Aftornoon Session.
Tho Assembly reconvened from
recess at 1:15 o'clock, and the con
sideration of tho resolution offered
by Hop. Bush, in re tho coining elec
tion at Hilo, was continued.
Hon. S. K. Pna considered that tho
matter should be investigated and
speedy action was necessary. Ho
favored tho motion to refer to a
commit too and to report immedi
ately. Noblo 1'ot orson w as doubt f ul about
tho propriety of the resolution. It
would bo instructing tho Cabinet to
do that which was not right. Ho
offered tho following amendment:
Whereas, nccording to information
and rumor it is charged that there
has been a gross neglect of duty on
tho part of Hon. F. S. Lyman, .). P.
Sisson and Q. V. A. llapai, inspec
tors of election for tho third pre
cinct of tho district of South llilo,
Hawaii, in rof using to act in tnoir
capacity as such inspectors and
thereby obstructing tho special elec
tion to bo hold in said district on
tho 2ilth day of November, 18(.)2.
Therefore;
Bo it resolved, that tho Altornoy
Gonoral cause a strict and impaitial
investigation into the circumstances
and facts concerning the .same, and
if legal grounds exist to take such
stops towards prosecuting such
parties as may bo necessary.
Noblo Williams sympathised with
tho motho yet could not approve of
tlio passago of tho resolution.
Noble Thurston did not favor tho
resolution. Ho had heaid nothing
which would cause him to have bo
liof that any proof had been furnish
ed which in any way impeached tho
well-known high character and
standing of Judges Lyman and lla
pai or Mr. Sisson.
Kep. Bush spoke 013 strongly in
favor of tho passago of tho resolu
tion. Ho roforred to the statements
made by othor members, and was
decided in his opinion that tho acts
of tho inspectors woro a honehinj'
upon tho rights of tho general pub
lic. His voice would bo heard, even
if it had to bo heard alone, in de
fense of tho people's rights.
Hop. It. W. Wilcox did not know
exactly how to vote in tho niattor.
Tho cause, undoubtedly, originally
lies with tho inspectors up thoro at
Hilo. If the inspectors are wrong
tho3r should bo punished and ho was
of tho opinion that tho Attornoy
Gonoral would punish them, rigor
ously, if ho found that they had
wilfully evaded tho performance of
their duties. It is evident that tho
inspectors did got tho papers in
time and thoreforo tho matter need
ed investigation. Ho would not now
state tho waj in which ho would
vote on tho matter, but when tho
time came ho would not hesitate to
vote according to his view of tho
matter.
Bop. Kaniauoha said that ho con
sidered that tho tumble was with
tho inspectors, who got so puffed up
with their dignity thoy considered
they were really bigger than tho
Cabinet. Ho offered an amendment
to tho effect that tho House instruct
tho Minister of Interior to forward
tho ballots, tliero boing only 0110
candidate, and that tho election pro
ceed forthwith.
The Attorney-General objected to
the amendment of Hop. Kaniauoha
as boing an usurpation of tho rights
of tho Cabinet. Ho and a portion
of tho Cabinet did not caio if tho
House passed tho resolution. Tho
proclamation and othor papers only
wont forward on tho 11th. Tho
shortness of time would debar an
other candidate entering the iiold.
Tho fault lay with tho old Cabinet
to a certain extent, that thoy did
not leave loo-way enough, possibly
from having thoughts on other sub
jects. Hop. Kaniauoha asked if Noblo
Peterson's amendment carried would
it not postpone the election.
The Attorney-General aswered,
yes. Tho purpose of the Ministry
is to issue a new proclamation and
send it up by the Kinau to-morrow.
Noblo Thurston said that ho did
not caro to prolong the discussion,
but ho had anothor point which
should bo investigated and that was
tliat tlio petition and signatures of
Mr. Nawahi are in tho same hand
writing. Ho suggested that that
point also bo investigated, whether
or no Mr. Nawahi had aut hority from
tho voters of Hilo. Ho was not par
ticular whether it was attached to
this one or not.
On motion tho amendment of No
blo Petorson passed.
Hop. Bush said that ho had another
resolution to offer and to the effect

