We received, a however, a number of the Browneville lag, of a the 17th inste The Galteston News contains the following Is queer paragraph: s' The San Antonio Ledger suggests that inar much as slaves are unsafe in our extreme west ern territory, the dismemberment of a Mexican State or two may be necessary to increase the , distance between our sister Republic, who prides herself in protecting fugitives, and our slave holding population. The Supreme Court commenced its session at Austin on the 8th instant. A letter from Jefferson, Cass county, informs 'us that the Galveston Railroad scheme is rapidly gaining favor with the people in that section. There has been a great deal of sickness among e the people, but it is now abating. Business, in the thriving town of Jefferson is brisk, and na vigation had opened earlier than usual this sasond. The Trinity river is in fine navigable order. The Advocate, published at Victoria, comes out in an entire new dress. Travelsted, who broke jail at Austin and left a facetious note behind him, has been arrested for mule stealing, and is in jail. The Brownsville Flag says that the pictures of misery on the banks of the Rio Grande are highly imaginative. It says that confidence has been restored and that business is prosperous. The Flag contains the following melancholy recital: Some four or five weeks since, two men, the one named Mick Oberly, the other William Gra ham, being upon a burst in Rio Grande City, became very violent and indecent in their be havior, riding and racing through the streets in a naked condition, and kicking up a row gen erally. The sheriff and Mr. Henry T. Smalley, the constable, made an effort to arrest them, I but they escaped at that time. About half an hour afterwarks the sheriff succeeded in cap turing Graham, whowas imprisoned; Mr. Smal ley endeavored to take Oberly, who was on horse back, but refused to surrender. The result was that Smalley fired at him with a six shooter, the ball passing between the bones of the left arm, probably fraoturinq them. He lost much blood, but in a few days was walking about with his arm in a sling, and had the use of his hand so far as to pursue his profession of gamb ling. About this time Smalley having heard that Oberly intended to assassinate him, met I him in the presence of several gentlemen and inquired as to his threats. Oberly at first re fused to talk upon the subject, on the ground that he was not in a condition to fight, but finally gave assurance that when he recovered he would give Smalley fair notice, and if he should determine to pursue the matter he would inform him of it-that he would take no ad vantage, and it should be a fair fight. To this Smalley agreed. Two or three weeks after Mr. Smalley was - taking his supper at an eating house, when Oberly entered with a double-barrel shot gun and firecd upon him. Smalley dodged under the table so that the load of buck shot lodged in the upper part of his thigh, shattering the bone. He put his hands upon the edge of the table and so raised and steadied himself. Oberly had re tired but he expected he would return to dispatch him. He drew his six-shooter and kept watch upon the two doors of the room uncertain at which he might enter. In a few moments he perceived the barrel of a gun poeking around through one of the doors; the partition was of canvass; he gave a guess where the body of the man ought to be and fred. The ball struck Oberly over theheart, but the side pocket of his waistcott was filled with dollars and so the shot did not take effect; Oberly then dropped his gun and escaped. It was hoped for some time that Mr. Smalley would recover, but he died on the 9th instant from the loss of blood. His relatives reside in the interior of this State, and in Indiana or Illinois. It will be consoling to them to know that he died for the discharge of his duty, and that a more conscientious officer or braver man never lived. It is known that Oberly after his escape went to Laredo. A credible rumor further says that he left that place in company with a Meicoan for San Juan, (San Antonio ?) and that he or aman coming fully up to his description, has beenfound with his throat out.
