Wesley Welding and I lie ease w aa stated to the Jury by Benj. Melde, Esq.. He stated that Mr. Thorne as an architect and builder had done work for Mr. Weldin, lumber merchant, aud the suit was for 8140 with Interest Irom Not. 4, 1879. ln 1K79 Mr. Thorne went to see Mr. Wel din al»ut eettlug some lumber for a house ho wae building. Mr. Weldin then stated that lie waa about 'to build a house and wanted plaintiff to pre)wre ul plaintiff sgraedaml said that If he got the contract for building tbe house ho would charge nothing for tho plans, but the de fendant said he would pay for the plans. Witness, therefore, went to work and pre pared plans for a residence willed were ac cepted, after a few alterationa. The house was built, but the defendant had received payment for his plaus aud speellieatinns. Edwin W. Thorne, on being sworn, said that early iu April, 1873, being about to build a house lor l'nncoust Allen lie went went to see Mr. Weldin about getting more lumber ; Weldin said lie was going to build, but wanted tbe matter kept quiet, as he would be overrun by builders 11 his inten tions were known ; told Weldin he would charge nothing for architectural scry ices he got the job of building ; Weldin said he was willing If witness did not do the build riglit for llie arciii N ? The original drawings for the house, with the exception of the elevations, were pre sented aud explained by the witness and offered in evi 'euce. Ou cross-examination by Lore the wit ness stated that, at tho instance of Mr. Weldin, he visited the cellar of the house aud saw that the foundation walls were all right ; he hud seen E. L. Rice and upon them build the bouse; Rice's plan» were Identical almost with those of Thome'»; a number of carpenter's made l»ids and the contract was given to Strickland A: A rebel ,who were the highest ladders; witness had understood distinctly from Mr. Wilden that he preferred Thorne to do the work, but would have to ask for M is to give other carpenters a show; wituc the |t»u0 during the winter. The witness style of the building plans, and stated that .Mr. Wcldiu had given the measurements to Mr. Rice. A close examination then took place the difference between the house as it now stand* and the plans made by Thorne, which the latter stated was slight in some respects. At 1 o'clock Court adjourned.
