A Morning Matinee.
Just after police court adjourned this
morning it so happened that n largo
party of city hall waga were present nnd
they indulged in n good many rematka
legarding the mayor aud oouncilmcn
who aro under indictment for mal
feasance iu office. -Most of tho '-accused"
were present and enjoyed tho fun cs
well as tho outsiders. Ex-Alderman
Parker wanted a cell large enough to
turn around in, but did not wish to bo
placed nearer than fonrctlls from Coun
cilman Etchells. Alderman Levin was
not particular oa regards companion
ship, but preferred to bewhero he cocld
"dee out." The Mayor had no choice
but ho proposed to make it warm for
some parties "in the sweet bye and
bye." Ex-Councilman Aguirre had
only returned from the Qnijotoaa and
was not posted on the situation ot
e Hairs, but it he was to bo confined ho
nief erred to be confined m one of tho
Tucsou nnd Quijotoa stago coaches he
wanted to see the country. Councilman
Etchelld thought it would be "nrettv
slici" to get in n place where ho could
enjoy some relict from daily toil, but ho
would insist ou tho privilege of going to
church Sunday morning.
ltecorder Meyer said in case the
prisoners" were confined in the city
"yug" he would give them their places
in the ranks oi tho mesrpiito brigade.
He would tint Leviu and Parker to
gether, and then p'lir off Mayor Strati
and Agnirre. Councilman Etrhells
would bo placed iu a squad by himself
.-mil would be accorded tho diguity of
conductor of a wheelbarrow.
All parties enjoyed tho jesta, but the
reporter was requested to say nothing

Tho cases of Mayor Strauss and coun-
ciiinen Etehella and Levin and ox-coun-cilmen
Parker and Agnirro came up in
tho district conrt this morning and the
entire forenoon was spent in the argu
ment ot a motion presented by Judge
Hereford, one ot tbe counsel for the last
four named to quash tbe iudictment
Tho Judge introduced a number
ot authorities nnd occupied about an
hour. He was followed by City Attor
ney Franklin counsel forMayorbtrausp,
who took the same ground that Judge
Uereford took, that is, that the act while
not particularly authorized by the
charter was not prohibited and that tbe
step was taken es n matter ot necessity
in order to comply with the provisions
ot tbe charter regarding tho duties ot
city officers. Mr. Franklin was followed
by Judge Campbell ou tho part ot the
prosecution after which Mr. Lovell, of
c tinsel for tbefntr councilmen made an
addrerH. N twithatandiug all this
eloquence Judge Fitzgerald overruled
the demurrer to tho lmlictinent and
tent for District Attorney Campbell,
who had been called to the grand jury

the motion t qunh. Ho added that
the gentlemen charged with the offense
of niolfeusiuce in this case were public
official nnd gentlemen ot high stauding
and it was incumbent upon all concerned
to give theoi as speedy a trial as pos
sible. Mayor Straues arose and stated
thnt he wua ready for trial and thought
hooudit to have it. Jndgc Hereford
etnted that his clients were ready and
demauded a trial. District Attorney
Campbell eaid that thn grand jury had
inft rmed him that they would reqnire
ercrv moment of bis timo and that it
would be impossible for him to take up
tho cases at once. He wanted the cases
cut off until Saturday afternoon but
tho attorneys for the defense insisted
that the cayes bo taken up Saturday
morning, and tho Judge stated that they
would be the first cases called on Satur
There seems to bo a disposition to try
the cases by jury and tbe probability is
that such a trial will bo bad, thoii-th
some lawyers express the opinion that
they are not properly jury cases, it is
the intention to take up the case ot one
ot the accused nnd make it a test ca-o
