cit distilling, was brought before U.
S. Commissioner Hatch this morning
and waived examination. She was
held for tho October term of court.

Rev. Leopold Kroll, lately of Hoo
sick Falls, N. Y., arrived with bis
wife and threo children by the Mon
golia on Monday. Ho comes at tho
request of Bishop Restarlck to take
charge of tho work of the church at
Lahalna. Ho will succeed the Rev.
A. B. Weymouth in chargo of Holy
Innocents. Mr. Kroll Is an Elk, and
an exceedingly pleasant man.
In the equity suit for partition of

this morning Judge Lindsay refused
to assume jurisdiction, tho defendant
claiming title. An ejectment suit
must bo brought to decide tho mat
ter. Tho involuntary bankruptcy case
against tho Kauai Wine and Liquor
Company was finished yestorday at
tornoon in tho Federal Court, tho
Jury bringing in a vordlct for tho
respondents. In the first ballot tho
vote was eight to four in favor of
tho petitioners, but finally switched
around till tho respondents carried
the day. Tho verdict camo as a great
surprise. It is understood that suits
will buy a fine home.

The majority of yachtsmen in town
seem to have a very optlsmlstlc view
of .tho race, all seeming to think
that there will bo enough boats to
assure a race when tho entries close
on Friday of next week. '

That the evening paper is the best ad
vertising medium, which carries into
most homes tho announcements ot mer
chants, is the conviction of Mr. J. W.
Eccleston of Los Angele. Mr. Eccles
ton Is the advertising manager of the
Broadway Department Store of Los An
geles, and probably the highest salaried
man in his line on the Pacific Coast.
He Is on a visit to this city.
The success of the house which he
represents is ono of the most remark
able In business venture in the country.
Nino years ago its owner, Arthur Letts,
arrived in Los Angeles with a small
capital and bought the bankrupt stock
of a retail merchant, and began his
business career in a most limited way.
By clever advertising he has built up
an enterprise which is now doing a
business of several million dollars an
nually and is constantly increasing.
To use the words of Mr. Eccleston,
the business of the Broadway Depart
ment Store is due to advertising, and
the house is tho child of advertising.
As one of the illustrations given by
him of what can bo accomplished by
advertising, he said that in one day
last July his houso sold 17,000 pairs of
shoes advertised at ?1 a pair. To do
this it took 115 clerks as hard as they
could work from morning till night.

SHARPLY CONTESTED CRIMINAL
TRIAL ON TODAY IN THE UNIT
ED STATES COURT.
There is quite a light going on today
In the Federal Court In tho case of the
United States against Ah Wan for
illicit distilling. Judge Kaulukou, who
is representing the defendant", Is put
ting up a hard fight for his client., it
appears that Ah Wan was arrested at
tho same time as Ah Sal, who has al
ready been convicted of the same of
fence and who takes all the blame. Ah
Sal says that he owned and operated
the still and that Ah Wan had nothing
to do with the case. As the defendant
is an old man and the defence Is mak
ing so good a. fight it looks as If Judge
Kaulukou might get his client on.
A double interpretation is needed in
the case as Judge Kaulukou is talking
in Hawaiian to Chinese witnesses while
tho jury is composed of men who do
not understand Hawaiian.

"The majority of advertisers In San I
Francisco," he said this morning, "are
overlooking their opportunity." lnas
much as I believe tney are overlooking
the evening paper as an advertising
medium.
"I have heard complaints among ad
vertisers here that the morning papers
have a large part of their circulation
outside the city. I never heard that
of the ovening paper. If such is the
case, then in my opinion they are over
looking the evening paper, because
these very same men admit and agree
that the ovening paper does not cir
culate outside the city In such a mark
ed degree.
"In my line I am making a huge suc
cess of advertising. Tho business I re
present is purely and sololy a child of
advertising, and I contend It is not on
account of conditions, but tho Ijact ot
our success is our whole business res
ponds to advertising; and in my opi
nion the San 'Francisco merchant pays
too little attention to his advertising.
What I mean by that is, these people
who complain of conditions and do not
sepk a remedy for them.
"There is no difference in human na
ture In San Francisco and Los Angeles.
Thero aro tho same people to work on,
and the same results are obtainable.
Human nature is the same the world
over. Wo are all looking for some
thing for nothing. It is within the
power of any largo department store
to obtain merchandise within the mar
ket value, and after obtaining this
merchandise, if tho merchant can ac
quaint the public of the fact that ho is
disposing ot the same at a lower price
thari his competitors, in my opinion
thero is no reasonVwhy ho should not
obtain results.
"If, as numerous advertlsors in San
Francisco claim, tho morning paper cir
culated In foreign fields, then I should
solve the problem by using greater
space In tho evening paper, but being
n stranger in the field I am no author
ity. It is simply an opinion I quoto,
and not a fact; ,but the pplnlon is based
on the statements ot the advertisers.

In the afternoon, and It stays there.

reading it and seeing the advertise
ments, and finding what Is advertised
