NEW ORLEANS: ••• MONDAY MOI(;\l.\G. hLPTKMllLIl 2, INS«. Sudden Change. —On Saturday night the weather suddenly underwent a change. It was one of the old New Orleans changes. Any one would have irnngined himself in latitude 43, a* he went forth into the piercing air, and buttoned him sell up, a fa mid-winter. It was a trying night for sickly and weak constitutions. It was a severe transition from Summer to Antumn, and those who were in a sanitary point, in trnnsitu, were very apt to be affected, so tlfat before the moon ran out, they would " fall as the leaves fall." Hearttnan was brught up again on Saturday morning, charged by lb« 1 lirm ol Druherty be Co., Makers, for having sold bread which they had entrusted him to sell on their account ai.d appropiiatcd the proceeds. It appeared in evidence that nan had never been employed by Druherty Co., but that this was a plain business transac lion—ileartmaii receiving bread fruin Dliberty iSc Co. at the rate ol «o many loaves for the dollar and making what profit he could in the Poyd-as street Market,on the transaction. Ii. U. Gaiennie, Esq , contended that the breach of trust law was one of the harshest ever passed; that the present was a claim for debt which, if good, ought to be prose cuted in a civil suit. From this he branched out into a variety of subjects, and wound up with a lament over the scarcity of soft-shelled crabs this season. This was an attempt to scare his poor little client, and he hoped his honor would discharge him. The Court held that an important feature in a charge of breach of tru.it was to show intention to delraud. There was nothing of this here. Heartman was discharged. Larceny Charged — George W. Westbrook, charged with stealing $13 GO from I). W. Monroe, a carpenter, from his room in the house No. 17G Carondelet street, appeared on Saturday. A host of witnesses for the State, (of whom Monroe was the first,) were examined. The money was stolen at night by some one, when Monroe had gone out on an alarm of fire. Mr. Coleman, for the defence, led no evidence, and simply moved for the dismis sal of the affidavit. The Court said that it would withhold its opinion, until another case between same parties should have been heard. Another Charge of Larceny. —A man named Drew, recently from St. Louis, now brought West brook to the stand on the charge of the former against the latter, for having stolen a gold pencil case out of his pocket. The pencil was stolen on Saturday, 24th ult., and had been oilered to a prin ter in town on Monday morning for SO. The prin ter had use for his money, and would not buy it, although he believed that Westbrook was offering it at a sacrifice. The same pencil was again offered to a pawn-broker on Tuesday, and three dollars given on it. Westbrook was not the man w ho offered it, although »he lad who took ; t there wanted an advance on it in Westbrook's name His case appeared to the Court a very fit ot e for committal. He sent both this and the preceding one to the Criminal Court. Witness has gone to prison. Striding Steahibo'it Cru,tes. —Thos. Powers was charged by Jas. Carter with having stolen four steamboat cranes irom his store on Front Levee. The de endant shewed that instead of being a cul prit, he was a public spirited citizen, and having found the cranes in a suspicious place, put them in storage in some other (rather suspicious) place un til the owner might be found. The Court ap plauded Powers' public spirit and exertions in the cause of honesty and forthwith discharged him. ÜECOUDhR Oe.V o IS C ourt — Dtsorrtrrly Iloiise and In* tdting a White Person. — It appeared on an examination on Saturday, that Pierre Coriolan (what a monstrous combination is intended in this name—St. Pierre and Corioianus !), who lives on Villeré street, between St. Philip and Main streets, reits a room in his premises to Jenny Gobet, free woman ol color ; that this Jenny haring no respect for the great tcmperance movement of the age, is in the habit ("oh, monstrous, dolel j! thing 1 ? ) of "drinking her brandy and water daily," and of keeping suspicious characters about her, raising occasionally all sizes of breezes and disturbing the whole neighborhood ; all in violation of an ordi nance to piovide for public decency. Specialry it was proved against Jenny that St. Pierre Corio ianus being in his yard on the morning of Thurs day, 28th ult., he was served with an artillery of abuse by Jenny, who called him r, seal, etc. Jen ny's conduct being proved against her, the