FIRST DISTRICT COUBT--The Election Case e2lt c. Hufly.-The Indisposedjuror, Mr. Silk, appeared In Court yesterday morsing, and the trial was proceeded with. Anotherjuoorpleaddldisposition, bunt his plead ing was overruled. The matter of nnndrv hballots having been wrongly depodited in the boxns at thel Twelth, Twsenty.second and Twenty-thlrd Precincts, was thoroughly investigated, with no result material to the euean. The Seventh Pre cinct affair was next lnvsstlgated. Mr. Locke, the Democratio Commissloner at the BSe venth Precinct, testified that when the mob brohke in and cleaed off the thable, thes tickets had been counted and divided into three piles ; ose pile of clean American tick ets, one pile of clean Democratic tickets, and one pile of over eighty scratched tiokens. Not a name of any eandi date had been called off from either the clean American or clean Democratic tlcket--tba tickets alone. and not the names, bad been ctunted. Did not know, of his own knowledge. whether or not tbhe count, as reported, was correct. He was cot frightened by the entrance of the mob, although he considered his life in danger ; and after getting home, he made from his memory a memorandum of the number of the tickete counted, as reported by the clerks. Mesrsn. Mitchell end Ramy ,the elerks in question, were e.nmined, and their testimony corroborated that of Mr. )Locke. Mr. lorton, one of the American Commissioner,, was then examined. His testimony as to the counting and divislon of thb tickets, aesoroonteated that of Mr. Locke. He did not know whether the tickets had been correctly counted; he would have counted them himself, or seen them sounted, and thbe count compared with the elerke' t.lly lites, before making his retuarn as Commissioner. Col. Christy, the other American Commieionner, wan next eamlined. His testimony a tothe ountinog and division of the tickets wan about the same as that of the others. He stated that since the eletion he had eeen frandulent election tinkets. on which the name of one party wa printed over the names of esndidates of the other party; and as the tickets taken from the ballot-box were separated only by their respective heads of "Ameri can tickest" and "Democratic ticket,,' without any of the condidates' names being looked at or called off-the scratched tickets excepted- and an the tickets were counted off very rapidly. or "shelied out" like bank notes he could not nay that the count of the ticketi was any evidence of the number of votes uat for the respective eandidats. named on the tickets. Col. C. was asted by the pronsetion for his oinio. as to the mejority of Bell over Hatty by the tickets as counted. The defenoe objeoted to the witness giving an opinion. and ilinsted upon ais adhering strictly to facts. Judge Robertson overrnled the objeetion, and ordered the Colonel to give his opinion. The Colonel stated that he -aa not give anything better than a mere guess ; he should judge there were about 200 tickete more for Dell than for Huffty. The defoence then asked the Colonel if he had not freqoently, In his opinion, made mistakhes in his guesses as to the results of eniotines, etc. Judge Robertson here changed his taetics, and forbade the Colonel to express any opinion on the subject. This was a very noticeable fnature in the proceedings, upon which Mr. Hunt addressed the court in becoming terms. The examination of Col. Christy concluded yesterday's proceedings, and the court adjourned to ten o'scloc. his morning. SIXTH DISTRICT CoRT--The Theatrical In i,jontimi Cate.-Yesterday, Mr. Jamison. with his counsel, Aleu Walker. EFq., appeared in court. as notified, to show cansos why he should not be punished for conotemp., In not obeying the injunction which waes served upon him on Saturday last, at the inntance of Mr. Charles, managerof the Pelican Theater, forbidding him to Opear on the stage of the St. Charles Theater. Mr. Brewer appeared for Mr. Charles, and made an argument of some length to show that the injunction was a proper one. obedience to which should be peremptorily enforced. Mr. Walker was about to reply, when Judge Cotton stated that there was nothing before the court but a question of contempt, and he wanted that disposed of Mr. Jamlson. being sworn, stated that he threw up his engagement atL the Pelioan because he was not prolvided sith good tools to work with; that by continulng there he would have disgraced himself and done injustice to the public. In answer to the charge of contempt, in playing at the St. Charles on four nights alter recriving the in junction, he stated that the deputy-sheriff, in giving him the document on Saturday, told him that it would not interfere with him that night-he being up for Rolla. while the intjnctiou particularly forbade him appearing in Un cle Tom-in conseaquence of which he went ahead and enacted the part o Rolla. On Sunday and Monday nightl he porformed Uncle Tom because, In an interview he nad wlth Mr. Charles on Sunday, tbat gentleman inform him that be had nothing whatever to do with the iujunc tion, and that he might go ahead at the St. Charles with perfect freedom. Prom this, and the testimony of Mr. Valentine. who corroborated Mr. Jamison.it appeared that the injunction had been sued out by the owners or agents of the theater, who used Mr. Charles' name, as manager, while be had no actual interest in the matter-the pro ceeding being instigated by a fear that Mr. Jkminon'e withdrawal would lead to a nonperformance of that in tenesting little private dramaycliept Payling the IRent. In regard to playing on Tuesday night at the St. Charles, Mr. Jaminon stated that when he was summoneod before the court on Tuesday morning, and notified to ap pear again on Wednesday, he did not understand that he was up for cootempt ; supposed there was going to be a trial of the injunction on its merits; and as the Judge had expressed to him hi. doubts as to the legality of the in junction, and his counsel, for reasons which he believed to be valid, had advoed him to perform, he did no. not knowing that he was acting contemptuously in the least. Judge Cotton. after explaiing that an injunction muest be obeyed. whether It be considered legal or illegal, ex pressed himself satilsfied with Mr. Jnmison's explanation,. and dismlssed him from the charge of contempt, but gave him distinctly to nunderstand that he must not appear at the Sn. Charles again while the injunction existed Mr. Brewer objected strongly to Mr. Jaminon's dismissal. and ,.Iosd hloceof to be tn a rather awkward sitnation, be twesen the petition for the injunction, signed byJ. S. Charles, upon whose petition he was acting, and the posi tive testimony of the defenoe that Mr. Charles had per sonally given Mr. Jamison his full and free eonsent to go ahead at the St. Charles Theater, in spite of the iojunc tion. Judge Cotton postponed the trial of the injunction on its merits. Mr. Walker urged immediate action, on the ground that his clint was advertised to do Grandfatbher Whitehead at night, and that Unless tbh ionjuctio were dissolvred, it would be a loe to his client and to the man agnment of the lt. Charles Theater, as well as a diap politment to the public. The Judge thereupon consesnted to hear the case in the afternoon, and the parties later ested left. In the afternoon the parties re-assembled in court., and upon a full showing of the ease, Jndge Cotton decided that the injunction had been properly lened; but that as the period of the contract between Mr. Jamison and Mr. Charles had expirod, the injunction had also ex pired.
