It shall be the duty of the clerk of the court or' justice receiving any costs be longing to any other person to hojd the same subject to the order of the person entitled thereto, and to pay the same over on request; and If such fees shall not be called fur within one year after having been received, the officer shall pay the same into the county treasury and take a receipt therefor. Sec. 44. Constructive services. No off! cer shall receive any fees for constructive cervices or mileage In any case. hec. 45. Ail fees provided for in this act shall be the same in each and every other county in the state, thereby maiung tnem uniform throughout the state. fcec. 4b. That in all counties having a county assessor, such assessor shall re ceive us compensation for his services the following sums: In counties having a population of 25.000 or less, $3.00 per day for the time actually and necessarily em ployed. In counties of over 25,000 and less than 40.000, the county assessor shall receive a salary of $900.00 per annum. In counties over 40,000 and less tha 60,080, the county assessor shall receive a salary of $1200.00 per annum, and in counties of over 60.000 such assessor shall receive the sum of $1810.00 per annum, all such sal aries to be paid out of the county treas ury in dual monthly installments. The compensation of deputy assessors shall be $3.00 per day for the time actually and necessarily employed in the discharge of their duties. Vouchers for the amounts claimed by deputy assessor shall be ap proved by the board of county commis sioners. The county commissioners mHj allow the claims of deputy assessors for their services ut any regular meeting af ter the returns made by such deputy as sessors have been duly verified and filed. Kec. 47. In all cases where the lees prescribed by this act in criminal cases for the sheriff, clerk, constables, justices of the peace, witnesses for the state, and jurors, are not paid by the defendant or the prosecuting witness, they shall be paid bv the county in which the criminal prosecution Is Instituted: provided, that rio such fees shall be paid by the board cf county commissioners until the sheriff shall have filed his affidavit that said fees cannot be collected from any other source. Src. 4S. No county in this state shall le llubli! for costs of any kind in criminal cases, whether examinations or trials, had before a justice of the peace, unless In case of conviction, or that the same have been instituted under the instructions and advice of the county attorney of such county: provided, that the county may be liable for such costs in the same manner and to the same extent in these cases as in others, whenever the county attorney shall certify in writing upon the fee bill in anv case that it was proper that such case should have been instituted, and that consultation with hlra prior thereto was Impracticable. Sec. 49. No officer serving any process shall be entitled to any fees for the same, unless he return on such process the amount of his fees and the Items thereof. Sec. 60.
