It must be understood that the bill paeedaby the House and now before the Senate 'ildenti.ea with the bill passed by the Senate excepting the Clayton amendment, which ex oludes aliens from voting, but it is not the Senate bill. As soon as the House bill was fairly before the Senate, Mr. Pierce, of Md. moved to amend it by adding the Clayton pro vision. In all probability the Northern op ponents of the bill and the amendment, would here voted for the latter in order to send back the bill to the House, but, one after another, several Senators from the South, strong ad herents of the amendment in principle, have de elared their readiness to abandon the amend ment rather than risk the loss of the bill. Mr. Douglas has proclaimed his wish that the bill should be passed to-day or to-morrow, and the Senate trains under the little giant-the Southern Senators hold themselves bound to follow the dictates of one who tendered the boon in behalf of the North; but a debate has sprung up, incidentally, involving the consist. enoy of Mr. Bell, of Tenn. in separating from his southern whig friends. Mr. Toombs, of Ga. upbraided Mr. Bell in an offensive manner for his course, and Mr. B. replied. Mr. Badger, of N. Twopersons, named. I David Connor and Thomas Singer, were arrested J and identified by Furlong as'having partici pated in the affair. They were held to bail in the sum of $600 each, to appear for examination. BOARD OF ~.slSTIsrANALDEIM. N.-This Board held its regular meeting, last evening, Colonel 1 Campbell in the Chair, and 20 members pre- I sent. The minutes of the prepeding meeting were read and approved, and a message from the Mayor, informing the Board that an ordinance of the city made it the duty of the Council to make the annual appropriations to the Publio Schools, was read and referred to a special cmo mittee. A letter was read from C. A. Miltenberger, stating that, having experienced great delay in the approval of the contract which had been adjudicated to him for supplying the city with Pittsburgh coal, he declined complying with the conditions.of said contract, and desired that the. ,oney depted "by him as security be repaid, Xeferred to'Commi.ee on Claits. A petition was received from numerous pro perty-hdderaof the Fourth District, asking that the cemetery on Washington Avenue be closed up and further burials therein prohib ited. Laid on the table subject to call. J. B. Dolhonde, Commissioner of the House of Refuge, sent in his resignation, which was accepted. A petition from cab owners, asking the privi lege of stands on St. Charles street, was referred I to the Police Committee. A resolution from the Upper Board granting the use of Place d'Arms for an exhibition of fire-works on Sunday evening next, was con curred in. A resolution granting a portion of the levee at the head of Canal street for the accommoda tion of the new Custom-house, was referred to I the Committee on Streets and Landings. A resolution granting the use of Washington Square to L. P. Catoir for a fire-work exhibition, was concurred in. A resolution providing for the construction of three wharves for tow-boats, was referred to the Committee on Streets and Landings. On motion, the order of the day, an ordinance for the establishment of a Health Department for the city was taken up, The second section of this ordinance provides that the department shall consist of not less than three citizens of the city of New Orleans, who shall have been e residents of the city at least ten years, and one of whom shall be a practising physician, to be elected by the City Council in joint session. Section 16 provides for the appointment of a quarantine physician, whose duty it will be to visit every vessel arriving from sea at the quar antine station, and who shall receive a salary of $2000 per annum, and be provided with a suitable boat and two assistants. The last section provides that the salary of the President of the Department shall be $2500 per annum; of each of his two assistants, $2000; r and of the Secretary, $1200; the sum of $2000 is also provided for the current expenses, rent, e stationery, etc., of the first year. Me r. Robert moved that the ordinance be re ferred to a joint committee from both Boards lost. !. On motion the ordinance was then taken up , section by section, and with a few trifling i. amendments, was adopted. The Board then t adjourned. FIRST DISTRICT COURT-Judge ltobertson. Trial for .lfurder.-Francis Smith was tried before this court yesterday for the murder of his wife, on the 19th of February last, in a shanty at the corner of Common and Broad streets, far out towards the swamp. The evidence produced for the prosecution was essentially the same as that elicited on the preliminary examination before the committing magistrate. The testimony of the Coroner and attending physician established the fact of the death and the character of the injuries which produced it, the latter deposing that after she was brought to the Charity Hospital he ex amined her and found the whole of the back part and left side of her head smashed and the brain completely disorganized. The skull ap peared to have been broken by a blow from some blunt, heavy instrument. Sundry bruises and outs were also found about the body and both her arms were broken. Death had re sulted from the injuries about the head. Witness could not say whether prisoner was drunk at the time. George Tate also testified that when Smith was arreset ie looked upon the body of his wife and-aokno'ledged that he had inflicted the blows and that he was willing to be hanged for nt The counsel for the defense, Mr. Eyrehart, introduced two or three witnesses to show that the prisoner and deceased had lived amicably together previous to the commission of the murder. An attempt was also made to show that the prisoner was intoxicated at the time of the murder, but this had but little effect upon the minds of the jury. The case was submitted at about 10 o'clock, and after being out about five minutes the jury rendered a verdict of " Guilty." The prosecution was conducted by the Attorney-General. Breach of Trust.-Joseph Lefebre and Joseph Trotot, bakers, made affidavit in this court yes terday to the efect that one Hypolite Javet, who had been in their employ from the let to the 16th of May, had appropriated the proceeds of about $800 worth of bread and bread tickets. The Recorder decided that he-had no jurisdic tion over the case, and it was accordingly dis miseed. Intent to Kill,-Daniel Kane was arraigned on a charge of having knocked down and at tempted to kill Wm. K with a loaded whip. His examination wa.stponed to the 8d of June. Discharged.-Wm. Parmiel and Andrew Bal bot, charged with having entered Wm. 0. Brad ley's room at the City Hotel and stolen the sum of $400, were yesterday discharged, the evidence nPt being sufficient to warrant their commit ent for trial. Many persons were disposed to look upon them as suspicious characters in con sequence of a couple of outsiders having been found in their room at the time they were ar rested.
