CHICAGO, July 21.—The United
States railroad labor board has the
power not only to set wage and work
ing rule conditions on railroads, but
to make decisions on cases dealing
Indirectly with these questions, ac
cording to a decision of the Circuit
Court of Appeals here late Thursday.
This decision will have an impor
tant bearing on the present railroad
strike as the original dispute involved
the forming of a “company union"
by the Pennsylvania Railroad, which
refused to meet union offiicials of the
federated shop crafts. The Pennsyl
vania road insisted it had the right,
to deal with Its own employes and
sought by injunction to restrain the
labor board from criticising its ac
tion.
The decision is not only a victory
for the labor board, but is held to be
an important victory for the unions.
The Pennsylvania Railroad has re
cently announced it has come to a
wage agreement with its shop em
ployes. This agreement is invalidated
because the labor board found the
road was dealing with representatives
of less than 15 per cent of its em
ployes and had not considered the
sentiments of the other 85 per cent.

Guards at the Dearth mine, Fayette
County, owned by the H. C. Frick
Coke Company, opened fire on miners
as they attempted to set fire to the
tipple today.
Investigation showed that an at
tempt had been made to dynamite the
mins.

June Report Shows Gain of 30 Per
Cent Over May.
Building contracts awarded during
June In Indiana amounted to $12,-
845,700, according to the F. W. Dodge
Company, who issue construction re
ports. This was an increase of 30
per cent over May and of 14 pef cent
over June, 1921.
