Tho crowd was composed of negroes and Porto Rlcans. New DISBARMENT CASES BEGUN ANDItHWS INTRODUCES RECORDS IN' UVIDKNCH AND MAGOON TAKES THE STAND. The Sumner disbarment case 'trial ' was begun yesterday afternoon In the Supreme court, after the reading ot the charges and the answers of respondents Attorney General Andrews began by Introducing in evidence the records of the various Sumner cases, showing np pearances of attorneys therein. There wns an objection, resulting In a ma jority ruling of the Justices, to putting In the transcript of testimony In the last case tried before De Bolt. Humph reys and Thompson objected on the ground that the transcript was not proper except to prove 'their appear ances In the case, and they admitted the appearances. Chief Justice Frear announced that a mnjorlty of the court allowed the evidence to go In, the dis senting Justice being apparently Gal bralth. J. Alfred Magoon was called as the first witness. He stated that before Humphreys left the bench he hod told Magoon that he was likely to be called Into the Sumner case, and Magoon had stated that he didn't see any harm in accepting such a call, in view of the early retirement of Humphreys from the bench, already announced. Ma goon told how he had been called to assist George A. Davis In the guardian ship suit, and said that Thompson as sisted High ton for Sumner, as he sup posed, in that case. Magoon said that Humphreys during the last case, of fered to settle for $30,000 more, for the Elllses, and told Magoon that out of such a settlement Magoon might charge Sumner. 13,000 and Humphreys might charge the Elllses $3,000. as fees. Magoon also said that Humphreys told him that Sumner would accept the settlement if Magoon advised it and told Magoon that all that mattered was the fees. Indirectly, after objections had been sustained to his conversations with Sumner, Magoon told of submitting the proposition to Sumner, saying he had ngreed to do so, and said that Sum ner had finally agreed to pay $12,000. He went to Humphreys' ofllce to make a proposition, but before he had time to make it Humphreys said that It was useless, as he would not take $29,999, 99 and demanded $30,000. Mngoon said that he had come to terms with Thompson on a basis of $12,000 for the Elllses, and the type writing of the agreement had begun, when Thompson went to consult Hum phreys, who demanded $1,000 as a fee. This ended the negotiations, Magoon refusing, and the case was therefore tried, Magoon said that Humphreys told him he expected to win In the cir cuit court and would appeal If he didn't. On cross examination by Humphreys Magoon said that he had not regarded Humphreys' proposition to him as dis honorable and when asked when he came to .so regard It said "I have not said that I regard it so now." PITTSBURG, Penn., June 29. An elevator fell today in one of the large buildings of the Heinz pickle words at a time when many of the employees were leaving the building. The current number of the San Fran cisco Dramatic Review says: A combination of two clever people, and two popular ones, too, has been ef fected this week, that will have quite a heming on the theatrical situation of .the west. Tom Bates, the agent, nnd Al Wntson, the comedian, have organ ized tho Bates and Watson Company and will open their season within the next month. Everybody out west knows Tom Bates.
