a bill to amend Sec. 78, Chap. 61,
Law of 1892, relating to Internal
Taxes; also a bill to ro-onact a law
relating to public instruction. Tho
lattor is a law repealed accidentally
through a clorical error in tho tax
law of 1892.
Attorney-General Smith intro
duced a bill to rectify a similar blun
der made by an ongrossing clerk,
which repealed a law relating to
steamers carrying lopors.

tho Provisional Govorninonl did not

Mr. Em moluth had an instance to
rolato in support of tho position as
sumed by Mr. Damon. Ho was talk
ing to a citizen about introducing a
constitution for tho regulation of
Honolulu's affairs by themselves,
when ho was picked up with tho ex
clamation! "What in holl do wo
want of a constitution? Wo aro after
annexation'"

Councils go into oxocutivo session to
consider tho political situation,

rived to-day, 59 days from Newcas
tle, N. S. W., with 1053 tons Wall
send coal consigned to tho Oceanic
S. S. Co. Tho Puritan loft on Fob.
14, and had strong breezes part of
tho passage, several sails being torn
away. Crossed tho equator on April
5th. From thonce made an excep
tionally good run.
Captain Peterson makes tho fol
lowing report of a fatal accidont
which happened on March 7 at 4 p.
m. in Lat. 85 30' S., Lon. 1G1 -10' W.
Whilo tho vessel was ruuniug by a
strong westerly wiud aud a largo
southwest swell tho second mate,
Augustus F. Wokstrom, a native of
Sweden, aged 38 yoars, a citizen of
tho United States, fell overboard
from tho vessel's deckload. Tho acci
dont was witnessed by Frauk Svou-
son, who was working together with
Wokstrom.
Sovoral pieces of wood and also a
white painted stop was thrown close
by him, and tho vessel was brought
around to tho wind as quickly as
possible. Wont about aud passed
tho wood aud stop several times but
no sign was soon of tho mate. After
consultation with tho crow it was
concluded that tlio man was drown
ed aud the voyage was continued.
Tho inato did not know how to
swim, nnd at tho time of tho acci
dont tho schooner was going at a
ton-knot gait.

stated that they had mended mat
ters, and that the truaut husband
had decided to return. The sent
ence was consequently remitted.

This morning tho application pre
viously reported of J. A. Magoou to
bo appointed guardian of Rebecca
Pa nee Huinoku was heard by Judgo
Whiting. Sho consenting the Court
granted tho application. Her dissi
pated and improvident habits wero
tho cause for putting tho woman
under guardianship.
Judge Cooper this morning began
a hearing of Kaleialii vs. M. S. Griu
baum & Co., a bill in equit3' to es
tablish a trust croatod by parol. A
summary of tho case was published
a few days ago exclusively in tho
Bulletin. Plaintiff's suit is in bo
half of her children by John Mc
Keague, formerly her husband. A.
S. Ilartwoll for tho defendants de
murred to tho bill, whereupon tho
Court ruled that tho bill could bo
amended in a few minor points,
when the demurrer would bo over
ruled. Mr. Hart well noted an ap
peal against this ruling to tho Su
premo Court. Tho hearing on the
merits cannot bo had until a deci
sion is given on tho appeal. Antono
Rosa is counsel for plaintiff.

Tho Attorney-General also, on bo
half of the Minister of Finance, in
troduced a bill to repeal Chap. 19,
Laws of 1892, to impose au internal
levonuo tax on playing cards. Ho
spoke of tho ridicule tho law in
question had attracted, and it was
believed tho tax was in contravention
of tho reciprocity treaty with tho
United States.
Mr. Damon thought thoro was an
understanding some time ago that
thoro was to bo as little general
legislation as possible. It seoined to
him there was no end of theso little
acts.
The Attorney-General explained
that some of theso bills wore to cor
rect obvious errors of legislation. In
tho caso of tho playing cards tax,
ono house in town was selling pou
oils with a pack of cards given away.
Mr. Damon thought thoy should
draw a lino that day. Thoy should
show themselves strong enough to
stick strictly to their provisional
business, which was simply to pre
serve ordor and administer such
laws as thoy found on tho statutes.
Mr. Hrown coincided thoroughly
with the views of Mr. Damon, but
with tho reservation that, whoro
mistakes in legislation obstructed
administration or caused complica
tions with a foreign powor, such
mistakes should bo rectified.
Mr. Damon returned to the sub
ject, saying thoy should wait for tho
demands of public opinion for now
legislation. Thoro was a public
opinion hero, aud ho came to tho
Council only as a representative of
tho public. Nothing was more eager
ly looked for by him than tho ex
pressions of public opinion, which
was very much alivo in Honolulu.
Tho bills wore reforrou to tho
Judiciary Committee.
Mr. Brown, from tho samo com
mitteo, reported ho had oxamined
tho charter of t ho Holomua Publish
ing Co., and found in it nothing to
require that the inline of an editor
or publisher should bo printed in
tho paper.
The Attorney-General stated that
tho company had been incorporated
under tho old law, which did not
contain such a requirement.
Mr. Emineluth moved thnt the
matter bo referred to tho Attorno3'
Gonoral, with instructions to com
pel the company to ro-incorporato
under tho now law.
Tho Attorney-General "To tako
such action as may be found practi
cable. You cannot compel a com
pany to ro-ineorporato,"

Mr. Morgan presented a roport
from the committee on miscel
laneous subjectson tho petition of
Dunbar it Co. for permission to

on the street corners. Thoy recom
mended tho petition be grauted
with the amendment that tho
charges shall not exceed .$1 for busi

gan said they had no bill prepared,

Mr. Watorhouso objected to tho
proposed franchise. They wore not
there to impose taxes on the people,

tions of the Council.

ter was just in point with his plu
vious leiutirks. There was no doubt
that the Provisional Govuruiuont
was ablo to conduct affairs satisfac
torily for a long time, but that was

quiry it was learned that a telephone
messago had been received at tho
Station that a gang of Hawaiian
sharpshooters wore congregating in
tho Opera House. Wlion tho polico
arrived at tho Government building
tho guards wore found all armod
and ready for an attack. Tho gat
ling gun was run out in front of tho
building. Deputy-Marshal Marlin
entered tho Opora House and found
tho Hawaii Ponoi Dramatic Com
pany making preparations for tho
evening entertainment. An old rico
bird gun without barrel or trigger
was found among thoir proportios.
Tho gun was to bo used by tho ma
rine parading tho deck in tho second
scene of Captain Cook.
Thus tho matter was explained.
The guard on patrol at tho Govern
ment building had seen tho native
taking tho gun into tho Opera
Houso and, suspecting a counter
revolution, had raised an alarm aud
tho guards under Captain Zieglor
wore called out. It was somo time
beforo matters quioted down, and
tho guards realized thoro was no
foar of any troublo from tho natives.
Tho gun was borrowed from Mr.
Mullor, gunsmith, yesterday. In tho
fornior presentation of Captain Cook
no gun was used.
