STATE FAIR RACES. Entries to Some of the Early-Closing . Events. i Others to Closo on the 26th—All the Purses and Stake Events Are Well Filled. At yesterday's session of tbe State Board of Agriculture the entries for such of the races as closed on the Ist of this month were canvassed* and announced. Some are pacing, others trotting, and others still running events. (ni the -10th of this month all the other trotting and juicing entries will close, and at tbat time tbe remainder of the running programme will be made public. Two horses attached to a heavy truck took fright iv the alley back of Wein stock, Lubiu ,t Co's buihliug about 0 o'clock last evening and dashed out to ward Fifth street iv a breakneck gait. Reaching Filth, they turned south so dy as to neariy upset the truck. As it was the heavy wagon was thrown violently against the trees and curbing on the east side of the street damaging it somewhat. The young man who had been driving the truck chased the runa ways down to the corner of Fifth and M streets when lie succeeded in slouping them. -— — The Cavnuaturhs Sued. Rlaneolonl and Perlnl Found Guilty and Tbeir Notorious Dance Hall "Will be Closed. Louis Biancoloni and J. Perini were tried on Wednesday lor selling liquor at tbeir dance-hall on Second street after tbeir license bad been revoked by the Board of Trustees for keeping ■ disor derly bouse. Their attorney claimed that tbo ordinance wiiich covered tbe matter of revocation was void, as a license was property and could not be taken from them without their being beard. It being au important point Judge litickley took it under advisement until yesterday morning, when bo rendered his decision. It is a subject of congratu lation to tbe community that bis decision sustains tbe ordinance au.l give., the city relief when such places become too bad. Tbo follow ing is .!rin.i: BUCKLEY'S DECISION: Defendants are accused of having vio lated l Iniinance No. 27, by opening a sa loon in this city and selling Certain liquors therein witliout having a license so to do as provided in said ordinance. The court finds the following facta: 'ihat in .July of tiiis year the city Is sued to defendants a license to conduct said saloon, which license was to run un til i iciolier Ist. That on tbe 'list day of July the Hoard of Trustees, without notice to said de fendants an.l against their wishes or knowledge, revoked said license and or dered repaid lo them such proportion of the sum paid for said license as the un expired term bore to the euliro quarter. That on < 'ctober Ist, and alter such re vocation, defendants continued to con duct sai.l saloon witliout further license, i That said ordinance was passed June 22, l.S'.il; that tbe board ordained tbat it should take effect from and alter .lune 3D, USi, and tbat it was published ou ten days alter iis passage. Defendants contend: First, that said ordinance is invalid by reason ot insuili cient publication; and, secondly, that it is unconstitutional, in that it seeks to ! deprive defendants of property without due process of law. As to the lirst question, assuming that the ordinance was published the require.t number of times, it would take etlect by operatiou of law, notwithstanding auy contrary direction oftho Hoard of Trus tees. Their direction may be treated as a superfluity. Tbe charter, among other things, em powers the board to lix and collect a license tax on all saloons, to license, tax, regulate, prohibit or suppress all saloons and like places. In pursuance of this, and its police power, the city passed the ordinance iv question, providing forthe regulation o! saloons, and in Section <; thereof, or dained as follows: "Nothing in this ordi nance shall be construed as preventing the Bourd of Trustees from revoking a license at any time, and without such complaint being tiled, ou causing to be repaid to the party to whom such license was issued, such a proportion of tho sum paid by him therefor as tiie un expired term bears to an entire quarter/ .'. license authorizing a person to retail I spirituous liquors does IKK create a con- I tract between him ana tiie Government.