Recor der sent her humanely to find another chance to exculpate herself before the Judge of the First District Court. Jenny, like a great many of her class, was not without, at least, our friend, and, im mediately, she as principal and Wm. L. Collins, a freeholder of the city, as surety, entered into bonds for $500 each. Coroners Inquest. —On Saturdaaan invuest was held on the bodvyf a white man, name unknown, said to be a Frenchman, found floating in the Bayou St. John, at the I/ike end, <>n the Third Municipality side. He had a white shirr, black Alpaca or Bombazine cuai, and a p-tir of blue striped cottnnade t.ants—*andy hair and whiskers. Verdict—Found drowned. Storm —On Friday and Saturday, the 23.1 and 24th, there was a violent storm, which did more or less damage to l he growing crops, and other prop erty, froru Montgomery, Ala., to as far Ea^t as Charleston. In some places it was very destruct ive, especially in some of the Districts |of South Carolina, and along the Central Rail Road in Georgia. Lady Elgin and suite arrived in Albany on the 19th, and took rooms at Congress Hall. The Lord Bishop of Jamaica is at the same house. Dr. Joseph liartshorne, long known as one of the first physicians of Philadelphia, died, on the 20th, at the Hrmdywine Springs, in his 71st year. refit. —Patrick McCormick, one of the bur glars who aided to hill some ol the Albany police officers, was arrested in New York on the 20th Settlement of the Hay tien and- Domini 'arfare. — !>y an arrival at, New York, the Herald of the 21st learns from th* ])>ariu dt la Marina that the treaty with tiie Republic of Dominica liai been ratified with the British Government. A note, by Lord Pnlrnerston, accepts mediation proposed for the termination of the war with the inhabitants of Hayti. The representatives of Frence, England and the United States, having been engaged s arrangements, all prospects of disturbances t an end, particularly as there has been mal protestation on their part against any of the Dominican territory by the Haytien: From lfai/li, Aug 3d. —The N. Y Courier and Enquirer lrarna from Cnpt. Hancock, of the brig Moselle, that the Emperor, Solouque, had not yet left his intended expedition to the Spanish part of the Island, but isstil! making preparations todo « but the time when he will commence his march uncertain. _ Railroad Accident. — We learn from the last aeon (Ga.) Journal &£ Meesenger, that a train of cars, with over three hundred p; Atlanta, a few days since, and when within a few miles of Oglethorpe, it detached a bar of iron, or " snake head," from the track, which passed through the cars, throwing two or three of them off the track, and killing or mortally wounding three persons, besides seriously injuring some five or siz others. Another. —An accident occurred on the Vicks burg and Jackson railroad on the morning of the 24th ult., about half-way between Clinton and Bolton's depot, by which the engineer, Mr. Evans, had his leg below the knee so shattered that am putation became necessary. 1 cry Decided. —A few days since a paper, pub lished in Macon, Ga., called "The Citizen," pub lished a letter from a correspond-nt in which it was recommended that II. B. Rhett, of South Caro lina, should be greeted with the hospitalities of Macon in the shape of a "coat of tar and feathers." 1 hereupon about two hundred persons assembled, and alter hearing sundry speeches, appointed committee ol thirteen to wait upon Dr. Andrews, the editor of the Citizen, and inform him that he must not issue another number of his paper Macon, and that he must give up the name of the author of the " Gabriel" letter, and that should he refuse to comply w^h these demands, that theciti zens of Macon would adopt such measures as t< compel his pre cipitate departure. Fugitive Slave bill was talien up and discussed, Mr. Pratt s amendments, providing for the pay Mr. Foote, Mr Atchison and Mr. Pratt. Mr. Pratt argued that Ibe lax* of 1793 had proved i The plan he proposed was to do justice to the South and remove an element of dis cord. He considered the United States respon ible for the execution of the constitutional pro Mr. Dayton denied that the Government was bound to do more than to endeavor, in good faith, to execute the provisions of the Constitution. Mr. Mason said the people of Maryland, Vir ginia and Kentucky would take means of redress unless the General Government would execute the clau-e of the Constitution for the delivery of fugi tive slaves. They were entitled