DEC. 20, 1929. FILE SUIT TO OUST ‘MAYOR’ ' OF UNHURST Five Town Board Members Ask Removal Mandate in Land Fight. Land annexation fight in Lyn hurst, town corporation southwest of Indianapolis, was carried Into a Marion county court today with the filing of a mandate suit by five town board members to force the removal of Ernest E. Kellogg, board chair man and town “mayor.” The action, filed in superior court four by plaintiffs Don Branigin Rowlin McMillan, Claude Wil : iam- Bon. James H. McGnire and William R Harding, demands that Kellogg lx- ordered to inform his associates of the time and place of trustees' meetings and explain his official u ts. Seek Meeting It is understood the trustees hope to hold a meeting through the court order, at which time Kellogg will be Ousted as president, and another member appoitned. Charges are made that Kellogg procured annexation of 2,000 acres of land to the community "wholly without regard for the interests, de sires or welfare of the people.” Kellogg's appeal from two fines Os SIOO and costs for drawing deadly Weapons and carrying concealed Weapons is ppnding. Dampness of the air has caused corn already placed in cribs to be come moldy and rotten, farmers report, and serious loss is expected. Corn prices, it is predicted, will rise considerably higher as a result of damage to the two years’ crop. THE INDIAN APOT IS TIMER Corn still in the fields Is in better condition than that harvested, it is reported, but even this has been threatened. In many instances, farmers say, the ungathered crop is sappy and unfit for seed purposes. Chile is more than 2,600 miles long, while its breadth nowhere ex ceeds 250 miles.
