Baltimore to Pcrryinan«vtllc, limited as to tlm«, and was on his return tho day after the limit had expired. The conductor refused to accept the ticket, and Penning ton had to purchase another. No violence or Ill-usage was alleged, and on the ques tion of law Involved J udge Fisher Instructed the Jury that Pennington wu not entitled to travel on the ticket after the expiration ol the time limited on It, and was therefore not entitled to damage.
