Being "a distinguished stranger," I was of course one of this jolly crew. At 11 o'clock A. M. all the emlbntbsses, buggies, horaes and carts of the village were premed into service, and the beauties pressed into the aforesaid vehicles, i. e., the beauties of the fair sec as we traveled hot only with " les belles dea.lue' but also with carts crowded with various ,eeseatibles, good for the inner man, to which the most particular attention was paid by our friend the Colonel, who bad charge of the regiment ? The belles and beaux were out in their most attrautive charms, and the damage which the fair ones have made upon the hearts of several of our city chits I cannot es:i mpate; but one in particular, who found it impossible to wait Ifr this event, remains with us still, and I have no doubt his delicate health will induce him to lay over for some time. A pleasant day indeed have I enjoyed, and while many are traveling hundreds of miles to find mineral wates, in two or three hours travel from the city they can indulge in the .nest iron and sulphur springs in the world, without taking into consideration the Swholesome and balmy air of the pine woods. An ex-legislator, a boon companion and dine fellow, had promised me a visit to Bogue Chitto (whar the gale only war shoes wonce a week, on Sunday) of .which more anon. I propose'to r add to what has bees sad, a few remarks tending to d show that there can be no legal difficulty, as it has been pretended thbre might be, in holding a perfectly valid election without reference to the "Army Bill." a h etaof Louisanumakes our StatesGov ernment elective. It recognizes the right of the peo pie to vote for thefsaneverl officerf This right is in alienable and cantiot be taken awayby law. The pro vision in the Constitution in. regard to Sheriffs is an illustration of this. Art. 80 imperatively declares that "a Sheriff and a Coroner shall be elected in each parish by the qualified voters thereof, who shall hold their offie for the term of two years," etc. In furtherance of this and other constitutional pro visions, on the subject of popular suffrage, the Legis- t latere in 1855 passed a general statute "relative to elections." This statute provides the time of holding all general elections throughout the State, the mode of establishing election precincts, and of appointing Commissioner ; it defines their duties, fixes the mode O voting, of obtaining ballot-boxes, of counting votes, making returns of elections, and issuing proclama tions; and generally establishes all the machinery and minutedetalls necessary to carry into effect the constitutional provisions referred to. Under this statute the Godernor has already issued his proclama tion for the elections in November next ; and it is un der this statute that these elections can and must be held. The law makes the Sherif of each parish returning officer thereof in all elections, Acts of '55, section 28, and to secure the performance of his duty, it enacts : " That it shall be the duty of the returning officer in each parish to make out triplicate returns, to forward one of them immediately by mail to the Secretary of State, to forward another to the Secre taryof State by the next speedy mode of conveyance and to deposit the third in the office of the Clerk of the District Court, and in the City of New Orleans in the office of tse Clerk of the First District Court; and for his wilful failure or neglect herein, such re turning officer shall be fined in a sum not exceeding five hundred dollars, at the discretion of the Court." Acts of '55, page 412. It is evident then, from these provisions of law, that if, as has been sometimes in timated, and I hope without authority, Sheriff Bell should dare to refuse to do his duty as the returning officer in November, and should presume to set up his crude notions of the constitutionality of a law against the deliberate official action of an enlightened judge, he would besides, being forced by process of law to the proper discharge of his duties, be liable to the penalties imposed by this statute. Let not persons adopt an error into which I find a few persons have fallen, and imagine that these pro visions of the act of 1855 are in conflict with the "Army bill." Such is not the case. The Army bill by its repealing clauseoepeals, or to speak more cor rectly, proposes to repeal "all laws or parts of laws inconsistent" with itself. Acts of '57, page 281. Now, there is nothing in its provisions which in the slightest degree refers to the manner of making returns, or to the returning officer. The Sheriff hence, even were the operation of the " Army bill" not suspended by the injunction, would still be the returging officer, liable to punishment for neglect or failure to perform his duty under the Act of 1855, as I I have already shown. The " Army bill'" will be found to conflict with the Act of 1855 only with reference to the number of polls in the precincts and the appointment of its Superintendent, and the other despots it ushers into life, and in the mode of conducting the polls and appointing commissioners, and in assuming the police power of the city and creating its army of Democratic State policemen. It does not clash with the Act of 1855 in any other respect than these; and it is under t the provisions of the Act of 1853 alone that the time of holding the election is fixed, that the Governor's I proclamation has been issued, and that the returns will have to be made. Acts of '55, sees. 1, 37, 28, et ib. That the Sheriff then will do his duty, let us hope; that he can be compelled to do it, admits of no doubt. I feind that I have unconsciously exceeded the limits 1 had assigned to my commaunication. I de sign to show in my next that even if the Army bill be constitutional, an election conducted under the old law would still be valid.
