The eiiy council asks for bids for
the reconstruction of the Sixth ave
nue viaduct, the bids to be in by the
evening of Monday, November 26th.
Tho rtlans sneoifications and esti
mates of the city engineer for the
work, were approved by the council
after a threatened tangle which would
have tended to tie the whole matter
up for several weeks more. Only by
the strenuous work of Councilman C.
K. . Holliday aided and abetted by
Couneilmen Hughes and Swendson
saved the day for the viaduct forces.
The estimate was presented to the
council and as the usual procedure is
to refer all matters first to a commit-
ee before action of approval m rne
ouncil takes place Mayor W. H. Da
vis suggested that the estimate should
go. first to the ways and means com
mittee. Scenting as he thought a pre
mediated attempt to delay, Council
man Holiiday got wrathy and gave his
opinion of it in this fashion: "It seems
to be the desire of the mayor and city
engineer to throw this estimate into
the hands of the committee. I have
no objection to the evident attempt at
a little delay if we meet next week,
Monday, and advertise for bids. One
thing is certain. It's as sure as fate -J
you are going to build the viaduct
you nave got to do it now. Everybody
is disgusted with this council with
their action in the matter. The whole
thing makes me everlastingly mad.
The railroad company got disgusted
with the council and backed out of
putting up their share of the money,
it seems to me we should get down
and if we don't do anything else to
night we should approve these plans
and specifications."
James McCabe, city engineer, ad
vised the council to go over the spec
ifications carefully before approving
them.
Where the money is to come from
forthese improvements is a puzzle. One
wing of the council is opposed to the
thought of increasing the bonded in
debtedness of the city and yet at the
same time the general improvement
fund., is not of sufficient size to war
rant expending any large amount
from that source.
Other members of the council
though not opposed to increasing the
bonded indebtedness have small faith
of a successful bond election if it is
submitted to the people. The votes
for the bonds will have to come from
the Second ward, because the viaduct
is located in... thai -ward iitid interest
would be naturally greatest there tharr
ln any other ward. Yet expressions
from voters residing in that ward have
been of a character against the issu
ance of bonds. If there is opposition
in the Second ward where the opinion
should be unanimous it is believed
that the bonds will have small hope of
carrying.
"I am very much in doubt whether
we can let this contract." said Council
man Horn who opposed approving the
estimate and calling for bids until the
council had determined where it would
try to get the money. "I don't know
where we are going to g-t the money.
How can we be expected to vote on
tlrese specifications when we haven';
gone over them and don't know what
we are approving."
"Why not take the preliminary steps
towards submitting the question to the
people and then while thi-s is going on
let the estimate get to the committee,"
said t-reen.
The probability is that a special

The illustration shows a smart design for a simple frock for at-home
wear the style also bein suitable for silk, as well as for -any light-weight
cloth. The bodice was made with a yoke across the back. Thts'voke'extend
ed across each side of the front, being cut in one with curved s"trane,' which
crossed below the bust, .in surplice fashion. -
A narrow piping of checked sil k was used about the edge of the yoke,
and outlined the straps. The small buttons used were also covered With the
silk, which was in two shades of blue. The yoke and lower sleeves were of
fine white embroidery and lace, and were detachable. The skirt was plaited
and had cut pieces stitched on about the upper part, in. yoke effect.

The two spans are on the
of the viaduct right over the switch
tracks of the Santa Fe. The smoke from
the passing engines is responsible for
the heavy damages by rusting out of the
iron work of these two spans. The
other spans of the viaduct though a f e .v
of them show wear and inroads of rust
are not in such bad shape as to hav-i
to be entirely replaced. The above es
timate calls for an entire new floor for
the enire structure and the repainting
of 1t. To protect the iron work from
future rusting due to locomotive smok

The maintenance of the viaduct is en
tirely on the shoulders of the city, the
council about 16 years ago having verj
foolishly waived the right to hold the
Missouri Pacific and the Santa Fe to
their share of the maintenance.
Sunday labor won't be allowed if the
contractor attempts to rush through
with his contract. Councilman Hughes
had the specifications amended so that
Sunday labor as well as a labor day In
excess of .eight hours will be tabooed.
The penalty for exceeding .the time
limit of the contract was" raised-from
$10 to $25. - '
Some of the city employes evidently
are ignorant that city contracts can not
be participated in by employes on the
city pay roil. G. H. Origgs, paving
inspector, entered a bid for the paint
ing and repair of the Auditorium and
city hall roofs at $715. He was the
lowest bidder but the bid was thrown
out on the above account. E. Leppert
was given the contract at $720..
The street commissioner has been
instructed to open the alley bounded
by Fifth street. Sixth avenue, Monroe
and Madison Streets.
The bond of J. P. Acherfbaeh of
$2,000 as plumber's bond was ap

The council approved the engineer's
estimate of $1,379.25 for constructing
the proposed addition to the Fourth
ward sewer.
FREY IS SURELY CR6ZY.
Returns to Asylum on Own Motion
Last Kveulng.
Clarence Frye the inmate recently
transferred from the penitentiary to the
tnane asylum who made his escape
early Sunday morning- returned some
time Monday night us notes found
about the buildiner indicate, though he
was not seen either by the officers or
attendants. One of the notes which was
left at the building: when he returned
and was signed Clarence Frye read:
"Dv not hunt for me for I am now
your friend."
Another which was found pinned on
a tree near the grounds read: "This is
from Clarence Frye. I will kill anyone
who tries to arrest me. Take warning.
From Clarence Frye, 11-12-1906." Frye
has been heard from, or at least it is
supposed that he has been seen by
farmers living in the v'cinity of the
asylum.
About five o'clock Monday afternoon
the telephone at the county 1ail rang
and an excited voice conveyed the in
formation to Jailor. Law-son that -the
escaped inmate was then-at a farm near
Topeka and aking if a reward was
offered for his apprehension. When
told that no reward had been offered
for his arrest the receiver was returned
to the hook and the man at the other
end of the line had evidently come to
the conclusion that he would not bother
himself farther about the crarv man.
Frye's conduct since he made his es
cape from the institution indicates that
he ha not been shamming as the
authorities had come to suspect bu
that he is in reality crazy. The search
which had been abandonH has bee7
taken ur again with renewed vigor p.n'
It is likely that Frve will he captured
and returned to the institution and
the residents near the asylum can again
rest easy. -

suffered a slight attack of Indigestion

covered.

was at the subtreasury today. It was
understood in Wall street that he was
to consider the money situation with
a view to determining whether govern
ment aid may be necessary.

cember 3. 1906. for the repairing the Sixth
ave. viaduct as per plans and specifica
tions now on file in the office of the city
engineer and all the work will be done
under his supervision.
A certified check must accompany each
bid equal to five per cent of the proposed
contract, payable to the city of Topeka,
as a guarantee that the successful bidder
will enter into a contract with the city
within five days after the award shall be
made.
Proposals should be addressed to the
city clerk, city of Topeka, indorsed "Pro
posals for repairing the Sixth ave. via
duct." Proposals must be made in full
conformity with the specifications and on
blanks furnished by the city of Topeka.
The mayor and council reserve the right
to reject any or all bids or parts of bids.
