Our readers will remember that on or about the 7th of last July, Henry Lister filed a complaint before S. W. Humph reys, against Valentine Hopkins, charg ing the said Hopkins with outraging May Lester. A warrant was placed hi the hands of Wm. Burk, a deputy sheriff, who asked the complaining witness to accompany him to point out the party accused of the offense. It seems that both Lister and Deputy Sheriff Burk started, each armed with a revolver, and when they reached the point on Chestnut street, near Kidder's livery stable, Hop kins was seen crossing the street, when Burk commanded him to halt two or three times, after which Heury Lister shot at and wounded the said Hopkins, from the effect of which he (Hopkins) died on the 9th day of August. The-jnry remained locked up until Jtlonday morning, at "which iime they informed the Judge that there was no probability of their agreeing upon a verdict, when they weie discharged. Henry Lister entered into a bond of $500 for his appearace at tho next term of the District Court and was allowed to go on his way rejoicing.