for election purposes the Minister of

Tho Order of tho Day coming up
tho amendment to Aiticlo 8.'J of the
Constitution came up ns follows:
Article 8!I, Tho Legislature may
from time to time enact such laws as
it may deem proper for tho super
vision and control and identification
of all pernous or any one class or
nationality who may bo introduced
into tho Kingdom for tho purpose
of performing ngricultuial labor,
and may also, by law, icstrict and
limit the term of rosidonco in tlio
Kingdom of such agricultural labor
ers and the business or omiiloyinout
in which thoy may engage.
Noblo Marsdon moved that tlio
amendment pass.
Noblo Williams said as represent
ing tho mechanical interests ho would
favor tho motion by tho Noblo from
Ilamakua. Thoro was strong objec
tion to tho unrestricted immigration
of Asiatics, neither tho foreign nor
tho Hawaiian workman could survive
competition therewith. Ho was
not a sugar planter, but, speaking
for mechanics, ho know that their
prosperity dopondod thoreon and ho
favored tho passairo ol tho bill.

Hep. Ashfoul said that tho Act

amendments after this83 had passed?
Wore the rost to bo cast away like
cast-off gaiinonts? Ho contended
that tho various aniondmonts pro
posed should bo taken up as one
bill.
Hop. Smith said that it was entire
ly competent to take any 0110 of the
amendments up sopaiately.
Noblo J. M. Hornor considered
that thoro was no good reason why
that amendment should not pass. It
was a benefit to tho country and
should so appoar to those who had
tho intorost of tho pooplo and tho
prosperity of tho kingdom at heart.
Ho favored tho pioposed amend
ment. Hop. Kaunaniano objected to tho
consideration of t his amendment bo
foro that of No. 55. Ho was not
oi"3' strongly opposed to tho amend
ment under consideration for any
other leasou.
Discussion was ended by a motion
to adjourn, but, before it was put,
tho Minister of tho Interior an
nounced that Her Majesty had boon
presented with tho bill "to bottor do
lino tho practice in trial by jury"
and also that "relating to internal
taxes" for hor signature.
Tho Assombly at 4:01 adjourned.
THE WRAMP CASE.
Memorandum by the German Consul
Intended for Royal Audience.
Mr. H. F. Glade, Gorman Consul,
has furnished us with the following
memorandum, which ho intended to
lmvo used at an audience with tho
Queen. Owing to tho action of tho
Privy Council in tho mattor, tho
audience was not requested:
Wianip was overseer on Kekaha
Plantation and had a gang of Japa
nese under him. Ono of the mon re
fused to work and had done so be
fore; so Wramp, thinking that tho
laborer was possessed of ill-will,
shoved him with his hand toward
tho work, but ho did not boat hiin
nor did ho kick him with his foot.
Tho laborer, aflor this, going to
work with more zeal and vigor than
before, soon afterward stopped and
said that ho could not jjosbibly work
any more. The overseer, noticing
from tho man's faco and appoaranco
that something must bo tho matter
with him, let him quit work and sent
him to tho office. Tho doctor boing
near tho laborer was ghon into
medical caro immediately and it was
found that tho laborer had a sovoro
rupture of which ho never had com
plained and of which tho oversoor
Wramp did not know. No doubt
tho man, being harshby told to do
his work, had overstrained himself
and thus an iuilamamtion was
brought on which caused the man to
die tho following day.

as tho Judges made tho verdict, and
for that reason tho jurors themselves
signed tho petition of pardon. Al
most everybody on Kauai found tho
punishment too hard and entirely
out of proportion. Tho petition
will show Your Majesty tho names
of the pooplo who pray Your Majosty
to pardon Wramp. The petition is
now in tho hands of tho Attornoy
Genonil and will bo laid before Your
Majesty.
Ginornor Rico was hero to wait
on Your Majesty, to speak about this
same case and to state his opinion
that ho considered W ramp's puuish
mont as far too hard and entirely
out of placo and proportion. But
tho Governor, who has also signed
tho petition, had no opportunity to
speak to Your Majesty about tho
man, and therefoio authorized mo to
ilo so in ins name, as ho was com
pelled to go back to Kauai last Tues
day. I havo taken tho liborty to la'
my request for pardon for ono of my
countrymen before Your Majesty and
hopo that my request will moot Your
Majesty's kindness, gracoand justice.
