Euitoh HfLLETts: -I I have waited for some, tiino to ob ' servo whether any public discussion I would tako place on tho merits of I the proposed bill to restrict Chinese 'competition by licensing "Chinese who engage iu trading or mechanic al occupations in the Hawaiian Islands.' So far there has been little said, and this has been a surprise to mo owing to the nature of the pro posed enactments, which to mo soem so subversive of tho principles of jus tice and liberty that if logically con sidered in their ultimate effects they will at ouc cause a revulsion of popular feeling against such pro posed arbitrary tyranny and confis cation of property without compen sation. 1 suppose that because it is a measure which at first sight affects Chinese only it has been received with such apparent indifference. Hut. I think, upon reflection all will see It as the entering wedge of such a career of absolute autocratic tyran ny and injustice to all races and na tionalities as has been seldom claim ed even by the most absolute despots the world" has overseen. With your permission I propose to point out some prominent inher ent defects in the proposed law. Section 1 of the bill brought in by Attornev-Oenoral Smith on Febru ary 1st defines what is meant by the term "Chinese." It is as follows: "The term 'Chiitfo' as used iu this Act shall mean any person male or female wholly of Chinese or Mon golian birth or descent, whether born iu China or elsewhere, and whet her eit iens or subjects of Chiiia or any other country." It will ho well to note here that America, Kuglatid, Kussin, France, Holland and Stmin have citizens or subjects "wholly of Chinese or Mon golian birth of dc.-ccut," and that there are iiiauv persons born iu these IIhiwIm n'l. ..lit' it I !i!ti.K,t or Mini Will leave Honolulu in J I. m., touching at I ..,... ,.i.ii. .T. ,i. ......... i " n...l il.M Laliuluu. Aud by the definition of I'Iiiiiomj iu Section I it thus prohibit Chinese Hiibjccta or cili.itiiMif various of our troaty I powers from exercising thoso rights Kuurniitcfil them By our iniitiiul treaties. So that this act, if it bo comes law, would thereby cause tho breach nil Inn actual or constructive of almost every treaty which tho Hawaiian Islands have with foreign nations, for by each of thoso treaties the subjects or citizens (without re gard to birth or descent) of caeh of the cont rni'tiiiK powers have the full right to cuter the territories of the oilier ami there abide and carry on business under no more restriction than is applicable to inery citizen or subject of the country ho is ubid ing in. This is the first uihorciit de fect iu the Act. It tiolalea almost every treaty by which Hawaii is ad mitted to an eipial footing in the family of nations of thu world. It will be observed also by this 'ml mid the two following Mictions that the value of the goodwill and stocltin-trade of any Chinese trader now iu business is at once confiscat ed without compensation. For he can neither transfer or sell to any one the business which he has built iijt, nor can his heirs carry it on after hin ileal Ii, nor can it be carried on for their benefit, as the business af- I fairs of oilier nittioiuilities and races can bo transferred or carried on. That is the second inherent defect iu the Act. It confiscates without compensation and robs a man of his property without even lieueliting Coii-luiifC).
