what sort of immigrants have been freely admitted at. New York, the
exclusion of all Chinese on this side of the continent has. been incon
sistent. The trend of national discussion indicates some. immigration,
laws that will exclude other undesirables than undesirable Chinese and
at the same time admit desirable orientals. The American Chinese ex
clusion law is barbarous1 in some of its features, nnd cannot last. Neith
er can the country milch longer endure the constant strcaui of popula
tion from the slums of Europe. The whole subject is one' that'Calls'

FERN IS TO BE MAYOR.
Joseph J. Fern is to be Mayor of Honolulu. The issue was settled
in the Supreme Court this morning, and there is no longer any ques
tion as to who shall be the chief executive officer of the new muni
cipality of Honolulu. Mr. Fern docs not bring to the office the busi
ness experience and training usually regarded as necessary for such an
official. But he has a good reputation personally, both for intelligence
and for personal honorablcness, and as the chosen mayor, he should
have the support of the community in all efforts to steer the public
corporation rightly. The Star will be found his supportc !- -i- '
makes for the good of the community and will never be found his cr.tic
for merely partisan reasons.

Some may say that our observant correspondent, Mr Osborne,
uses candor of a kind to "hurt the town" in bis revelation of the pain-,
ful disgust of visitors at the mosquito nuisance. Yet the hurt he may
administer in that way is akin to wfiat the doctor or Tlcnt.st infl.e s
which is expected to be followed by. the surcease of a constant agony
unbearable. It is well to hurt the town and particularly to make its
self-sufficient compaisancy toward nuisances both fierce and foul,
under the delusion of dwelling in a finished paradise which certain
undisputed conditions of pleasantness create, give way to keen smart
ing from the probe of truth regarding both positive and negative con
ditions of discomfort which arc patent to every unhypnotised observer.

the motto of all promotion endcavorers. Honolulu will never be a
really and truly Mecca of tourists and home-seekers of opulence until
the mandate of that motto shall have been executed. All well and good,
if the Federal authorities do it, so they do it quickly. They will doubt

courts here, the Lanai land deal lias been decided on points which do
not settle the real merits of the controversy. It would seem that in
such a case the government should have tried to get an interpretation
of the law. But it didn't. It has now got a ruling to the effect that
McCandless was not legally qualified to bring a suit. and the ques
tion McCandless raised, as to whether the Lanai deal was legal or not.

"The obvious course to pursue is to place the matter of Cbi-
nese immigration where it essentially belongs, namely, within
the operation of the system of regulation applicable to im
migration generally; in other words, to let the methods and
the machinery provided with respect to the admission and ex
clusion of aliens generally be applied in the case of aliens from
China as well. Should this be done, among other results
which may confidently be expected are, in the first place; an
1 enormous gain in effectiveness of enforcement, particularly
with reference to the deportation of those who have secured
unlawful access to the country; second, a most decided gain in
economy of administration, and third, a marked improvement
in the relations between two friendly peoples as well as a
notable increase in commercial prestige.
"The great gain in efficiency of execution which would fol
low the adoption of the plan proposed will appear from a com
parison of the methods employed, respectively, in the deporta
tion of alien Chinese found unlawfully in the United States
and in the deportation of other aliens so. found.
"The process of arrest under the immigration act, whether
followed by deportation or discharge, is preferable to the
process used under the Chinese exclusion laws, from the point
of view both of the government and of the alien, by reason of
the expedition and the economy with which it is accomplished,
as well as of the certainty of its results. The period from the
daje ofuarrest until the case is finally disposed of is. ordinarily
only a matter of days, unless sickness or some other special
1 feature "supervenes.
"In regard to the Chinese aliens themselves, besides having ,
to endure indefinite delays, running into months and sometimes ,
' into years, coupled as often as not with confinement, before a
final decision is reached, under the present method, they and ,
their friends at times become the victims of extortion, prac
ticed by attorneys and others, who, by reason of the delays""'
they are able to interpose, to say nothing of more questionable" 1
devices, are in a position to win their confidence.
"The presence of such aliens (paupers, etc.) in the country '
is as undesirable, economically and socially, as that of pro
hibited Chinese; but the exclusion of the former is accom
plished under the general immigration laws very effectively
without causing either offense or embarrassment, whereas the
exclusion of the latter is a result achieved only imperfectly at
host, and is attended by no little unpleasantness. The invidious
distinctions, to use an apt phrase, now so apparent on com
paring the treatment of necessity meted out to Chinese with
the treatment accorded to aliens of other nationalities, in my
judgment, would not exist but for the fact that the subject
of Chinese immigration is distinguished from all other immi
gration by being dealt with in n separate code of laws, involv