to an effectual remedy. They were entitled to indemnity for the loss of their slaves. If one remedy would not do, another must be tried, and indemnity must be secured, if all remedies failed. Mr. Mason argued the point at length. Mr. Berrien could not give his support to the proposition. He did not think that the U. S. Gov ernment could be made responsible for the loss of slaves. The case was different from those arising under treaties with foreign powers. Messrs. Mason and Pratt replied, and before the question was taken the Senate adjourned. In the House , on motion of Mr. Thompson, of Pennsylvania, the Speaker was authorized to ap point a committee of conference on the disagreeing votes of the two Houses on the bill of the Senate to extend the time of taking the seventh census, and to increase the pay of the marshals. On motion of Mr. Gott, the rules were sus pended, and the House resolved itself into Com mittee of the Whole, Mr. Burt in the chair, and resumed the consideration of the Civil and Diplo matic Bill. The principal subject of discussion was the for amendments Mr. Mcl. priât ion unless Mr. McClernand moved an appropriation of S150(k,for a Secretary of Legation to Turkey. After explanation by Mr. McC., the Chairman of Foreign Affars, it was agreed to. Mr. Bayly moved an appropriation for outfits for Charges d'Alfaires to Portugal, New Granada, Guatemda and Ecuador, the sum of $18,000. McClernand moved to amend the above by adding $3000 for salary at d outfit of a Charge d'Affaires to Nicaragua. After some discussion, in which Messrs. Mc Clernand, Carier, Slanton, of Tennessee, Thad. Stevens, McLane, of Maryland, participated, these adopted. 'as opposed to making an appro actual recall had taken place, or actual vacancy in the missions. In of the amendment of Mr. Bayly, a mere intimation had been given that these missions would become vacant. He did not believe it proper >r the House to yield to intimations merely, but > provide for facts. Mr. Marsball, of Kentucky, submitted an amend ment appropriating $50,000 to be expended under the supervis' ri of the Secretary of the Treasury, lor the relief and protection of mariners on the Western waters. Tins was adopted—yeas GG, nays 61. Mr. Bayly moved a similar amendment for the benefit of the seamen on the Atlantic coast. It is voted down. Mr. Brown, of Missisippi, under instructions from the Committee on the District of Columbia, submitted amendments appropriating S3000 for he mprovements of New Jersey Avenue North, and §>2000 for its improvement north of the Capitol. The question was put on the amendment, and it was rejected. Amendments for custom-houses were adopted as follows: Bv Mr. Dinsv, $50.000 fora custom house I post « ffîce at Cincit nati. By Mr. Bowl n. $50,000 for the same pur.>o es at St. Louis, Mo By Mr Bayly, for the same purpose at Mobile, Ala.. $50,000. By Mr. Bayly, for the same purpose, at Bath, Me., $25,000. Mr. Potter moved an amendment of $90,000 for building a post office in Baltimore city, in which also, was tc be accommodated the U. S. Courts He urged it as a matter of economy, maintaining that if there was an appropriate building for thi purposes of the. post office, clerk hire and other labor might he saved there. Mr. Thompson, ofPenn., moved to reduce the amount of appropriation to $25,000. He spoke ol the absolute necessity of an appropriation for pni ting up a building in which to accommodate the U. S Courts. There was not the same necessity even for the post office, as there was for the courts. Hi had examined into the miserable accommodation afforded to the I 7 . S. Court in the room in which they hold their sesoions. Ile hoped the appropria tion would be made. The amendment was rejected. Numerous other unimportant amendments were proposed and rejected. Mr. Thurston moved an amendment of $25,000 for the continu uion of the survey of the western coast of the United States under the superintend ence of the coast survey. This led to a long du cushion about the expense < f the coast, purvey, and on the propriety of the army and navy attending lo such duty. Messrs. II dnies, Bayly, McLane, of Maryland, Biker, Star.ton, of Tennessee, Grinnell, Morse, Coulter, and Thompson, of Mississippi, participated in the debate. Mr. Me Lane supported the appropriation for the coast survey. Pending the further discussion on this amend ment, the committee rose; when Mr. Eliot, of B s;on, the member elect in th> ■ich Mr Winthrop vacated, appeared and i appro qualified.
